DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent application is filed by the applicant for grant of regular<br \/>\nbail under Section 439 of the Criminal Procedure Code after<br \/>\ncharge-sheet is filed.\n<\/p>\n<p>2.\tThe<br \/>\napplicant-accused is charged for having committed offence under<br \/>\nSections 364(A),394,397,171,120(B) and 34 of the Indian Penal Code<br \/>\nand Section 135 of the Bombay Police Act for which FIR being<br \/>\nC.R.No-I-97 of 2010 has been registered with Bhavnagar &#8216;B&#8217; Division<br \/>\nPolice Station.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the applicant referred to the FIR and submitted that the<br \/>\ncharge-sheet has been filed considering the role attributed with<br \/>\nregard to the offence and that only Rs.50,000\/- was given out of the<br \/>\namounted looted to take care of other persons.\n<\/p>\n<p>4.\tHe<br \/>\nsubmitted that other two accused persons have been released and<br \/>\ntherefore the present application requires to be allowed.\n<\/p>\n<p>5.\tLearned<br \/>\nAdditional Public Prosecutor resisted the application and submitted<br \/>\nthat he has also been attributed with specific role.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned counsel appearing for the applicant-accused and learned<br \/>\nA.P.P. and having considered the nature of offences, role attributed<br \/>\nand also the fact that the charge-sheet has now been filed as also<br \/>\nconsidering the fact that other co-accused has been released, the<br \/>\npresent application deserves to be allowed.\n<\/p>\n<p>7.\tAccordingly,<br \/>\npresent application stands allowed. The applicant<br \/>\nis ordered to be released on regular bail, in connection with<br \/>\nC.R.No-I-97 of 2010 has been registered with Bhavnagar &#8216;B&#8217; Division<br \/>\nPolice Station, on his executing a bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand Only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
