The rejection of petitioner&#8217;s claim is sought to be<\/p>\n<p>                  challenged in this application.\n<\/p>\n<p>                             A counter affidavit has been filed in which with<\/p>\n<p>                  reference to the Government letter dated 4.1.2010, it is stated<\/p>\n<p>                  that the promotions are not to be granted with retrospective<\/p>\n<p>                  effect. It is now stated that a supplementary counter has been<\/p>\n<p>                  filed, which is not on record. Let the Registry trace out the same<\/p>\n<p>                  and place it on record.\n<\/p>\n<p>                            It is stated    that    the supplementary affidavit that<\/p>\n<p>                  petitioner has now been granted          promotion but it effects<\/p>\n<p>                  prospectively from the date of order and the petitioner neither<\/p>\n<p>                  get any monetary benefit nor promotion from the due date when<\/p>\n<p>                  it ought to have been granted. Prima facie, in my view, the<\/p>\n<p>                  policy of the Government is clearly arbitrary and cannot be<\/p>\n<p>                  sustained if for any reason . The Government slept over the<\/p>\n<p>                  matter of grant of promotion, which is due to an employee,<\/p>\n<p>                  which is now a constitutional right, then for the fault of the<\/p>\n<p>                  Government and for the Government sleeping over the matter .<\/p>\n<p>                  the employee cannot be denied his due remuneration .The<\/p>\n<p>                  principle of law is well enunciated in the case of All India<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>         Groundnut Syndicate         Ltd. -v- Commissioner of Income<\/p>\n<p>         Tax, Bombay City since reported in A.I.R 1954 Bombay 232:<\/p>\n<blockquote><p>                                  &#8220;But the most surprising contention<br \/>\n                    is put forward by the Department that because<br \/>\n                    their own officer failed to discharge his<br \/>\n                    statutory duty, the assessee is deprived of his<br \/>\n                    right which the law has given to him under sub-<br \/>\n                    section 2 of S. 24. In other words, the<br \/>\n                    Department wants to benefit from and wants to<br \/>\n                    take advantage of its own default. It is an<br \/>\n                    elementary principle of law that no person- we<br \/>\n                    take it that the Income-tax Department is<br \/>\n                    included in that definition-can put forward his<br \/>\n                    own default in defence to a right asserted by the<br \/>\n                    other party. A person cannot say that the party<br \/>\n                    claiming the right is deprived of that right<br \/>\n                    because &#8221; I have committed a default and the<br \/>\n                    right is lost because of that default&#8221;<\/p><\/blockquote>\n<p>                    Learned counsel for the State seeks time to seek<\/p>\n<p>         specific instructions in the matter from the State in respect of<\/p>\n<p>         this aspect.\n<\/p>\n<p>                    Put up this matter on 2nd of May 2011, at the top of the<\/p>\n<p>         list as a zero item.\n<\/p>\n<\/p>\n<pre>Namita                              ( Navaniti Prasad Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
