Justice K.M.JOSEPH\n\n Dated :27\/06\/2008\n\n O R D E R\n                   H.L.DATTU, C.J. &amp; K.M.JOSEPH, J.\n                         -------------------------------------------\n                              W.P.(C) No.18470 of 2008\n                         ------------------------------------------\n                     Dated, this the 27th day of June, 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>               One and the only direction that is sought for by the petitioner<\/p>\n<p>in this public interest litigation is as under:<\/p>\n<blockquote><p>                        &#8220;(a) to issue a writ of mandamus or other<\/p>\n<p>         appropriate writ, direction or order commanding the<\/p>\n<p>         Magistrate Court, Varkala and other courts within the<\/p>\n<p>         jurisdiction of concerned Police stations wherein the<\/p>\n<p>         vehicles are kept and in ruined condition in the State of<\/p>\n<p>         Kerala to dispose of them with immediate effect or the<\/p>\n<p>         concerned police officers to report the fact to the concerned<\/p>\n<p>         courts to initiate appropriate action.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>               2. When the matter was posted before us, we had directed<\/p>\n<p>Sri.M.P.Sreekrishnan, learned Government Pleader, to take appropriate<\/p>\n<p>instructions in the matter.<\/p><\/blockquote>\n<p>               3. Learned Government Pleader today produced before us<\/p>\n<p>the fax message received by him from the Superintendent of Police,<\/p>\n<p>Thiruvananthapuram Rural dated 27.6.2008. The fax message reads as<\/p>\n<p>under:\n<\/p>\n<p>W.P.(C) No.18470 of 2008<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>               &#8220;Sub: Writ Petition filed by Dr.B.R.Ambedkar<br \/>\n                      Samskarika Sangham &#8211; Reg.\n<\/p>\n<p>                Ref: Instructions dtd.19.06.08 on W.P.(C)<br \/>\n                     18470\/2008\/R<\/p>\n<p>               Kind attention is invited to the above.<\/p>\n<p>               In pursuance of the direction in the above Writ<\/p>\n<p>        Petition before the Hon&#8217;ble High Court, instructions had<\/p>\n<p>        been given to all the Station House Officers,       Circle<\/p>\n<p>        Inspectors and Deputy Superintendents of Police in<\/p>\n<p>        Thiruvananthapuram Rural District for moving the Courts<\/p>\n<p>        concerned for taking action for disposing off the vehicles<\/p>\n<p>        and other goods seized and detained in Police Station<\/p>\n<p>        premises U\/S 457, 458 &amp; 459 CrPC. Accordingly, the<\/p>\n<p>        SHOs have submitted reports before the courts concerned<\/p>\n<p>        for initiating action as mentioned above. Certain courts<\/p>\n<p>        have taken action on these lines. The matter is being<\/p>\n<p>        pursued vigorously. It is ensured that expeditious action<\/p>\n<p>        will be taken and the process will be completed shortly.&#8221;<\/p>\n<p>              4. After going through the fax message produced before us<\/p>\n<p>by the learned Government Pleader, we are of the opinion that the<\/p>\n<p>respondents are taking effective steps for proper disposal of the unwanted<\/p>\n<p>vehicles parked in front of Courts, Police Stations and other Government<\/p>\n<p>Offices.\n<\/p>\n<p>W.P.(C) No.18470 of 2008<\/p>\n<p><span class=\"hidden_text\">                                            3<\/span><\/p>\n<p>               5.
