Justice K.M.JOSEPH\n\n Dated :06\/11\/2007\n\n O R D E R\n                          K.M.JOSEPH, J.\n                   - - - - - - - - - - - - - - - - - - - - -\n              W.P.(c).No. 8899 OF 2007\n               - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 6th day of November, 2007\n\n                               JUDGMENT\n<\/pre>\n<p>      Petitioner has approached this court on the following brief<\/p>\n<p>allegations.\n<\/p>\n<p>      Petitioner is a Co-operative Society. It is the only society<\/p>\n<p>with net profit of Rs. 15 lakhs during 98 to 2006.                 Pursuant to<\/p>\n<p>the enquiry proceedings, former employee of the society<\/p>\n<p>Sri.V.R.Ratnappan was dismissed from the service of the society<\/p>\n<p>in 2002 with effect from the date of suspension.                   It is further<\/p>\n<p>stated that V.R. Retnappan filed a complaint before the Minister<\/p>\n<p>alleging that he has not allowed to be reinstated pursuant to the<\/p>\n<p>direction of the Labour Court.         The Minister who is impleaded in<\/p>\n<p>the personal capacity as additional third respondent without<\/p>\n<p>obtaining any reply from the petitioner directed the second<\/p>\n<p>respondent to order enquiry under Section 66 of the Act. Second<\/p>\n<p>respondent by order dated 12\/01\/2006 (Ext.P2) directed the<\/p>\n<p>Arbitrator-Sale Officer, Project Office (Coir), Alappuzha to have an<\/p>\n<p>inspection of the financial affairs between the society and the<\/p>\n<p><span class=\"hidden_text\">WPC No.8899\/07                    2<\/span><\/p>\n<p>former employee V.R. Retnappan and the enquiry is still pending.<\/p>\n<p>It is the case of the petitioner that former secretary upon getting<\/p>\n<p>employment in the state service resigned from the society and<\/p>\n<p>now a member of the society is acting in-charge of the Secretary.<\/p>\n<p>Vacancy was notified and Coir Project Officer accorded sanction<\/p>\n<p>for conducting a test for the appointment of Secretary of the<\/p>\n<p>petitioner.   Applications were invited and the written test was<\/p>\n<p>scheduled to be held on 22.02.2007.         In the meantime, four<\/p>\n<p>members of the society submitted a complaint before the Minister<\/p>\n<p>stating that V.R. Retnappan was not reinstated in service and he<\/p>\n<p>is also entitled to get the post of Secretary        and therefore<\/p>\n<p>requested    to   stop  the   recruitment    proceedings   for   the<\/p>\n<p>appointment of Secretary to the petitioner. The third respondent ,<\/p>\n<p>by order dated 21\/02\/2007 directed the respondent to stop all<\/p>\n<p>recruitment processes since enquiry under Section 66 has been<\/p>\n<p>commenced.\n<\/p>\n<p>       2.   The main contention of the petitioner is that the<\/p>\n<p>Minister has absolutely no authority in law to interfere with<\/p>\n<p>recruitment process.      I heard learned counsel for the petitioner<\/p>\n<p>and the learned Government Pleader.\n<\/p>\n<p>       3.   Learned counsel for the petitioner relied on the<\/p>\n<p><span class=\"hidden_text\">WPC No.8899\/07                   3<\/span><\/p>\n<p>decision of the Full Bench in <a href=\"\/doc\/896741\/\">Aji v. State of Kerala<\/a> (1995(1)KLT<\/p>\n<p>363) to contend that there is total absence of jurisdiction with the<\/p>\n<p>Minister to interfere with the recruitment process.       Petitioner<\/p>\n<p>further contends that no powers are available with the Minister to<\/p>\n<p>pass the impugned order. I find that there is considerable merit in<\/p>\n<p>the contention of the petitioner that the third respondent had no<\/p>\n<p>authority to interfere with the matter as he has done and the<\/p>\n<p>impugned order is liable to be quashed.
