This\u00a0petition\u00a0by\u00a0the\u00a0landlord\u00a0is\u00a0directed\u00a0against\u00a0an\u00a0appellate\u00a0<br \/>\norder \u00a0 dated \u00a0 11th\u00a0 of \u00a0 January \u00a0 2008 \u00a0 by \u00a0 which \u00a0 the \u00a0 appeal \u00a0 of \u00a0 the\u00a0<br \/>\nrespondent \u00a0 tenant \u00a0 against \u00a0 release \u00a0 of \u00a0 the \u00a0 disputed \u00a0 shop \u00a0 has \u00a0 been\u00a0<br \/>\nallowed.\u00a0\n<\/p>\n<p>       The \u00a0 petitioner \u00a0 landlord \u00a0 filed \u00a0 a \u00a0 release \u00a0 application \u00a0 No. \u00a0 3 \u00a0 of\u00a0<br \/>\n1994\u00a0inter\u00a0alia\u00a0with\u00a0the\u00a0allegation\u00a0that\u00a0the\u00a0respondent\u00a0was\u00a0a\u00a0tenant\u00a0<br \/>\nof \u00a0 the \u00a0 disputed \u00a0 shop\u00a0 @ \u00a0 Rs.25\/\u00ad \u00a0 per \u00a0 month \u00a0 apart \u00a0 from \u00a0 house \u00a0 and\u00a0<br \/>\nwater \u00a0 tax \u00a0 which \u00a0 is \u00a0 situated \u00a0 near \u00a0 the \u00a0 main \u00a0 crossing \u00a0 of \u00a0 Khurja \u00a0 in\u00a0<br \/>\nBulandshahr \u00a0 which \u00a0 is \u00a0 a \u00a0 prime \u00a0 business \u00a0 location \u00a0 and \u00a0 having \u00a0 a\u00a0<br \/>\ndimension\u00a0of\u00a012&#8242;\u00a0x\u00a07&#8242;.\u00a0Navneet\u00a0Kumar,\u00a0the\u00a0son\u00a0of\u00a0the\u00a0landlord\u00a0after\u00a0<br \/>\nseveral\u00a0attempts\u00a0was\u00a0able\u00a0to\u00a0clear\u00a0his\u00a0IX\u00a0class\u00a0but\u00a0is\u00a0not\u00a0 \u00a0good\u00a0in\u00a0<br \/>\nstudies \u00a0 and \u00a0 therefore \u00a0 he \u00a0 wanted \u00a0 to \u00a0 settle \u00a0 his \u00a0 son \u00a0 in \u00a0 the \u00a0 disputed\u00a0<br \/>\nshop.\u00a0The\u00a0release\u00a0application\u00a0was\u00a0contested\u00a0by\u00a0the\u00a0respondent\u00a0tenant\u00a0<br \/>\nand \u00a0 after \u00a0 contest, \u00a0 the \u00a0 release \u00a0 application \u00a0 was \u00a0 allowed \u00a0 by \u00a0 an\u00a0<br \/>\nexhaustive\u00a0order\u00a0dated\u00a010th\u00a0 of\u00a0July\u00a01997\u00a0against\u00a0which\u00a0the\u00a0tenant\u00a0<br \/>\npreferred\u00a0an\u00a0Appeal\u00a0No.\u00a020\u00a0of\u00a01997\u00a0which\u00a0has\u00a0been\u00a0allowed\u00a0on\u00a0the\u00a0<br \/>\nbasis\u00a0of\u00a0the\u00a0subsequent\u00a0events.\n<\/p>\n<p>       It \u00a0 appears \u00a0 that \u00a0 the \u00a0 wife \u00a0 of \u00a0 the \u00a0 petitioner \u00a0 landlord \u00a0 was \u00a0 the\u00a0<br \/>\nowner\u00a0and\u00a0landlord\u00a0of\u00a0two\u00a0other\u00a0shops\u00a0which\u00a0were\u00a0in\u00a0possession\u00a0of\u00a0<br \/>\ntwo\u00a0tenants\u00a0viz;\u00a0Jumma\u00a0Khan\u00a0and\u00a0Dal\u00a0Chand\u00a0and\u00a0she\u00a0had\u00a0moved\u00a0an\u00a0<br \/>\napplication\u00a0for\u00a0release\u00a0under\u00a0Section\u00a021\u00a0(1)(b)\u00a0of\u00a0U.P.\u00a0Act\u00a0No.\u00a013\u00a0of\u00a0<br \/>\n1972\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0it\u00a0was\u00a0in\u00a0a\u00a0dilapidated\u00a0condition\u00a0and\u00a0needed\u00a0<br \/>\ndemolition\u00a0and\u00a0 \u00a0reconstruction.\u00a0The\u00a0matter\u00a0reached\u00a0the\u00a0Apex\u00a0Court\u00a0<br \/>\nwhere \u00a0 the \u00a0 shops \u00a0 were \u00a0 released \u00a0 on \u00a0 agreed \u00a0 condition \u00a0 between \u00a0 the\u00a0<br \/>\nparties\u00a0that\u00a0after\u00a0reconstruction\u00a0both\u00a0the\u00a0tenants\u00a0will\u00a0be\u00a0reinducted\u00a0<br \/>\nin\u00a0the\u00a0two\u00a0shops\u00a0@\u00a0Rs.375\/\u00ad\u00a0per\u00a0month\u00a0and\u00a0accordingly\u00a0the\u00a0appeal\u00a0<br \/>\nwas\u00a0finally\u00a0disposed\u00a0off\u00a0on\u00a029th\u00a0 of\u00a0October\u00a01999.\u00a0It\u00a0appears\u00a0that\u00a0in\u00a0<br \/>\n<span class=\"hidden_text\">                                                                                      2<\/span><\/p>\n<p>pursuance\u00a0of\u00a0the\u00a0said\u00a0order,\u00a0the\u00a0petitioner&#8217;s\u00a0wife\u00a0\u00a0demolished\u00a0the\u00a0said\u00a0<br \/>\nshops \u00a0 and \u00a0 made \u00a0 new \u00a0 constructions \u00a0 and \u00a0 allegedly \u00a0 let \u00a0 out \u00a0 the \u00a0 two\u00a0<br \/>\nshops\u00a0to\u00a0those\u00a0tenants\u00a0but\u00a0subsequently \u00a0the\u00a0shop\u00a0of \u00a0Jumma \u00a0Khan\u00a0<br \/>\nwas\u00a0sold.\u00a0The\u00a0respondent\u00a0tenant\u00a0moved\u00a0an\u00a0amendment\u00a0application\u00a0<br \/>\nbringing\u00a0on\u00a0record\u00a0that\u00a0out\u00a0of\u00a0the\u00a0two\u00a0newly\u00a0constructed\u00a0shops\u00a0on\u00a0<br \/>\nthe \u00a0 ground \u00a0 floor, \u00a0 the \u00a0 petitioner&#8217;s \u00a0 wife \u00a0 \u00a0 had \u00a0 not \u00a0 inducted \u00a0 Jumma\u00a0<br \/>\nKhan,\u00a0the\u00a0erstwhile\u00a0tenant\u00a0but\u00a0had\u00a0sold\u00a0it\u00a0through\u00a0a\u00a0sale\u00a0deed\u00a0dated\u00a0<br \/>\n5th\u00a0 of\u00a0January\u00a02004\u00a0in\u00a0favour\u00a0of\u00a0Tarun\u00a0s\/o\u00a0Gurbux\u00a0Singh\u00a0and\u00a0Smt.\u00a0<br \/>\nManjit \u00a0 Kaur \u00a0 wife \u00a0 of \u00a0 Gurbux \u00a0 Singh \u00a0 in \u00a0 vacant \u00a0 condition. \u00a0 After \u00a0 the\u00a0<br \/>\namendments\u00a0were\u00a0allowed,\u00a0the\u00a0parties\u00a0proved\u00a0their\u00a0respective\u00a0cases\u00a0<br \/>\nand\u00a0the\u00a0appellate\u00a0court\u00a0after\u00a0affirming\u00a0the\u00a0evidence\u00a0of\u00a0need\u00a0of\u00a0the\u00a0<br \/>\nson \u00a0 of \u00a0 the \u00a0 landlord, \u00a0 held \u00a0 that \u00a0 it \u00a0 was \u00a0 not \u00a0 bonafide \u00a0 as \u00a0 one \u00a0 newly\u00a0<br \/>\nconstructed\u00a0shop\u00a0was\u00a0sold\u00a0during\u00a0appeal.\u00a0\n<\/p>\n<p>       Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 has \u00a0 urged \u00a0 that \u00a0 the \u00a0 court\u00a0<br \/>\nbelow \u00a0 had \u00a0 erred \u00a0 in \u00a0 holding \u00a0 that \u00a0 the \u00a0 shops \u00a0 were \u00a0 sold \u00a0 in \u00a0 vacant\u00a0<br \/>\ncondition\u00a0and\u00a0has\u00a0also\u00a0not\u00a0considered\u00a0the\u00a0effect\u00a0of\u00a0the\u00a0affidavit\u00a0filed\u00a0<br \/>\nby\u00a0both\u00a0the\u00a0erstwhile\u00a0tenants.\n<\/p>\n<p>       The\u00a0certified\u00a0copy\u00a0of\u00a0the\u00a0sale\u00a0deed\u00a0dated\u00a05.1.2004\u00a0was\u00a0brought\u00a0<br \/>\non\u00a0record\u00a0and\u00a0the\u00a0appellate\u00a0court\u00a0after\u00a0relying\u00a0upon\u00a0a\u00a0recital\u00a0therein\u00a0<br \/>\nthat\u00a0the\u00a0possession\u00a0has\u00a0been\u00a0transferred\u00a0to\u00a0the\u00a0transferee,\u00a0held\u00a0that\u00a0it\u00a0<br \/>\nwas\u00a0transferred\u00a0in\u00a0vacant\u00a0condition.\u00a0The\u00a0copy\u00a0of\u00a0the\u00a0sale\u00a0deed\u00a0is\u00a0on\u00a0<br \/>\nrecord \u00a0 and \u00a0 it \u00a0 nowhere \u00a0 states \u00a0 that \u00a0 actual \u00a0 vacant \u00a0 possession \u00a0 was\u00a0<br \/>\ntransferred. \u00a0 The \u00a0 recital \u00a0 merely \u00a0 indicates \u00a0 that \u00a0 the \u00a0 constructive\u00a0<br \/>\npossession, \u00a0 which \u00a0 the \u00a0 transferee \u00a0 herself \u00a0 had \u00a0 over \u00a0 it, \u00a0 had \u00a0 been\u00a0<br \/>\ntransferred. \u00a0 Apart \u00a0 from \u00a0 that, \u00a0 the \u00a0 appellate \u00a0 court \u00a0 did \u00a0 not \u00a0 even\u00a0<br \/>\nconsider \u00a0 that \u00a0 Jumman \u00a0 \u00a0 himself \u00a0 had \u00a0 given \u00a0 an \u00a0 affidavit \u00a0 before \u00a0 and\u00a0<br \/>\nafter \u00a0 the \u00a0 amendment \u00a0 in \u00a0 the \u00a0 written \u00a0 statement \u00a0 that \u00a0 after\u00a0<br \/>\nreconstruction\u00a0he\u00a0was\u00a0inducted\u00a0as\u00a0a\u00a0tenant\u00a0@\u00a0Rs.375\/\u00ad\u00a0per\u00a0month\u00a0<br \/>\nand \u00a0 after \u00a0 the \u00a0 transfer \u00a0 he \u00a0 vacated \u00a0 the \u00a0 shop \u00a0 in \u00a0 favour \u00a0 of \u00a0 the \u00a0 new\u00a0<br \/>\nlandlords.\u00a0There\u00a0is\u00a0no\u00a0substantive\u00a0evidence\u00a0to\u00a0disprove\u00a0it\u00a0and\u00a0it\u00a0was\u00a0<br \/>\nthe\u00a0best\u00a0evidence\u00a0which\u00a0has\u00a0been\u00a0totally\u00a0ignored\u00a0by\u00a0the\u00a0court\u00a0below.\u00a0<br \/>\nEven\u00a0before\u00a0this\u00a0Court,\u00a0apart\u00a0from\u00a0a\u00a0bald\u00a0denial,\u00a0there\u00a0is\u00a0no\u00a0evidence\u00a0<br \/>\nto\u00a0disprove\u00a0the\u00a0affidavit\u00a0and\u00a0which\u00a0clinches\u00a0the\u00a0issue\u00a0in\u00a0favour\u00a0of\u00a0the\u00a0<br \/>\n<span class=\"hidden_text\">                                                                             3<\/span><\/p>\n<p>petitioner.\n<\/p>\n<p>      For\u00a0the\u00a0reasons \u00a0above,\u00a0this\u00a0petition\u00a0succeeds\u00a0and\u00a0is\u00a0allowed\u00a0<br \/>\nand \u00a0 the \u00a0 impugned \u00a0 order \u00a0 dated \u00a0 11th\u00a0 of \u00a0 January \u00a0 2008 \u00a0 is \u00a0 hereby\u00a0<br \/>\nquashed\u00a0and\u00a0that\u00a0of\u00a0the\u00a0Prescribed\u00a0Authority\u00a0is\u00a0restored.\n<\/p>\n<p>
