The<br \/>\nservices of the respondent came to and after 1988. Being aggrieved by<br \/>\nthe same,  the respondent raised a dispute which was ultimately<br \/>\nreferred to the Labour Court for adjudication being Reference [LCJ]<br \/>\nNo. 1656 of 1990.  Before the Labour Court, both the parties adduced<br \/>\nevidence and after appreciating the material produced before it, the<br \/>\nLabour Court allowed the reference with the aforesaid directions.<br \/>\nHence, this petition.\n<\/p>\n<p>3.\t\tThe<br \/>\nlearned counsel for the respondent has raised a preliminary<br \/>\ncontention that in view of the order dated 16.02.2000 passed by this<br \/>\nCourt and since there is non compliance of provisions of 17-B of the<br \/>\nIndustrial Disputes Act, the main matter cannot be heard. In support<br \/>\nof his say, he has placed reliance on the decision of the Apex Court<br \/>\nin the case of <a href=\"\/doc\/1786785\/\">Workmen Reptd.  By Hindustan V.O. Corporation<br \/>\nLimited v. Hindustan Veg. Oils Corporation Limited<\/a> reported in 2000<br \/>\nGLHEL SC 33777, wherein the Court has observed that an<br \/>\napplication u\/s. 17-B should be disposed of before the principal<br \/>\npetition and it should be disposed of most expeditiously.\n<\/p>\n<p>4.\t\tSo<br \/>\nfar the preliminary contention raised by the respondent is concerned,<br \/>\nI am of the view that the same does not deserves consideration<br \/>\ninasmuch as the respondent had not preferred any application<br \/>\nfor vacating  the interim relief granted by this Court vide order<br \/>\ndated 16.02.2000 for a period of almost ten years. It appears that<br \/>\nthe workman was not vigilant about his rights. Looking to the facts<br \/>\nof the case, I am of the view that the employee who is not vigilant<br \/>\nabout his rights and that he had not preferred any application for<br \/>\ncompliance of provisions of Section 17B of the ID Act for almost ten<br \/>\nyears, the same cannot be revived at a belated stage.  The said<br \/>\ncontention is, therefore, rejected.\n<\/p>\n<p>5.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.   It appears that the before the Court below the<br \/>\npetitioner was not able to establish that the respondent had not<br \/>\nworked for 240 days in a year. However, before terminating the<br \/>\nservices of the respondent, the petitioner had not followed the due<br \/>\nprocess of law. Therefore, I am of the view that the Labour Court has<br \/>\nrightly passed the award qua reinstatement with continuity of<br \/>\nservice.\n<\/p>\n<p>6.\t\tSo<br \/>\nfar as the direction with regard to grant of back wages is concerned,<br \/>\nit is required to be noted that the Labour Court has given the<br \/>\nbenefit of doubt to the respondent while awarding back wages. No<br \/>\ncogent reasons have been given by the Labour Court while awarding the<br \/>\nsame. Moreover,\tin view of the principle laid down by the Apex Court<br \/>\nin the case of <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh<\/a> reported in<br \/>\n(2003) II L.L.J., pg.176, a workman has no automatic entitlement<br \/>\nto back wages, since it is discretionary and has to be dealt with in<br \/>\naccordance with the facts and circumstances of each case.\n<\/p>\n<p>6.1.\t\tIn<br \/>\nthe case of <a href=\"\/doc\/1628125\/\">General Manager, Haryana Roadways v. Rudhan Singh<\/a><br \/>\nreported in J.T. 2005(6) S.C., pg.137, it has been held that an<br \/>\norder for payment of back wages should not be passed in a mechanical<br \/>\nmanner, but, a host of factors are to be taken into consideration<br \/>\nbefore passing any such order. Hence, the impugned award qua granting<br \/>\nback wages is required to be quashed and set aside.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, this petition is partly allowed. The impugned<br \/>\naward of the Labour Court qua granting  reinstatement with continuity<br \/>\nof service is confirmed; and, the direction qua awarding back wages<br \/>\nis quashed and set aside.
