1.\tRULE.\n<\/p>\n
Ms CM Shah, learned APP appears and waives service of notice of rule
\non behalf of the respondent State.\n<\/p>\n
2.\tThe
\npetitioner has preferred this application under Section 439 of the
\nCode of Criminal Procedure, 1973 seeking regular bail in connection
\nwith Panigate Police Station, Baroda bearing CR No. I 123 of 2010
\nfor the offence punishable under Sections 465, 467, 468, 471, 472,
\n473 read with Section 114 of the IPC and Sections 18A(1)(c) and 18(c)
\nof the Drugs and Cosmetics Act.\n<\/p>\n
3.\tConsidering
\nthe facts and circumstances of the case, the matter is taken up for
\nfinal hearing today.\n<\/p>\n
4.\tMr
\nYogesh S Lakhani, learned Senior Counsel with Mr Pravin S Gondaliya,
\nlearned advocate for the petitioner submitted that in this case, the
\ninvestigation is over and charge-sheet is filed. Considering the
\nentire papers of charge-sheet, it would reveal that the petitioner is
\narraigned as an accused in this case solely upon the oral statement
\nof co-accused Nilesh during seizure Panchnama. That during search of
\nthe petitioner, nothing incriminating came to be found. That except
\nthe statement of co-accused before the police, during the course of
\nsearch Panchnama, there is no evidence whatsoever collected by the
\npolice and placed along with the charge-sheet to connect the
\npetitioner with the crime. It is further submitted that about 35
\nco-accused persons came to be released on bail, either by this Court
\nor by the Trial Court and against some of them, more serious
\nallegations were levelled by the prosecution than the petitioner.
\nThey were actually found in possession of certain forged documents.
\nIt is further submitted that the petitioner is not named in the FIR.
\nTherefore, it is submitted that the application may be allowed.\n<\/p>\n
5.\tPer
\ncontra, Ms CM Shah, learned APP representing the State vehemently
\nopposed this application and submitted that the petitioner is main
\naccused and the other co-accused persons who came to be released on
\nbail played lesser role in the incident. It is further submitted that
\nconsidering the seizure Panchnama, co-accused Nilesh Kantibhai Patel
\nreferred the name of the petitioner before the Panchas. Therefore, it
\nis submitted that the application may be dismissed.\n<\/p>\n
6.\tHaving
\nconsidered the submissions advanced on behalf of both the sides and
\nmore particularly the fact that the investigation is over and
\ncharge-sheet is filed so also the fact that out of 43 accused persons
\narraigned in the charge-sheet, 35 co-accused persons have been
\nreleased on bail either by this Court or by the Trial Court and the
\nfact that the prosecution attempted to establish the complicity of
\nthe petitioner on the basis of the statement of co-accused   Nilesh
\nKantibhai who is also released on bail as well as considering the
\nfact that from the search conducted, nothing incriminating could be
\nfound out from the petitioner and the fact that the offences alleged
\nagainst the petitioner are triable by the Court of learned JMFC,
\nwithout further entering deep into the evaluation of the evidence
\ncollected by the prosecution, this Court is of the opinion that the
\ndiscretionary powers vested in this Court under Section 439 of the
\nCode of Criminal Procedure, 1973 deserves to be exercised in favour
\nof the petitioner.\n<\/p>\n
7.\tConsidering
\nthe submissions made on behalf of the parties and having regard to
\nthe facts and circumstances of the case, the application is allowed
\nand the petitioner is ordered to be released on bail in connection
\nwith Crime Register No.I 123 of 2010 registered at Panigate Police
\nStation, Baroda for the offence alleged against him in this
\napplication on his executing bond of Rs.5,000\/- (Rupees five thousand
\nonly) with one solvent surety of the like amount to the satisfaction
\nof the lower Court and subject to the conditions that he shall,<\/p>\n
(a)\tnot take undue
\nadvantage of his liberty or abuse his liberty.\n<\/p>\n
(b)\tnot try to tamper or
\npressurize the prosecution witnesses or complainant in any manner.\n<\/p>\n
(c)\tmaintain law and
\norder and should co-operate the investigating officers;\n<\/p>\n
(d)\tnot act in any
\nmanner injurious to the interest of the prosecution.\n<\/p>\n
(e)\tnot leave the
\nterritory of India without the prior permission of the concerned
\nTrial Court;\n<\/p>\n
(f)\tfurnish the address
\nof his residence to the Investigating Officer and also to the Court
\nat the time of execution of the bond and shall not change the
\nresidence without prior permission of the Court.\n<\/p>\n
(g)\tsurrender his
\npassport, if any, to the lower Court, within a week.\n<\/p>\n
8.\tIf
\nbreach of any of the above conditions is committed, the concerned
\nTrial Court will be free to issue warrant or take appropriate action
\nin the matter.\n<\/p>\n
9.\tBail
\nbefore the lower Court having jurisdiction to try the case. It would
\nbe open to the Trial Court concerned to give time to furnish the
\nsolvency certificate if prayed for.\n<\/p>\n
10.\tRule
\nis made absolute to the aforesaid extent. Direct service is
\npermitted.\n<\/p>\n
