H.L.JANI, ADDITIONAL\nPUBLIC PROSECUTOR for\nRespondent1 \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThe present<br \/>\n\tapplication has been filed by the Applicant accused under Section<br \/>\n\t439 of Criminal Procedure Code for grant of regular bail after the<br \/>\n\tcharge sheet is filed.\n<\/p>\n<p>\tThe Applicant<br \/>\n\taccused is charged with having committed offence under Sections<br \/>\n\t489(A), (B), (C), (D), 120B, 201 and 114 of the Indian Penal Code,<br \/>\n\tfor which complaint has been lodged being I-CR No. 100 of 2009 with<br \/>\n\tGodhra Town Police Station, District Panchmahal.\n<\/p>\n<p>\tLearned Advocate Mr.<br \/>\n\tNirav Mishra for the Applicant accused referred to the FIR and also<br \/>\n\tthe material and submitted that the present application is filed<br \/>\n\tafter the charge sheet as a successive bail application and earlier<br \/>\n\tCriminal Misc. Application No. 7206 of 2009 was rejected.  However,<br \/>\n\the submitted that almost about a year has passed, the trial has not<br \/>\n\tproceeded.  He also submitted that the other co-accused having<br \/>\n\tsimilar role have been released as per the order passed in Criminal<br \/>\n\tMisc. Application No. 12789 of 2009 dated 4.12.2009 as well as<br \/>\n\tCriminal Misc. application No. 12001 of 2009 dated 14.10.2009.  He<br \/>\n\ttherefore submitted that the present application may be allowed.\n<\/p>\n<p>\tLearned APP Mr.<br \/>\n\tH.L.Jani resisted the application and submitted that considering the<br \/>\n\trole and since it is a successive bail application, the present<br \/>\n\tapplication may not be entertained though he fairly stated that the<br \/>\n\tother co-accused have been released subsequently and also confirmed<br \/>\n\tthat the trial has not commenced.\n<\/p>\n<p>\tHaving heard learned<br \/>\n\tAdvocate Mr. Nirav Mishra for the Applicant accused and learned APP<br \/>\n\tMr. H.L.Jani and having regard to the aforesaid circumstances,<br \/>\n\tincluding the fact that the trial has not commenced and the other<br \/>\n\tco-accused have been released as stated above, the present<br \/>\n\tapplication deserves to be allowed.\n<\/p>\n<p>\tAccordingly, the<br \/>\n\tpresent application stands allowed.  The applicant   Taherbhai<br \/>\n\tAbbasbhai Piplodwala is ordered to be released on bail in connection<br \/>\n\twith I-CR No. 100 of 2009 registered with Godhra Town Police<br \/>\n\tStation, District Panchmahal, on his executing a bond of Rs.10,000\/-<br \/>\n\t(Rupees Ten Thousand), with one solvent surety of the like amount to<br \/>\n\tthe satisfaction of the lower Court and subject to the conditions<br \/>\n\tthat he shall:\n<\/p>\n<p>\t(a)\t\tnot take undue<br \/>\n\tadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>\t(b)\t\tnot to try to<br \/>\n\ttamper or pressurize the prosecution witnesses or complainant in any<br \/>\n\tmanner.\n<\/p>\n<p>\t(c)\t\tnot act in any<br \/>\n\tmanner injurious to the interest of the prosecution.\n<\/p>\n<p>\t(d)\t\tmaintain law and<br \/>\n\torder and should cooperate the investigating officers.\n<\/p>\n<p>\t(e)\t\tmark his presence<br \/>\n\tbefore Godhra Town Police Station on every 1st and 15th<br \/>\n\tday of calendar month between 11:00 AM to 2:00 PM till the trial<br \/>\n\tcommences.\n<\/p>\n<p>\t(f)\t\tfurnish the<br \/>\n\taddress of his residence to the Investigating Officer and also to<br \/>\n\tthe Court at the time of execution of the bond and shall not change<br \/>\n\this residence without prior permission of the Court.\n<\/p>\n<p>\t(g)\t\tsurrender his<br \/>\n\tpassport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf breach of any of<br \/>\n\tthe above conditions is committed, the concerned Sessions Judge will<br \/>\n\tbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>\tBail before the lower<br \/>\n\tCourt having jurisdiction to try the case.
