She\n\nacquired    post        appointment         training   relating       to    the\n\npost of Para Teacher from 26.6.2003 to 22.7.2003 and\n\non 23.7.2003 she joined duties as Para Teacher. In\n\npursuant     to     an    advertisement          dated      31.5.2008       the\n\npetitioner    applied          for   appointment       to      the   post    of\n\nPrabodhak in District Sirohi, however, her candidature\n                                          2\n\nwas    rejected      by     the    respondents        by    treating        her    a\n\nperson    not       having    requisite       teaching        experience          of\n\nfive years. Being aggrieved by the same this petition\n\nfor writ is preferred.\n\n\n\n               As per the petitioner the period of training\n\nundertaken by her as a consequent to appointment to\n\nthe post of Para Teacher is required to be treated as\n\npart of teaching experience and by including that she\n\ncompletes five years teaching experience.\n\n\n\n               The    controversy        involved      in     this      petition\n\nfor writ as a matter of fact is no more res integra in\n\nview of the judgment of this Court in the case of\n\nShankar Lal v. State of Rajasthan &amp; Ors., SBCivil Writ\n\nPetition No.6766\/2008, decided on 15.10.2008. In the\n\ncase     aforesaid        a   view      is   taken     that       the     period\n\nrelating to the post appointment training relating to\n\nthe    post     of    Para     Teacher       is   a    part      of     teaching\n\nexperience      and    that        is   required      to    be   included         in\n\nteaching experience while considering candidature of a\n\nperson for appointment to the post of Prabodhak.\n\n\n\n               In    view     of    that,    this     petition        for    writ\n\ndeserves acceptance, the same, therefore, is allowed.\n\nThe rejection of the petitioner's candidature on the\n\ncount     of    lacking       teaching       experience          is     declared\n\nillegal.
