The petitioner is accused<\/p>\n<p>No.2 in Crime No.479 of 2009 of Perinthalmanna Police<\/p>\n<p>Station, Malappuram.\n<\/p>\n<\/p>\n<p>       2. The offences alleged against the petitioner are<\/p>\n<p>under Sections 21(b)(ii)(C) and Section 29 of the Narcotic<\/p>\n<p>Drugs and Psychotropic Substances Act.<\/p>\n<p>       3. The prosecution case is as follows:<\/p>\n<p>       On 28\/7\/2009, the police got secret information that<\/p>\n<p>sale of Narcotic Drugs was being made in a lorry parked<\/p>\n<p>near the side of Perinthalmanna-Pandikad road. The police<\/p>\n<p>party reached the spot. Accused Nos.1 to 3 were found<\/p>\n<p>inside the lorry and accused Nos.4 and 5 were found outside<\/p>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                               :: 2 ::\n<\/p>\n<p>the lorry. A quantity of 485 grams of Brown sugar was<\/p>\n<p>found in the possession of the first accused and a quantity<\/p>\n<p>of 452 grams of Brown Sugar was found in the possession<\/p>\n<p>of the second accused. Accused Nos.3, 4 and 5 were having<\/p>\n<p>possession of one gram each of Brown Sugar . The accused<\/p>\n<p>persons were arrested on 28\/7\/2009. The investigation<\/p>\n<p>reveals that Brown Sugar was brought from Ujjain and it<\/p>\n<p>was intended for sale in Kerala. The packets containing one<\/p>\n<p>gram each found in the possession of accused Nos.3, 4 and<\/p>\n<p>5 are sample packets. According to the prosecution, all the<\/p>\n<p>accused are involved in the offence in the same way and the<\/p>\n<p>offence against them is to be treated as offence involving<\/p>\n<p>commercial quantity. It is alleged that the first accused,<\/p>\n<p>Abdul Azeez, was convicted for an offence in Saudi Arabia<\/p>\n<p>and he was in jail in Jiddah for a period of about two years<\/p>\n<p>and he was later deported to India. The second accused<\/p>\n<p>Abdu @ Abdul Majeed was involved in a drug case and he<\/p>\n<p>was convicted and sentenced by a court in Bombay. The<\/p>\n<p>second accused was in jail for about five years. It is alleged<\/p>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                                :: 3 ::\n<\/p>\n<p>that other accused are close associates of accused Nos.1<\/p>\n<p>and 2 and all of them acted for the same object of the sale<\/p>\n<p>of large quantity of Brown Sugar.\n<\/p>\n<\/p>\n<p>       4. The learned Public Prosecutor opposed the Bail<\/p>\n<p>Application. The learned counsel for the petitioner submits<\/p>\n<p>that the quantitative analysis of the contraband was not<\/p>\n<p>done and therefore the continued detention of the petitioner<\/p>\n<p>after 60 days of the date of arrest is not legal and proper.<\/p>\n<p>He relies on the decision in K. K. Ashraf Vs. State of<\/p>\n<p>Kerala (2009(4) KLT 399 = 2009(4) KHC 449). In that<\/p>\n<p>case, it was held as follows:\n<\/p>\n<\/p>\n<blockquote><p>            &#8216;In E.Micheal Raj&#8217;s case, the Supreme<\/p>\n<p>      Court considered the statement of objects and<\/p>\n<p>      reasons concerning the Amendment Act of 2001<\/p>\n<p>      and also the rationalisation of sentence structure<\/p>\n<p>      and providing strict bail provisions in respect of<\/p>\n<p>      offenders who indulge in serious offences.     In<\/p>\n<p>      view of the judgment in E.Micheal Raj&#8217;s case,<\/p>\n<p>      the prosecution has to establish that the narcotic<\/p>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                                :: 4 ::\n<\/p><\/blockquote>\n<blockquote><p>      drug or psychotropic substance constitutes the<\/p>\n<p>      commercial quantity in order to attract Section<\/p>\n<p>      21(c) of the Act. In the present case, though<\/p>\n<p>      the sample was sent for quantitative analysis<\/p>\n<p>      within few days of seizure, report is not obtained<\/p>\n<p>      so far. This Bail Application was being adjourned<\/p>\n<p>      on several occasions providing maximum time to<\/p>\n<p>      the prosecution to make available the FSL report.<\/p>\n<p>      Till now the report is not obtained. Therefore,<\/p>\n<p>      there is no material before the court to come to<\/p>\n<p>      the conclusion that the contraband involves<\/p>\n<p>      commercial quantity.<\/p><\/blockquote>\n<p>             Learned Public Prosecutor submitted that<\/p>\n<p>      the requirement of proof that the content of the<\/p>\n<p>      narcotic drug in the contraband constitutes<\/p>\n<p>      commercial quantity arises only at the trial stage<\/p>\n<p>      and   it has no relevance while considering the<\/p>\n<p>      Bail Application. I am not inclined to accept this<\/p>\n<p>      contention in view of the specific provisions in<\/p>\n<p>      the Act. In order to attract Section 21(c) of the<\/p>\n<p>      Act, there must be material to show that<\/p>\n<p>      commercial quantity is involved. Such material<\/p>\n<p>      could normally be provided after a quantitative<\/p>\n<p>      analysis is made. Of course, when the quantity<\/p>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                                :: 5 ::\n<\/p>\n<p>      involved is so large that even without any<\/p>\n<p>      quantitative analysis it could be inferred that the<\/p>\n<p>      contraband constitutes a commercial quantity,<\/p>\n<p>      the position may be different. But in the present<\/p>\n<p>      case, the quantity involved is only 500 grams. It<\/p>\n<p>      cannot be inferred that the content of the<\/p>\n<p>      narcotic drug in the contraband constitutes<\/p>\n<p>      commercial quantity. That there occurs delay in<\/p>\n<p>      getting the quantitative analysis report is not a<\/p>\n<p>      ground to invoke sub-section (4) of Section 36A<\/p>\n<p>      of the Act on the ground that the contraband<\/p>\n<p>      involves commercial quantity. Unless there are<\/p>\n<p>      materials to indicate that commercial quantity is<\/p>\n<p>      involved, the court cannot apply sub-section (4)<\/p>\n<p>      of Section 36A of the Act simply because an<\/p>\n<p>      allegation is made without any material that<\/p>\n<p>      commercial quantity is involved.<\/p>\n<p>             When the law is clear and it has been<\/p>\n<p>      interpreted by the Supreme Court in E.Micheal<\/p>\n<p>      Raj&#8217;s case, it is not a consolation at all to the<\/p>\n<p>      accused who has been incarcerated in jail that<\/p>\n<p>      the report from FSL is not received. When the<\/p>\n<p>      law    provides  severe   punishment     for  drug<\/p>\n<p>      trafficking and allied offences, there must be<\/p>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                                  :: 6 ::\n<\/p>\n<p>      sufficient     infrastructural      facilities  for<\/p>\n<p>      implementing the Act and the provisions therein.<\/p>\n<p>      The freedom of citizen cannot be denied only on<\/p>\n<p>      the ground that we do not have the sufficient<\/p>\n<p>      infrastructural facilities to prove    before Court<\/p>\n<p>      without delay that the contravention involves<\/p>\n<p>      commercial quantity of the narcotic drug.&#8221;<\/p>\n<p>      5.    In view of the Judgment in K.K. Ashraf Vs.<\/p>\n<p>State of Kerala, I am of the view that the petitioner is<\/p>\n<p>entitled to get bail in the present case.<\/p>\n<p>       6. The petitioner shall be released on bail on his<\/p>\n<p>executing bond for Rs.50,000\/- with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Special<\/p>\n<p>Court (N.D.P.S. Act cases), Vadakara subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<\/p>\n<blockquote><p>      A)     The petitioner shall appear before the<br \/>\n            Investigating Officer between 9 A.M. and 1<br \/>\n            P.M. on all Mondays, till the final report is<br \/>\n            filed or until further orders;\n<\/p><\/blockquote>\n<p>B.A. NO. 6709 OF 2009<\/p>\n<p>                                 :: 7 ::\n<\/p>\n<p>      B)   The petitioner shall surrender his passport,<br \/>\n            if any, before the Special Court (N.D.P.S Act<br \/>\n            cases), Vadakara. If the petitioner does not<br \/>\n            possess a passport, an affidavit to that<br \/>\n            effect shall be filed before the court. The<br \/>\n            surrender of the passport and the filing of<br \/>\n            the affidavit, as the case may be, shall be<br \/>\n            done within a period of one week after the<br \/>\n            release of the petitioner from the jail;<\/p>\n<p>      C)    The petitioner shall not leave the State of<br \/>\n            Kerala without prior permission from the<br \/>\n            Special    Court    (N.D.P.S    Act    cases),<br \/>\n            Vadakara;\n<\/p>\n<p>      D)   The petitioner shall not try to influence the<br \/>\n            prosecution witnesses or tamper with the<br \/>\n            evidence;\n<\/p>\n<p>      E)   The petitioner shall not commit any offence<br \/>\n            or indulge in any prejudicial activity while<br \/>\n            on bail;\n<\/p>\n<p>      F)    In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to<br \/>\n            be cancelled.\n<\/p>\n<p>      The Bail Application is allowed as above.<\/p>\n<p>                                             (K.T.SANKARAN)<br \/>\n                                                    Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Abdu @ Abdul Majeed vs The Sub Inspector Of Police on 16 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6709 of 2009() 1.
