JUSTICE BIRENDRA PRASAD VERMA\nORAL ORDER<\/pre>\n<p>(Per: HONOURABLE THE CHIEF JUSTICE)<br \/>\n<span class=\"hidden_text\"> 2         Patna High Court LPA No.1154 of 2011 (2) dt.18-08-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                 2\/3<\/span><\/p>\n<p>2.   18-08-2011 Interlocutory Application No. 5621 of 2011:\n<\/p>\n<blockquote><p>                                    The delay of 78 days occurred in filing the Letters<br \/>\n                   Patent Appeal is condoned.\n<\/p><\/blockquote>\n<blockquote><p>                                    Interlocutory Application stands disposed of.<br \/>\n                   Letters Patent Appeal No.1154 of 2011:\n<\/p><\/blockquote>\n<blockquote><p>                                    Feeling aggrieved by the judgment and order dated 1st<br \/>\n                   April 2011 passed by the learned single Judge in above C.W.J.C.<br \/>\n                   No. 10195 of 2008 the writ petitioner has preferred the present<br \/>\n                   Appeal under Clause 10 of the Letters Patent.\n<\/p><\/blockquote>\n<blockquote><p>                                    The matter at dispute is a tractor purchased by the<br \/>\n                   appellant hypothecated to the respondent State Bank of India. On<br \/>\n                   account of failure of the appellant to repay the loan amount as<br \/>\n                   scheduled, the tractor hypothecated to the Bank was seized by the<br \/>\n                   Bank. Feeling aggrieved the appellant filed above C.W.J.C. No.<br \/>\n                   10195 of 2008 for release of the tractor and the other reliefs. The<br \/>\n                   learned single Judge has allowed the writ petition to the extent that<br \/>\n                   the tractor is ordered to be released on condition that the appellant<br \/>\n                   pays      Rs.25,000\/- towards the outstanding loan amount. The<br \/>\n                   Bank is directed to reschedule the repayment of the balance loan<br \/>\n                   amount.\n<\/p><\/blockquote>\n<blockquote><p>                                    It is the grievance of the appellant that the<br \/>\n                   relief\/subsidy granted by the State Government to the farmers has<br \/>\n                   not been credited to the account of the appellant which has<br \/>\n                   resulted into outstanding dues. If proper credits were made, the<br \/>\n                   appellant has already repaid the loan amount. The condition to pay<br \/>\n                   Rs.25,000\/- and the direction of reschedulement of outstanding<br \/>\n                   loan amount are, therefore, unsustainable.\n<\/p><\/blockquote>\n<blockquote><p>                                    Learned advocate Mr. Radhe Shyam Prasad has also<br \/>\n                   submitted       that    the     tractor     was   seized   by   the   Bank<br \/>\n<span class=\"hidden_text\"> 3         Patna High Court LPA No.1154 of 2011 (2) dt.18-08-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                3\/3<\/span><\/p>\n<p>                   unceremoniously, leaving the appellant without the livelihood.<br \/>\n                   Immense damage has been caused to the appellant.\n<\/p><\/blockquote>\n<blockquote><p>                                    Be that as it may, the action of the Bank in seizing<br \/>\n                   the tractor is not challenged by the appellant in the writ petition.<br \/>\n                   For settlement of account, a petition under Article 226 of the<br \/>\n                   Constitution would not lie. If the appellant has any grievance with<br \/>\n                   respect to the correctness of the accounts he may avail of the<br \/>\n                   remedy before the civil court. Insofar as the release of tractor is<br \/>\n                   concerned, the condition imposed by the learned single Judge does<br \/>\n                   not seem to be inappropriate.\n<\/p><\/blockquote>\n<blockquote><p>                                    No case for interference is made out. Appeal is<br \/>\n                   dismissed in limine.\n<\/p><\/blockquote>\n<blockquote><p>                                    The period for payment of Rs.25,000\/- specified by<br \/>\n                   the learned single Judge is extended up to 30th September 2011.<\/p><\/blockquote>\n<p>                                                  (R.M.
