Justice K.SURENDRA MOHAN\n\n Dated :02\/07\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.17042 of 2010\n             -------------------------------------------\n               Dated this the 2nd July, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>   The petitioners have filed this Writ Petition challenging<\/p>\n<p>the Revenue Recovery action initiated against them for the<\/p>\n<p>recovery of Toddy Workers Welfare Fund contributions.<\/p>\n<p>     2. The petitioners along with 13 others had formed a<\/p>\n<p>partnership firm by name Amruth Liquors as per Ext.P1<\/p>\n<p>agreement. Pursuant to the said agreement, the license<\/p>\n<p>for conducting Toddy Shop Nos.1 to 86 of Kodungallur<\/p>\n<p>range for the abkari year 1999-2000 was bid in auction in<\/p>\n<p>the name of five partners including the petitioners. Since<\/p>\n<p>there was difference of opinion between the partners,<\/p>\n<p>some of them withdrew withdrawn from the partnership<\/p>\n<p>agreement.    According to the petitioners, the Welfare<\/p>\n<p>Fund Inspector had conducted an enquiry and assessed<\/p>\n<p>the welfare fund contribution in respect of the said shops.<\/p>\n<p>The said assessment was challenged by two of the<\/p>\n<p>partners before the Government by filing an appeal. The<\/p>\n<p>Government set aside the said assessment and remitted<\/p>\n<p><span class=\"hidden_text\">wpc No.17042\/2010         2<\/span><\/p>\n<p>   the matter back to the Welfare Fund Inspector for fresh<\/p>\n<p>   assessment. According to the petitioners, thereafter no<\/p>\n<p>   enquiry has been conducted and the matter is kept<\/p>\n<p>   pending. At present, Revenue Recovery proceedings have<\/p>\n<p>   been     initiated for  recovery   of  the   welfare   fund<\/p>\n<p>   contributions from the other partners on the ground that<\/p>\n<p>   the persons who had not challenged the assessment order<\/p>\n<p>   could not get the benefit of the order passed by the<\/p>\n<p>   Government, setting aside the assessment. Accordingly,<\/p>\n<p>   the petitioners have now been issued with a Revenue<\/p>\n<p>   Recovery notice which is Ext.P7. The petitioners therefore<\/p>\n<p>   challenge Ext.P7. As per Ext.P5, the share due from each<\/p>\n<p>   of the petitioners has been fixed and therefore, the same is<\/p>\n<p>   also challenged herein.\n<\/p>\n<p>         3. Adv.Renil Anto who appears for the third<\/p>\n<p>   respondent submits that an enquiry is in progress, for the<\/p>\n<p>   purpose of passing the final determination order in respect<\/p>\n<p>   of Toddy Shop Nos.1 to 86 of Kodungallur range for the<\/p>\n<p>   abkari year 1999-2000. It is submitted that notices have<\/p>\n<p>   been issued to the petitioners and that they are<\/p>\n<p>   participating in the enquiry.      Any amount would be<\/p>\n<p><span class=\"hidden_text\">wpc No.17042\/2010        3<\/span><\/p>\n<p>   recovered only after passing the final determination order<\/p>\n<p>   pursuant to the enquiry. In view of the above submission,<\/p>\n<p>   this Writ Petition can be disposed of directing the<\/p>\n<p>   proceedings to be expedited and keeping the Revenue<\/p>\n<p>   Recovery proceedings in abeyance till final orders are<\/p>\n<p>   issued by the third respondent.\n<\/p>\n<p>         4. In the above circumstances, this Writ Petition is<\/p>\n<p>   disposed of directing the third respondent to complete the<\/p>\n<p>   assessment proceedings and to pass final determination<\/p>\n<p>   orders in respect of the petitioners in accordance with<\/p>\n<p>   law, as expeditiously as possible and at any rate within a<\/p>\n<p>   period of two months from the date of receipt of a copy of<\/p>\n<p>   this judgment.
