                  learned counsel for the State.\n<\/p>\n
                              The petitioner is aggrieved by the orders dated<\/p>\n
                  15.9.2008    passed    by   the   Sub-divisional   Officer,<\/p>\n
                  Phulparas in Supply Case No.12\/08 ordering cancellation<\/p>\n
                  of his Public Distribution System Dealership licence as<\/p>\n
                  affirmed by the appellate order dated 21.7.2009 of the<\/p>\n
                  Collector, Madhubani in Supply Case No.59\/08-09.<\/p>\n
                  Assailing the procedure followed in disposal of the matter<\/p>\n
                  learned counsel submits that on 7.9.2008 the petitioner<\/p>\n
                  was alleged to have been served a show cause notice to<\/p>\n
                  be replied within 24 hours. It is submitted that this was<\/p>\n
                  no show cause notice as reasonable time to reply had to<\/p>\n
                  be given. The show cause notice is bad on that ground<\/p>\n
                  itself.\n<\/p>\n
                              He next submits that the Sub-divisional<\/p>\n
                  Officer in the order dated 15.9.2008 has arrived at a<\/p>\n
                  finding that the petitioner refused to receive the show
\n                    -2-<\/span><\/p>\n
cause notice and even his son refused acceptance of the<\/p>\n
same. In fact, the show cause notice was never served<\/p>\n
upon him. There is no discussion in the order dated<\/p>\n
15.9.2008 as to who was the individual\/person who went<\/p>\n
to serve the notice, and on what date and time,<\/p>\n
acceptance of which was refused. There is no discussion<\/p>\n
of any nature of evidence taken from that person, oral or<\/p>\n
documentary for refusal by the petitioner. In his appeal<\/p>\n
before the District Magistrate, the petitioner again denied<\/p>\n
receipt of any show cause notice and questioned the<\/p>\n
action of the respondents in concluding refusal of<\/p>\n
acceptance by failing to even disclose the name of the<\/p>\n
person who purported to serve the notice.<\/p>\n
            Learned counsel for the State prays for time to<\/p>\n
file counter affidavit.\n<\/p>\n
            On going through the impugned orders the<\/p>\n
Court does not consider it necessary as in light of the<\/p>\n
discussions contained in the orders the Court is satisfied<\/p>\n
that the matter has to be remanded to the Court of the<\/p>\n
Sub-divisional Officer.\n<\/p>\n
            The order dated 15.9.2008 recites that the<\/p>\n
petitioner did not receive the show cause notice. There is<\/p>\n
no discussion in the order of who was the individual who<\/p>\n
went to serve the order, on what date the acceptance was<\/p>\n
refused. That there may have been an endorsement by
\n                      -3-<\/span><\/p>\n
the person on the show cause notice acceptance of which<\/p>\n
was refused, may not be sufficient as there had to be a<\/p>\n
specific   finding   in    the   proceedings   for   refusal   of<\/p>\n
acceptance of notice, as otherwise the order assumes the<\/p>\n
nature of an ex parte order having serious repercussions<\/p>\n
on the petitioner, especially when the notice to show<\/p>\n
cause was never served upon him. The so called person<\/p>\n
who is said to have served notice was unnamed and<\/p>\n
details of the same was not being disclosed. The Appellate<\/p>\n
Authority has failed to deal with that objection of the<\/p>\n
petitioner and dismissed it as trivial in nature to arrive at<\/p>\n
the finding that since there was more than one report<\/p>\n
against the petitioner with regard to irregularities, he was<\/p>\n
aware that he was under enquiry and he did not wish to<\/p>\n
file any reply. The Court holds that the finding of the<\/p>\n
Appellate Authority on the aspect of service of notice is<\/p>\n
based on conjectures and surmises being speculative in<\/p>\n
nature. There had to be a positive finding of service upon<\/p>\n
the petitioner or refusal to accept. Even otherwise, there<\/p>\n
had to be a positive finding that there was a proceeding<\/p>\n
pending against the petitioner before the Sub-divisional<\/p>\n
Officer of which the petitioner was aware. Merely because<\/p>\n
there may have been enquiries against the petitioner<\/p>\n
shall not lead to a presumption of knowledge with regard<\/p>\n
to pendency of a proceeding. An enquiry may be held,
\n                          -4-<\/span><\/p>\n
     proceedings may not be initiated or vice versa.<\/p>\n
                   The impugned orders dated 15.9.2008 and<\/p>\n
     21.7.2009 are accordingly set aside.\n<\/p>\n
                   The matter is remanded to the Sub-divisional<\/p>\n
     Officer, Phulparas who shall proceed to serve a show<\/p>\n
     cause   notice    upon    the    petitioner   and    after   due<\/p>\n
     opportunity to him        pass final appropriate orders in<\/p>\n
     accordance with law within a maximum period of one<\/p>\n
     month from the date of receipt\/presentation of a copy of<\/p>\n
     this order.\n<\/p>\n
                   The writ application stands allowed.\n<\/p>\n<\/p>\n
