The said complaint was numbered as Criminal<br \/>\nCase No. 264 of 1982. In pursuance of the filing of the aforesaid<br \/>\ncomplaint, the trial Court issued summons to the petitioners. Being<br \/>\naggrieved by the same, the petitioners have preferred the present<br \/>\npetition.\n<\/p>\n<p>3.0\t\tLearned<br \/>\nAdvocate for the petitioners state that he is not pressing this<br \/>\npetition so far as petitioner no.1, original accused no.1 is<br \/>\nconcerned and that the matter may be decided only qua petitioner<br \/>\nno.2, original accused no.2.\n<\/p>\n<p>4.0\t\tIn<br \/>\nview of the above statement, this petition is entertained only qua<br \/>\npetitioner no.2 herein. The petition stands disposed of as not<br \/>\npressed qua petitioner no.1. Rule is discharged qua petitioner no.1.\n<\/p>\n<p>5.0\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Having gone through the impugned complaint, I find that no<br \/>\nallegation\/s, much less any specific allegation\/s, have been made<br \/>\nagainst petitioner no.2 herein. Moreover, no specific role has been<br \/>\nattributed to petitioner no.2 in the alleged offence. Even if the<br \/>\nallegations made in the impugned complaint are taken at its face<br \/>\nvalue, they do not constitute any offence. Hence, I am of the opinion<br \/>\nthat the complaint qua petitioner no.2 deserves to be quashed.\n<\/p>\n<p>6.0\t\tConsidering<br \/>\nthe facts of the case, it would be relevant to refer to a decision of<br \/>\nthe Apex Court in the case of <a href=\"\/doc\/1033637\/\">State of Haryana &amp; Ors. V.<br \/>\nBhajan Lal &amp; Ors<\/a> reported in 1992 Supp (1) SCC 335<br \/>\nwherein, the Apex Court has broadly set out the circumstances in<br \/>\nwhich the High Court can exercise the power under Section 482 of<br \/>\nCriminal Procedure Court. Paragraphs 102 and 103 thereof read as<br \/>\nunder:\n<\/p>\n<p>\t The<br \/>\nfollowing categories of cases can be stated by way of illustration<br \/>\nwherein the extraordinary power under Article 226 or the inherent<br \/>\npowers under Section 482 CrPC can be exercised by the High Court<br \/>\neither to prevent abuse of the process of any court or otherwise to<br \/>\nsecure the ends of justice, though it may not be possible to lay down<br \/>\nany precise, clearly defined and sufficiently channelized and<br \/>\ninflexible guidelines or rigid formula and to give an exhaustive list<br \/>\nof myriad kinds of cases wherein such power should be exercised<\/p>\n<p>Where<br \/>\n\tthe allegations made in the first information report or the<br \/>\n\tcomplaint, even if they are taken at their face value and accepted<br \/>\n\tin their entirety do not prima facie constitute any offence or make<br \/>\n\tout a case against the accused.\n<\/p>\n<p>Where<br \/>\n\tthe allegations in the FIR do not disclose a cognizable offence,<br \/>\n\tjustifying an investigation by police officers under Section 156(1)<br \/>\n\tof the Code except under an order of a Magistrate within the purview<br \/>\n\tof Section 155(2) of the Code.\n<\/p>\n<p>Where<br \/>\n\tthe uncontroverted allegations made in the FIR or complaint and the<br \/>\n\tevidence collected in support of the same do not disclose the<br \/>\n\tcommission of any offence and make out a case against the accused.\n<\/p>\n<p>Where,<br \/>\n\tthe allegations in the FIR do not constitute a cognizable offence<br \/>\n\tbut constitute only a non-cognizable offence, no investigation is<br \/>\n\tpermitted by a police officer without an order of a Magistrate as<br \/>\n\tcontemplated under Section 155(2) of the Code.\n<\/p>\n<p>Where<br \/>\n\tthe allegations made in the FIR or complaint are so absurd and<br \/>\n\tinherently improbable on the basis of which no prudent persons can<br \/>\n\tever reach a just conclusion that there is sufficient grounds for<br \/>\n\tproceeding against the accused.\n<\/p>\n<p>Where<br \/>\n\tthere is an express legal bar engrafted in any of the provisions of<br \/>\n\tthe Code or the concerned Act (under which a criminal proceeding is<br \/>\n\tinstituted) to the institution and continuance of the proceedings<br \/>\n\tand\/or where there is a specific provisions in the Code or the<br \/>\n\tconcerned Act, providing efficacious redress for the grievance of<br \/>\n\tthe aggrieved party.\n<\/p>\n<p>Where<br \/>\n\ta criminal proceeding is manifestly attended with mala fide and\/or<br \/>\n\twhere the proceeding is maliciously instituted with an ulterior<br \/>\n\tmotive for wreaking vengeance on the accused and with a view to<br \/>\n\tspite him due to private and personal grudge.\n<\/p>\n<p>7.0\t\tKeeping<br \/>\nin mind the principle laid down by the Apex Court in the aforesaid<br \/>\ndecision, I am of the opinion that the impugned complaint cannot be<br \/>\nsustained in the eyes of law and deserves to be quashed and set aside<br \/>\nqua petitioner no.2 herein.\n<\/p>\n<p>8.0\t\tConsequently,<br \/>\nthe application is partly allowed. The private<br \/>\ncriminal complaint being numbered as Criminal Case No.264 of 1982<br \/>\npending before the Court of learned Metropolitan Magistrate, Court<br \/>\nNo.5, Ahmedabad and the consequential proceedings initiated thereto,<br \/>\nare quashed and set aside only qua petitioner no.2, original accused<br \/>\nno.2.
