Justice C.N.RAMACHANDRAN NAIR\n\n Dated :06\/12\/2006\n\n O R D E R\n                      C.N.RAMACHANDRAN NAIR, J.\n\n                - - - - - - - - -  - - - - - - - - - - - - - - - - - - - - - -\n\n                          W.P.(C)NO.30245 OF 2006\n\n                - - - - - - - - -  - - - - - - - - - - - - - - - - - - - - - -\n\n                Dated this the 6th day of December 2006\n\n\n                                     JUDGMENT\n<\/pre>\n<p>       Writ     petition   is   filed   for   a   direction   to   respondents   to<\/p>\n<p>implement   Exts.P12   and   P15   orders   issued   by   the   second   and<\/p>\n<p>third   respondent   respectively   to   demolish   a   slab   over   the<\/p>\n<p>drainage canal connecting national high way on the one side and<\/p>\n<p>landed   property   on   the   other   side.     Petitioner&#8217;s   case   is   that<\/p>\n<p>petitioner is the owner of one side of the property and is entitled<\/p>\n<p>to get  the slab over the drainage     canal  connecting  petitioner&#8217;s<\/p>\n<p>property to high way demolished.\n<\/p>\n<\/p>\n<p>       2.  Government Pleader produced photograph and a sketch<\/p>\n<p>showing slab over the drainage canal connecting the main land<\/p>\n<p>to the national high way.  According to the Government Pleader,<\/p>\n<p>the   slab   is   used   by   the   public   for   going   from   the   road   to   the<\/p>\n<p>private bus stand.\n<\/p>\n<\/p>\n<p>       3.     The   counsel   appearing   for   the   additional   respondents<\/p>\n<p>filed   Ext.R6(B)   order   issued   by   the   RDO   under   Section   133   of<\/p>\n<p>Cr.P.C. upholding public right of way over the slab.   The counsel<\/p>\n<p>for  additional  respondents  also  relied   on   Ext.R6(d)   judgment   in<\/p>\n<p>W.P.(C)NO.30245 OF 2006<\/p>\n<p>                                  Page numbers<\/p>\n<p>appeal issued by Additional District Court declaring right of way<\/p>\n<p>and   granting   permanent   injunction   against   demolition   of   slab.<\/p>\n<p>The   case   of   the   additional   respondent   is   that   the   petitioner<\/p>\n<p>suppressed material facts and filed this writ   petition to get the<\/p>\n<p>slab   over   the   drainage   canal   demolished   with   the   assistance   of<\/p>\n<p>PWD.     It   is   seen   from   Exts.P8,   P7   and   P12   issued   by   PWD<\/p>\n<p>authorities   that   they   were   either   not   aware   of   the   order   of   the<\/p>\n<p>Sub Divisional Magistrate  or of the Civil  Court declaring public<\/p>\n<p>right   of   way   over   the   slab.     Ext.R6(a)   produced   by   additional<\/p>\n<p>respondent shows that there is a panchayat road connecting the<\/p>\n<p>high   way   through   the   very   same   slab.     On   the   face   of   it,   I   am<\/p>\n<p>convinced that the PWD authorities have initiated action without<\/p>\n<p>verifying factual position and without knowing the order of Sub<\/p>\n<p>Divisional Magistrate, Panchayat records and the decree passed<\/p>\n<p>by   Civil   Court.     Moreover,   if   the   photograph   and   the   sketch<\/p>\n<p>produced   by   the   Government   Pleader   represent   true   picture   of<\/p>\n<p>the   area   then   the   action   proposed   by   the   PWD   authorities   is<\/p>\n<p>absolutely illegal, arbitrary and against public interest, more so<\/p>\n<p>when there  is no scheme  for  widening  of the road.   The  orders<\/p>\n<p>W.P.(C)NO.30245 OF 2006<\/p>\n<p>                                Page numbers<\/p>\n<p>produced   by   petitioner   only   serves   destruction   of   the   slab   over<\/p>\n<p>drainage  canal   which  is under  use  by public  as is evident  from<\/p>\n<p>the documents produced by additional respondents.<\/p>\n<p>       4.  In the circumstances, the orders of the PWD authorities<\/p>\n<p>sought   to   be   enforced   by   the   petitioner   under   direction   of   this<\/p>\n<p>court   are   unenforceable.     It   is   for   the   petitioner   to   challenge<\/p>\n<p>order of the Sub Divisional Magistrate and the order of  the Civil<\/p>\n<p>Court   and   get  his  exclusive   right  over  the   slab  established  and<\/p>\n<p>then approach PWD authorities.\n<\/p>\n<\/p>\n<p>       5.     Writ     petition   is   disposed   of   declaring   that   the   PWD<\/p>\n<p>authorities in this case have no right what so ever to remove the<\/p>\n<p>slab   except   with   the   approval   of   the   Sub   Divisional   Magistrate<\/p>\n<p>and the Panchayat.\n<\/p>\n<\/p>\n<p>       Writ  petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                   C.N.RAMACHANDRAN NAIR, JUDGE<\/p>\n<p>jes<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.V.
