RESPONDENTS.\n                                    -----------\n<\/pre>\n<p>02\/   24.06.2011              Petitioner is working as Peon in the Non-<\/p>\n<blockquote><p>                      government Devendra Madhya Vidyalaya, Yarpur,<\/p>\n<p>                      Patna since 4.12.1992. School in question is a Non-<\/p>\n<p>                      government recognized school. Petitioner&#8217;s prayer is for<\/p>\n<p>                      making payment of salary\/cost of living allowance and<\/p>\n<p>                      other allowances to the petitioner since 4.12.1992, in<\/p>\n<p>                      the light of the policy decision of the Govt. of Bihar to<\/p>\n<p>                      make payment of cost of living allowance to teachers<\/p>\n<p>                      working in such non-government recognized Primary<\/p>\n<p>                      and Middle School, where free education is being<\/p>\n<p>                      imparted to the students up to Class VI. Similar matter<\/p>\n<p>                      came for considering before this Court in C.W.J.C. Nos.<\/p>\n<p>                      5278, 5361, 5599 of 2007 and analogous cases. The<\/p>\n<p>                      writ applications were disposed of giving direction to<\/p>\n<p>                      the State Govt. for constituting Committee of Three<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       Officers of the rank of Deputy Secretary\/Deputy<\/p>\n<p>       Director, Human Resources Development Department<\/p>\n<p>       in order to enquire whether right persons are claiming<\/p>\n<p>       such benefits. The Committee was directed to conduct<\/p>\n<p>       an enquiry giving proper opportunity to the petitioners<\/p>\n<p>       by issuing public notice and the Committee was<\/p>\n<p>       directed to examine and scrutinize the case in the light<\/p>\n<p>       of the relevant provisions, rules, regulations, circulars,<\/p>\n<p>       examine the file of each case, in case it is found that the<\/p>\n<p>       petitioners are entitled for the same, it should be granted<\/p>\n<p>       to them.\n<\/p><\/blockquote>\n<blockquote><p>                  Counsel for the petitioner submits that the<\/p>\n<p>       Committee is still existing and functioning.<\/p>\n<\/blockquote>\n<blockquote><p>                  Considering this fact, this application is<\/p>\n<p>       disposed of, giving liberty to the petitioner to represent<\/p>\n<p>       his case before the same Committee, which will<\/p>\n<p>       examine the claim of the petitioner and pass necessary<\/p>\n<p>       orders as per the direction in C.W.J.C.
