K. Soni appearing for petitioners and learned<br \/>\nAGP Mr.Maulik Nanavati appearing for respondents state authorities.\n<\/p>\n<p>2.\tToday,<br \/>\nlearned advocate Mr. Soni made a mention to this Court in first<br \/>\nsession to permit him to circulate one page petition along with<br \/>\nSpecial Civil Application No.9781 of 2011 in second session.  This<br \/>\nCourt has granted permission to circulate this group of petitions in<br \/>\nsecond session.  Accordingly matters have been called for from<br \/>\nregistry of this Court and registry has prepared the Board and sent<br \/>\npapers of this group of petitions before this Court in second<br \/>\nsession.  Accordingly, this group of petitions is taken up for<br \/>\nhearing.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Soni submitted that before this Court in identical facts<br \/>\nand circumstances which are having with petitioner, this Court has<br \/>\npassed an order on 18\/7\/2011 in Special Civil Application No.8177 of<br \/>\n2011 with Civil Application No.7670 of 2011.  Said order is quoted as<br \/>\nunder:\n<\/p>\n<p>&#8220;1.\tHeard<br \/>\nlearned advocate Mr. KB Pujara on behalf of petitioner, learned AGP<br \/>\nMr. Maulik Nanavati appearing for respondent.\n<\/p>\n<p>2.\tI<br \/>\nhave considered submissions made by both learned advocates.  The<br \/>\napplication has been made by each petitioner giving choice of place<br \/>\nwith a request to transfer respondent as per policy of State<br \/>\nGovernment. Therefore, it is directed to respondent to first consider<br \/>\nan application made by petitioner to respondent with a request to<br \/>\ntransfer who are senior and experienced Trained Graduate primary<br \/>\nteachers, to be posted on vacancies in Upper Primary Section before<br \/>\ntaking any steps in furtherance of advertisement dated 15\/7\/2011<br \/>\nissued by respondent as per Annexure II of civil application no.<br \/>\n7670\/2011.\n<\/p>\n<p>3.\tIn<br \/>\nview of above observation and direction, SCA no. 8177\/2011 and CA no.<br \/>\n7670\/2011 both are disposed of by this Court without expressing any<br \/>\nopinion on merits.  However, in case of such individual applicant\/<br \/>\npetitioner have some difficulty arise, it is open for such<br \/>\napplicant\/petitioner to approach this Court.  Direct service today is<br \/>\npermitted.&#8221;\n<\/p>\n<p>4.\tHere,<br \/>\npresent  petitioners are working as a teachers in upper primary<br \/>\nschool and all have made  their applications before respondents with<br \/>\na request to consider their case of transfer at a particular choice<br \/>\nof place before finalizing selection and appointments in pursuance to<br \/>\nadvertisement dated 15\/7\/2011.\n<\/p>\n<p>5.\tI<br \/>\nhave considered submissions made by learned advocate Mr. Soni and<br \/>\nlearned AGP Mr. Maulik Nanavati appearing for respondents  state<br \/>\nauthority and an application which has been made by each petitioner<br \/>\nto respondents  giving choice of place with a request to transfer as<br \/>\nper policy of State Government.\n<\/p>\n<p>6.\tTherefore,<br \/>\nit is directed to respondents state authorities to first consider<br \/>\nsuch application which has been made by each petitioner to<br \/>\nrespondents with a request to transfer who are senior and experienced<br \/>\ntrained graduate primary teachers to be posted on vacancies in upper<br \/>\nprimary section before taking any steps or finalizing it in<br \/>\nfurtherance of advertisement dated 15\/7\/2011.\n<\/p>\n<p>7.\tIn<br \/>\nview of above observation and direction, present petitions are<br \/>\ndisposed of by this Court without expressing any opinion on merits.<br \/>\nHowever, in case if any petitioner has some difficulty or any<br \/>\ndifficulty arise to petitioners, it is open for petitioners to<br \/>\napproach this Court.
