Justice C.K.ABDUL REHIM\n\n Dated :24\/11\/2010\n\n O R D E R\n                    C.K.ABDUL REHIM, J\n               ---------------------------------------\n                W.P(C) No.34269 of 2010-G\n               ----------------------------------------\n        Dated this the 24th day of November, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioner is an auction purchaser of certain<\/p>\n<p>immovable properties sold by the 3rd respondent, pursuant<\/p>\n<p>to proceedings initiated under the Kerala Revenue Recovery<\/p>\n<p>Act. The sale in question was conducted on 9.4.2007 and<\/p>\n<p>the property was bid in auction by the petitioner for a sum<\/p>\n<p>of Rs.15,20,000\/-. The petitioner had remitted 15% of the<\/p>\n<p>bid amount on the date of sale itself and the balance amount<\/p>\n<p>was paid on 7.5.2007. Grievance of the petitioner is that<\/p>\n<p>much after remittance of the entire amount, the 1st<\/p>\n<p>respondent had cancelled the sale by virtue of Ext.P1 order,<\/p>\n<p>on 16.8.2010.\n<\/p>\n<p>     2.   It is evident that cancellation of the sale was<\/p>\n<p>ordered on the basis of a report submitted by the Tahsildar,<\/p>\n<p>pointing out certain irregularities and also pointing out that<\/p>\n<p>the auction bidder is the nearest kith and kin of the<\/p>\n<p>defaulter.  Further reason stated is that the amount at<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.34269 of 2010-G      2<\/span><\/p>\n<p>which the auction was conducted is not justifiable when<\/p>\n<p>compared with value of the property. However, aggrieved<\/p>\n<p>by Ext.P1 order the petitioner had filed Ext.P2 revision<\/p>\n<p>petition, as contemplated under Section 83(1) of the Kerala<\/p>\n<p>Revenue     Recovery     Act, before   the    4th  respondent.<\/p>\n<p>According to the petitioner the revision petition is pending<\/p>\n<p>consideration and disposal before the 4th respondent. It is<\/p>\n<p>alleged that without considering pendency of the revision,<\/p>\n<p>the 3rd respondent had now initiated further steps for sale<\/p>\n<p>and the property in question is proclaimed for re-auction as<\/p>\n<p>evidenced from Ext.P3 notice.       Hence the petitioner is<\/p>\n<p>seeking direction to the 4th respondent to have an early<\/p>\n<p>disposal of the revision petition and till then to keep further<\/p>\n<p>steps for re-sale in abeyance.\n<\/p>\n<p>     3.    Heard, learned Government Pleader appearing on<\/p>\n<p>behalf of the respondents. On the basis of instructions it is<\/p>\n<p>submitted that the sale proclaimed as per Ext.P3 was not<\/p>\n<p>taken place, and the 3rd respondent had adjourned the sale<\/p>\n<p>to 18.12.2010.\n<\/p>\n<p>     4.    Considering the fact that the petitioner had<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.34269 of 2010-G      3<\/span><\/p>\n<p>remitted the entire sale amount as early as in the year 2007<\/p>\n<p>and also considering the fact that the sale was set aside<\/p>\n<p>only in the year 2010, I am of the view that it is only just<\/p>\n<p>and proper to restrain further actions of the 3rd respondent<\/p>\n<p>till the statutory revision is considered and disposed of by<\/p>\n<p>the 4th respondent.\n<\/p>\n<p>      5.   Therefore, the writ petition is disposed of<\/p>\n<p>directing the 4th respondent to consider and pass orders on<\/p>\n<p>Ext.P2 revision petition, after affording an opportunity of<\/p>\n<p>personal hearing to the petitioner, as early as possible, as<\/p>\n<p>any rate within a period of two months from the date of<\/p>\n<p>receipt of a copy of this judgment.\n<\/p>\n<p>      6.   Till such time orders are passed by the 4th<\/p>\n<p>respondent as directed, all further proceedings with respect<\/p>\n<p>to sale of the property in question shall be kept in abeyance.<\/p>\n<p>      7.
