Raval waives service of Rule on behalf of the<br \/>\n\trespondent ?  State. Heard.\n<\/p>\n<p>The<br \/>\n\tpresent Application, under Section 439 Cr.P.C., is filed by the<br \/>\n\tapplicant for enlarging him on regular bail in connection with CR<br \/>\n\tNo.I-2 of 2008, registered at Chalala Police Station, District<br \/>\n\tAmreli, for the offences punishable under Section 489-B and 489-C of<br \/>\n\tIndian Penal Code (for short ?SI.P. Code??).\n<\/p>\n<p>Earlier<br \/>\n\tthe present applicant has filed Bail Application in the Court of<br \/>\n\tlearned J.M.F.C., Dhari and the same was rejected by the learned<br \/>\n\tMagistrate vide order dated 7.2.2008. Thereafter, the applicant<br \/>\n\tpreferred regular bail Application under Section 439 in the Sessions<br \/>\n\tCourt, Amreli, being Misc. Criminal Application No.168 of 2008. The<br \/>\n\tlearned Sessions Judge, Amreli, rejected the said application with<br \/>\n\tsound reason, by order dated 24.4.2008. Thereafter, the present<br \/>\n\tapplicant approached this Court by filing Criminal Misc. Application<br \/>\n\tNo.7021 of 2008. The said Application was dismissed as withdrawn by<br \/>\n\torder dated 10.6.2008, passed by this Court. Thereafter, the present<br \/>\n\tApplication is filed by the applicant under Section 439 Cr.P.C. for<br \/>\n\tenlarging him on regular Bail.\n<\/p>\n<p>Heard<br \/>\n\tlerned Advocate Mr. Buch for the applicant and learned A.P.P. Mr.<br \/>\n\tRaval for the State.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tBuch contended that in this case the applicant is charged for the<br \/>\n\toffences punishable under Sections 489-A, 489-B, 489-C and 434<br \/>\n\tI.P.Code. He contended that the prosecution has not alleged that the<br \/>\n\tapplicant performed or even participated in performance of any such<br \/>\n\tprocess of counterfeiting and he cannot be booked under Section<br \/>\n\t489-A I.P. Code. It is also contended that from the allegation made<br \/>\n\tagainst the applicant for the alleged offence of Section 389-C<br \/>\n\tI.P.Code FIR does not corroborate and there is no iota of evidence<br \/>\n\tto show the presence of knowledge to the applicant that the currency<br \/>\n\tnote is counterfeit on fake currency notes. He also contended that<br \/>\n\tfrom the papers of charge-sheet, no prima-facie case is made out and<br \/>\n\tit is a fit case to grant regular bail to the applicant. It is also<br \/>\n\tcontended that there are 38 witnesses which are likely to be<br \/>\n\texamined and for that it will take longer period to complete the<br \/>\n\ttrial and, therefore, also the applicant may be enlarged on bail.\n<\/p>\n<p>Learned<br \/>\n\tAPP Mr. Raval has read the charge-sheet and contended that 94 fake<br \/>\n\tcurrency notes of Rs.1000\/- denominaton each were seized from the<br \/>\n\tpossession of the applicant ?  accused. He contended that the<br \/>\n\toffence alleged against the applicant is very serious in nature and,<br \/>\n\ttherefore, the application is required to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave gone through the charge-sheet papers. Prima-facie the<br \/>\n\tinvolvement of the present applicant is established and under the<br \/>\n\tdiscovery panchnama, 94 fake currency notes of Rs.1000\/-<br \/>\n\tdenomination each have been found from the possession of the<br \/>\n\tapplicant ?  accused.\n<\/p>\n<p>From<br \/>\n\tthe perusal of the papers it transpires that the allegations against<br \/>\n\tthe applicant are very serious in nature and the gravity of offence<br \/>\n\tis quite obvious and it relates to the economy and economical<br \/>\n\ttransaction of the State as well as the whole country and it will<br \/>\n\taffect the financial schemes of the nation. Therefore, the Court<br \/>\n\tcannot enter into the moral issue when the alleged offence is<br \/>\n\tharmful to the economy of nation. When in such type of recovery of<br \/>\n\tused fake currency notes made out against the accused, then no<br \/>\n\tleniency can be shown to such type of offender.\n<\/p>\n<p>The<br \/>\n\tallegations made by the prosecution has no doubt, still to be<br \/>\n\testablished at the trial. It is true that it is suggested that the<br \/>\n\trespondent and the person accused along with him are persons of easy<br \/>\n\tconscience, so far as the interest and security of the country are<br \/>\n\tconcerned and current situation in the country is such that it can<br \/>\n\teasily be exploited by unscrupulous men to their own or to some<br \/>\n\tforeign powers advantage.\n<\/p>\n<p>It<br \/>\n\tis true that in bail matters the High Court should become the final<br \/>\n\tauthority. Normally, it is settled that the Apex Court should<br \/>\n\tinterfere only in the limited class of cases when there is a<br \/>\n\tsubstantial question of law involved which needs to be finally set<br \/>\n\tat rest by the Apex Court for the whole country, or where there is<br \/>\n\tgrave blatant and atrocious miscarriage of justice. In such type of<br \/>\n\tcases, like the present one, the Judge may not shut his eyes to do<br \/>\n\tinjustice but he must equally not keep his eye too wide open,<br \/>\n\totherwise the Court would not be able to perform the high and noble<br \/>\n\trole to perform according to the faith of the Constitution maker.\n<\/p>\n<p>It<br \/>\n\tis also to be noted that the present applicant is a resident of<br \/>\n\tMumbai. I have examined all the evidence and elaborate scrutiny of<br \/>\n\tthe evidence. It is likely that the presence of the accused may not<br \/>\n\tbe secured at the time of trial and likelihood of witnesses being<br \/>\n\ttampered and, therefore, in the larger interest of the State and<br \/>\n\tsociety it is not desirable to exercise the judicial discretion in<br \/>\n\tgranting bail in such grave offence. The learned Sessions Judge has<br \/>\n\tmade detailed discussion and has given sound reasons against the<br \/>\n\tprayer of grant of bail and offered his opinion in substance about<br \/>\n\texistence of prima-facie case. The learned Judge has considered all<br \/>\n\tthe circumstances of the case and he has not simply and casually<br \/>\n\tdismissed the bail application of the applicant. It is true that<br \/>\n\tduring the hearing of Bail Application under Section 439 Cr.P.C. the<br \/>\n\tCourt cannot go into the details of evidence to find out that the<br \/>\n\tevidence will be sufficient to establish the guilt of the applicant<br \/>\n\tbeyond reasonable doubt, but even then the Court can look at prima<br \/>\n\tfacie case against the accused.\n<\/p>\n<p>It<br \/>\n\tappears that the present applicant is involved in the case of fake<br \/>\n\tcurrency Notes and due to the act of present applicant economical<br \/>\n\tand financial situation, dealing and transaction of the State as<br \/>\n\twell as the whole country can be disturbed and serious consequences<br \/>\n\twould follow and the same can  disturb the situation of law and<br \/>\n\torder also. It is found from the papers that prima-facie it is<br \/>\n\testablished that the applicant has committed grave and serious<br \/>\n\toffence and, therefore, it is not desirable to exercise discretion<br \/>\n\tin favour of the applicant and this is a fit case to dismiss the<br \/>\n\tapplication of the applicant.\n<\/p>\n<p>In<br \/>\n\tview of what is observed herein above, this Application is<br \/>\n\tdismissed. Accordingly, it is dismissed.
