        Petitioners are the appellants in<\/p>\n
A.S.No.217\/03 on the file of the District<\/p>\n
Court, Palakkad.             The appeal was rejected<\/p>\n
by  the  court         below        on      default         of  the<\/p>\n
petitioners\/appellants to pay the balance<\/p>\n
court fee within time.                    Petitioners moved<\/p>\n
an  application             to       review           the     order<\/p>\n
rejecting the appeal, seeking condonation<\/p>\n
of delay in remitting the balance court<\/p>\n
fee.  The learned District Judge dismissed<\/p>\n
that  review        petition            by      Ext.P2       order.<\/p>\n
Propriety and correctness of Ext.P2 order<\/p>\n
is challenged in the writ petition invoking<\/p>\n
the supervisory jurisdiction vested with<\/p>\n
this  court       under          Article           227      of  the<\/p>\n
Constitution of India.\n<\/p>\n
        2. I heard the counsel on both<\/p>\n
sides.\n<\/p>\n

        3. The dismissal of the review<\/p>\n
petition by going into the merits of the<\/p>\n
appeal as done by the court was not proper<\/p>\n
and  correct  is  the   submission  of  the<\/p>\n
learned counsel for the petitioners.  It is<\/p>\n
further canvassed that the petitioners must<\/p>\n
be given an opportunity to have a disposal<\/p>\n
of the appeal on merits, setting aside the<\/p>\n
order of the court below and restoring the<\/p>\n
appeal  accepting  the  balance  court  fee<\/p>\n
payable on the appeal tendered by them.<\/p>\n
        4. Perusing the impugned order, it<\/p>\n
is seen, the appeal was preferred against<\/p>\n
the  dismissal  of  a  suit  filed  by  the<\/p>\n
petitioners as plaintiffs to set aside a<\/p>\n
final decree passed in an earlier suit.<\/p>\n
The appeal was preferred as early as in<\/p>\n
2003, paying 1\/3rd of the court fee payable<\/p>\n
on the memorandum of appeal. Even after two<\/p>\n

\nyears, the balance court fee payable was<\/p>\n
not tendered by the appellants.  The order<\/p>\n
of the court below would show, noticing<\/p>\n
non-payment of the balance court fee on<\/p>\n
3.8.2005 the appeal was posted for payment<\/p>\n
of such fee on 14.10.2005.  Since the court<\/p>\n
fee was not paid on that date, the appeal<\/p>\n
was  rejected.  The  petitioners\/appellants<\/p>\n
then moved the petition to review the above<\/p>\n
order rejecting the appeal for non-payment<\/p>\n
of the balance court fee.    The appellate<\/p>\n
court has found that the cause shown for<\/p>\n
the non-payment of the balance court fee<\/p>\n
was a lame excuse. The appellants have<\/p>\n
contended that the second appellant was<\/p>\n
indisposed and first appellant was away at<\/p>\n
Chennai during the period when the appeal<\/p>\n
was pending before the court.  It was also<\/p>\n
noticed that the appeal had been preferred<\/p>\n

\nagainst the dismissal of a suit wherein the<\/p>\n
appellants as plaintiffs have sought for<\/p>\n
setting  aside  a   final  decree  in   the<\/p>\n
previous suit stating that decree had been<\/p>\n
passed by collusion and fraud and therefore<\/p>\n
not binding on them.   The appellate court<\/p>\n
noticed that the suit was dismissed on<\/p>\n
merits.  I find that the learned District<\/p>\n
Judge has applied his mind to the facts and<\/p>\n
circumstances  presented  while  exercising<\/p>\n
his discretion, whether the appeal which<\/p>\n
had been dismissed for default for non-<\/p>\n
payment of the court fee has to be restored<\/p>\n
to file or not. At any rate, there is no<\/p>\n
jurisdictional error or infirmity in the<\/p>\n
order passed by the learned District Judge.<\/p>\n
In exercise of the visitorial jurisdiction<\/p>\n
it is not proper and appropriate for this<\/p>\n
court in the given facts fo the case to<\/p>\n

\ninterfere with the order of the inferior<\/p>\n
court.\n<\/p>\n
        Writ petition is dismissed.<\/p>\n
