HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 6495 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 14th day of November,2008\n\n                                  O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 309, 498A, 306<\/p>\n<p>read with section 34 IPC. According to              prosecution, petitioners<\/p>\n<p>are mother-in-law and sister-in-law of deceased Sajitha and they<\/p>\n<p>allegedly harassed deceased Sujatha and due to the harassment<\/p>\n<p>she poured kerosene on her body and set fire to herself and<\/p>\n<p>committed suicide.\n<\/p>\n<p>       3. According to          petitioners, they are innocent of the<\/p>\n<p>allegations made and there was no provocation for the deceased<\/p>\n<p>to commit suicide. Section 306 IPC is added consequent to an<\/p>\n<p>after thought. First petitioner is aged 75 years and she is<\/p>\n<p>suffering from several ailments. Second petitioner is having<\/p>\n<p>children who are studying in various classes. Therefore, they may<\/p>\n<p>be granted anticipatory bail, it is submitted.<\/p>\n<p>       4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that        a dying declaration was recorded by the<\/p>\n<p>Magistrate from the deceased while she was in the hospital. She<\/p>\n<p>made specific allegations            against petitioners and also her<\/p>\n<p>brother-in-law in the dying declaration. In a case of this nature, it<\/p>\n<p>may not be fit to grant anticipatory bail, it is submitted.<\/p>\n<p>BA 6495\/08                          -2-\n<\/p>\n<p>      5. On consideration of the relevant contentions and on<\/p>\n<p>going through the case diary, I am satisfied that this is not a fit<\/p>\n<p>cast to grant anticipatory bail.\n<\/p>\n<p>             Petitioners are directed to surrender before<\/p>\n<p>      the     Magistrate court concerned or before the<\/p>\n<p>      Investigating Officer without any delay and co-operate<\/p>\n<p>      with the investigation.
