This writ petition has been filed against<\/p>\n<p>                    the order bearing Memo No. 143\/E dated 7.2.2004<\/p>\n<p>                    passed    by     the   Additional   Collector,    Katihar,<\/p>\n<p>                    Annexure-3 whereunder promotion granted to the<\/p>\n<p>                    petitioner and others on the need based post of Head<\/p>\n<p>                    Clerk in the scale of Rs. 5000- 8000\/- under order<\/p>\n<p>                    bearing Memo No. 98\/E dated 28.1.2004, Annexure-<\/p>\n<p>                    2 has been cancelled with immediate effect even<\/p>\n<p>                    without hearing the petitioner.\n<\/p>\n<p>                               3. It is submitted on behalf of the petitioner<\/p>\n<p>                    that the aforesaid order dated 28.1.2004, Annexure-2<\/p>\n<p>                    was passed after the approval of the Establishment<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>Committee, but without making any reference to the<\/p>\n<p>Establishment Committee the impugned order dated<\/p>\n<p>7.2.2004, Annexure-3 has been issued by the<\/p>\n<p>Additional Collector, Katihar only on the instruction<\/p>\n<p>of the Collector, Katihar, perhaps for the reason that<\/p>\n<p>one of the promotees under order dated 28.1.2004,<\/p>\n<p>Annexure-2, Sri Janki Nandan Lal did not possess the<\/p>\n<p>qualification for such promotion.\n<\/p>\n<p>            4. Highlighting the aforesaid aspect of the<\/p>\n<p>matter, petitioner has represented before the District<\/p>\n<p>Magistrate,    Katihar   under    representation dated<\/p>\n<p>4.8.2004,     Annexure-4     series.   Till   date   such<\/p>\n<p>representation has not been disposed of as from the<\/p>\n<p>counter affidavit filed on behalf of Respondent nos. 2<\/p>\n<p>and 3 duly affirmed by the Executive Magistrate,<\/p>\n<p>Katihar, it does not appear that the aforesaid<\/p>\n<p>representation of the petitioner dated 4.8.2004,<\/p>\n<p>Annexure-4 series has yet been disposed of.<\/p>\n<p>            5. In the circumstances, the writ petition is<\/p>\n<p>disposed of directing the District Magistrate, Katihar<\/p>\n<p>to consider and dispose of the representation of the<\/p>\n<p>petitioner dated 4.8.2004, Annexure-4 series as early<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         as possible, in any case within two months from the<\/p>\n<p>         date of receipt\/ production of a copy of this order<\/p>\n<p>         before the District Magistrate, Katihar. In the event it<\/p>\n<p>         is found by the District Magistrate, Katihar that the<\/p>\n<p>         need based posts in the scale of Rs. 5000- 8000\/- is<\/p>\n<p>         available in the district of Katihar and petitioner is<\/p>\n<p>         eligible for such promotion, his case be considered<\/p>\n<p>         for such promotion within the aforesaid time.<\/p>\n<pre>Arjun\/                                     ( V.
