Justice ANTONY DOMINIC\n\n Dated :30\/09\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n\n           --------------------------------------------------------\n\n                     W.P.(C) 28992 of 2008\n\n           --------------------------------------------------------\n\n                Dated: SEPTEMBER 30, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>     The claim of the petitioner is that the Acharya<\/p>\n<p>Teachers Training Course in Hindi conducted by the Kerala<\/p>\n<p>Hindi Prachara Sabha should be treated as equivalent to<\/p>\n<p>Language Teachers Training and B.Ed. for the purpose of<\/p>\n<p>appointment in the post of HSS Teacher (Senior) and<\/p>\n<p>(Junior) (Hindi).     The claim was taken up before the 1st<\/p>\n<p>respondent and that has been considered in pursuance to<\/p>\n<p>the judgment in WP(C) 21957\/07 and 12201\/07.                          The<\/p>\n<p>Government have thereafter turned down the request as per<\/p>\n<p>Ext.P8. It is challenging Ext.P8, this writ petition has been<\/p>\n<p>filed.\n<\/p>\n<p>     2.   As is evident from Ext.P8, the qualification<\/p>\n<p>prescribed in the Special Rules for the post of HSST are<\/p>\n<p>Masters Degree in the subject concerned with not less than<\/p>\n<p>50% marks           from any            Universities in Kerala         or<\/p>\n<p>WP(C) 28992\/08<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>qualification equivalent thereto with B.Ed. and SET in the<\/p>\n<p>subject concerned.        Admittedly what the petitioner<\/p>\n<p>possesses is only Acharya Teachers Training Certificate in<\/p>\n<p>Hindi as referred to above.          It is praying that the<\/p>\n<p>qualification obtained by the petitioner          should be<\/p>\n<p>recognised as equivalent to B.Ed. Degree, this writ petition<\/p>\n<p>has been filed.\n<\/p>\n<p>     3. It is settled law that equation of qualification is<\/p>\n<p>essentially for the appointing authority to do so and, it<\/p>\n<p>being in the domain of a policy decision, the scope for<\/p>\n<p>interference by a Court of law is very limited. In this case<\/p>\n<p>dealing with the claim of the petitioner, the Government,<\/p>\n<p>which is aware of the nature of the duties attached to the<\/p>\n<p>post, have stated in Ext.P8 that the qualification possessed<\/p>\n<p>by the petitioner is not sufficient for appointment as HSST.<\/p>\n<p>Once    the  appointing    authority    has  held  that  the<\/p>\n<p>qualification possessed by the petitioner is insufficient to<\/p>\n<p>hold the post of HSST, this Court will not be justified in<\/p>\n<p>WP(C) 28992\/08<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>holding the same to be perverse in the absence of any<\/p>\n<p>material to arrive at such a conclusion.<\/p>\n<p>     4. The fact that the qualification possessed by the<\/p>\n<p>petitioner    has been recognised for the purpose of<\/p>\n<p>appointment of UPSA and HSA, is hardly of any relevance<\/p>\n<p>when it comes to equation of that qualification for the<\/p>\n<p>purpose of determining the eligibility for HSST post.<\/p>\n<p>Petitioner cannot contend that the duties which are<\/p>\n<p>discharged by UPSA and HSA are same as that of HSST<\/p>\n<p>appointees.
