No.18778 of 2011\n                                 Subhash Prasad Singh\n                                           Versus\n                                   The State Of Bihar\n                                         -----------\n<\/pre>\n<p>3   29-07-2011                Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                              Initially, the informant filed Complaint Case which was<\/p>\n<p>                 converted into Banka P.S. Case No. 206 of 2007 registered<\/p>\n<p>                 under Sections-304(B), 201\/34 of the Indian Penal Code.<\/p>\n<p>                 Admittedly, the petitioner is father-in-law of the informant&#8217;s<\/p>\n<p>                 daughter and it is also admitted position that relation of the son<\/p>\n<p>                 of the petitioner with his wife i.e. daughter-in-law         of the<\/p>\n<p>                 petitioner    was not cordial and the victim (daughter of the<\/p>\n<p>                 informant) had filed a case under section-498A of the Indian<\/p>\n<p>                 Penal Code in which a settlement took place and the victim left<\/p>\n<p>                 alongwith her husband for             her matrimonial home but<\/p>\n<p>                 submission on behalf of the petitioner is that while the<\/p>\n<p>                 informant&#8217;s daughter was being taken to her matrimonial home<\/p>\n<p>                 by her husband, she was forcibly taken away by her brother as<\/p>\n<p>                 well as brother-in-law and after that, her marriage was<\/p>\n<p>                 solemnized with another person in U.P. and the exact<\/p>\n<p>                 whereabouts of the alleged victim is not known to the petitioner.<\/p>\n<p>                 It is also pointed out by him that for the above-said incident, the<\/p>\n<p>                 husband of the victim had already filed an informatory petition<\/p>\n<p>                 before the Sub Divisional Judicial Magistrate, Banka. In support<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        of his contention, he produced Photostat copy of the certified<\/p>\n<p>        copy of aforesaid informatory petition.\n<\/p>\n<p>                   It appears from perusal of the case diary that in<\/p>\n<p>        course of investigation, some witnesses have    supported the<\/p>\n<p>        above said stand of the petitioner.\n<\/p>\n<p>                   Taking into consideration the aforesaid facts and<\/p>\n<p>        circumstances as well as submission of the parties, let the<\/p>\n<p>        petitioner, namely, Subhash Prasad Singh be released on bail<\/p>\n<p>        on furnishing bail bonds of Rs 10,000\/- (ten thousand) with two<\/p>\n<p>        sureties of the like amount each in connection with Banka P.S.<\/p>\n<p>        Case No. 206 of 2007 to the satisfaction of Chief Judicial<\/p>\n<p>        Magistrate, Banka.\n<\/p>\n<\/p>\n<pre>AKV\/-                                  ( Hemant Kumar Srivastava,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Subhash Prasad Singh vs The State Of Bihar on 29 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
