Mukhopadhaya, J.  <\/p>\n<p> 1. According to petitioner, his father late Parash Goswami was a Kshetriya Karya Karta (Field Worker) in the office of Malaria Scheme, Daltonganj, Palamau and died in harness on 3.8.1999. The petitioner applied for compassionate appointment where in after his case was placed before the District Compassionate Appointment Committee. The Committee vide its proceeding dated 21.10.2000 and 10.11.2000 considered the case of petitioner and others and recommended the name of petitioner for<\/p>\n<p>appointment against a class-IV post to the office of the Civil Surgeon-cum-Chief Medical Officer, Palamau\/District Medical Officer, Palamau vide Memo No. 78 dated 23.1.2001. It is alleged that the Civil Surgeon-cum-Chief Medical Officer, Palamau or the District Medical Officer, Palamau has not yet issued the formal order of appointment though about one year has passed.\n<\/p>\n<p> 2. Having regard to the facts and circumstances, the case is remitted to the Civil Surgeon-cum-Chief Medical Officer, Palamau, who will enquire as to whether the case of petitioner was considered by the District Compassionate Appointment Committee and was recommended vide Memo dated 23.1.2001 or not. If it is found that such recommendation was made, the Civil Surgeon-cum-Chief Medical Officer, Palamau will issue formal order of appointment against a class-IV post in favour of petitioner within one month from the date of receipt\/production of a copy of this order.\n<\/p>\n<p> 3. If no class-IV post is available under him, he will enquire from the office of District Malaria Officer, Daltonganj, Palamau as to whether any class-IV post is vacant or not and ensure appointment against any such post.\n<\/p>\n<p> 4. In case of any adverse decision is taken, the Civil Surgeon-cum-Chief Medical Officer, Daltonganj, Palamau will communicate the ground to the petitioner within the aforesaid period of one month.\n<\/p>\n<p> 5.
