No.33212 of 2011\n                                        Suresh Prasad Yadav\n                                                  Versus\n                                          The State Of Bihar\n                                                -----------\n<\/pre>\n<p>2.      27.9.2011            This application has been filed for clarification of the<\/p>\n<p>                    order dated 27.7.2011 passed in Cr.Misc.No.18092 of 2011.<\/p>\n<p>                             It has been submitted that when the petitioner filed a<\/p>\n<p>                    petition before the Court below for acceptance of his bail<\/p>\n<p>                    bond, the Court opined that it would take the petitioner into<\/p>\n<p>                    custody while his antecedents are verified. This would<\/p>\n<p>                    frustrate the privilege of Anticipatory Bail granted to the<\/p>\n<p>                    petitioner.\n<\/p>\n<p>                             After hearing the petitioner, I am of the view that if at<\/p>\n<p>                    all the court below wants to verify the antecedents of the<\/p>\n<p>                    petitioner, he may do so, but after releasing the petitioner on<\/p>\n<p>                    provisional bail in the meanwhile.\n<\/p>\n<p>                             The order is clarified to the extent indicated above.<\/p>\n<p>                             The time for surrender is extended to another four<\/p>\n<p>                    weeks.\n<\/p>\n<p>                             Modification application stands disposed of.<\/p>\n<p>                                  Let the order be communicated to the court of the<\/p>\n<p>                    Chief Judicial Magistrate, Khagaria in connection with<\/p>\n<p>                    Parbatta P.S. case No.43 of 2011 through fax at the cost of<\/p>\n<p>                    the petitioner.\n<\/p>\n<\/p>\n<pre>     Narendra\/                           ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Suresh Prasad Yadav vs The State Of Bihar on 27 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
