Shah, learned Assistant Government<br \/>\n\tPleader, has relied upon the contents of the affidavit-in-reply, and<br \/>\n\thas submitted that the case of the petitioners is squarely covered<br \/>\n\tby the decision of this Court (Coram : K.S. Jhaveri, J)<br \/>\n\trendered on 30th July 2004 in<br \/>\n\tSpecial Civil Application No.7122 of 1991 and other allied<br \/>\n\tpetitions. It would be beneficial to reproduce the said<br \/>\n\tdecision as under :\n<\/p>\n<p>     1.\tIn  all  the  above  petitions the prayers are to<br \/>\n \t      direct the respondents to regularise  their  services  on<br \/>\n      \ttheir  respective  posts  and  to  pay  the consequential<br \/>\n      \tbenefits.\n<\/p>\n<p>\t      2.\tIn these petitions the petitioners  alleged  that<br \/>\n      \tthey  have  been  working  since last many years, but are<br \/>\n      \tdeprived of  the  benefits  and  status  of  the  regular<br \/>\n      \temployees of  the  respondent  Department.    The further<br \/>\n      \tgrievance is that the petitioners are not granted  salary<br \/>\n      \ton the  basis  of  &#8220;equal  pay  for  equal  work&#8221;.    The<br \/>\n      \tpetitioners have also prayed to quash and set  aside  the<br \/>\n      \tGovernment Resolution dated 22.12.1999 and to declare the<br \/>\n      \tGovernment  Resolution  dated 17.10.1988 is applicable to<br \/>\n      \tthe petitioners.\n<\/p>\n<p>      \t3.\tThe learned counsel for the petitioners submitted<br \/>\n\t      that the Resolution dated 17.10-1988 was made  applicable<br \/>\n      \tto  the  daily wagers who are working for maintenance and<br \/>\n      \trepairs of construction in  various  departments  of  the<br \/>\n      \tGovernment   including   the   Forests   and  Environment<br \/>\n      \tDepartment and therefore  the  same  benefits  should  be<br \/>\n      \textended to the petitioners also.\n<\/p>\n<p>      \t4.\tMr.  Kamal   B.     Trivedi,  learned  Additional<br \/>\n      \tAdvocate General pointed out that the issue  involved  in<br \/>\n      \tthese  petitions has been decided by a Full Bench of this<br \/>\n      \tCourt in the case of Gujarat Forest Producers,  Gatherers<br \/>\n      \tand Forests Workers Union Vs.  State of Gujarat, reported<br \/>\n      \tin 2004 (2) GlH 302.  In the said decision this Court has<br \/>\n      \theld  that  the Government Resolution dated 17.10.1988 is<br \/>\n      \tapplicable  to  the  daily  wagers  of  the  Forest   and<br \/>\n      \tEnvironment Department engaged in the work of maintenance<br \/>\n      \tand  repairs  of constructions in that Department and not<br \/>\n      \tto the daily wagers engaged in other  types  of  work  in<br \/>\n      \tthat department.   The question no.3 referred to the Full<br \/>\n      \tBench in this regard along with its answer is  reproduced<br \/>\n      \tas under:\n<\/p>\n<p>       \t\t&#8220;Que-3   Whether  the  petitioners  or  similarly<br \/>\n              \tsituated employees of the Forest  Department  are<br \/>\n              \tentitled  to the benefit of Government Resolution<br \/>\n              \tdated 17-10-1988?&#8221;\n<\/p>\n<p>\t\t       Ans-3   The   Government  Resolution  dated  17th<br \/>\n            \t October 1988 is applicable to the daily wagers of<br \/>\n              \tthe Forest &amp; Environment  Department  engaged  in<br \/>\n              \tthe   work   of   maintenance   and   repairs  of<br \/>\n              \tconstructions in that Department, and not to  the<br \/>\n              \tdaily  wagers  engaged  in other types of work in<br \/>\n              \tthat Department.&#8221;\n<\/p>\n<p>      \tAdmittedly the  petitioners  are  not  working  as  daily<br \/>\n      \twagers  of Forest &amp; Environment Department engaged in the<br \/>\n      \twork of maintenance and repairs of constructions.   Since<br \/>\n      \tthe   Government   Resolution  dated  17.10.1988  is  not<br \/>\n      \tapplicable to the case of the petitioners.  none  of  the<br \/>\n      \tgrievances  raised  in these petitions can be considered.<br \/>\n      \tThese petitions are, therefore, devoid of any  merit  and<br \/>\n      \trequire to be rejected.\n<\/p>\n<p>\t      5.\tIn the  premises  aforesaid,  the  petitions  are<br \/>\n      \trejected.   Rule is discharged with no order as to costs.<br \/>\n      \tSince the main matter is disposed of CA  No.9008\/99  does<br \/>\n      \tnot survive and is accordingly disposed of.\n<\/p>\n<p>\tIn<br \/>\n\tview of aforesaid, when the issue involved in the present petition<br \/>\n\thas already been decided by this Court by way of above cited<br \/>\n\tdecision, in light of the same the present petition is required to<br \/>\n\tbe disposed of and the same stands disposed of accordingly. The<br \/>\n\tparties to abide by the above cited decision. Rule is discharged<br \/>\n\twith no order as to costs.
