Raval, learned Additional Public Prosecutor waives service<br \/>\n\tof notice of Rule on behalf of the Respondent-State of<br \/>\n\tGujarat.\n<\/p>\n<p>\tThe<br \/>\n\tpresent application has been filed for modification of the<br \/>\n\tconditions of bail and release of passport on the grounds mentioned<br \/>\n\tin the memo of application.\n<\/p>\n<p>\tThe<br \/>\n\tapplicant-accused is charged with having committed offences<br \/>\n\tunder Sections 406, 420, 465, 467, 471, 120(B) and 114 of the Indian<br \/>\n\tPenal Code and under Sections 13(1)(d) and 13(2) of the Prevention<br \/>\n\tof Corruption Act, 1988, for which, FIR being I-C.R.No.3\/2003 has<br \/>\n\tbeen lodged at D.C.B. Crime Police Station, Surat.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Mr.Kapadia has referred to the details and submitted that<br \/>\n\tin past also, the applicant has been granted such permission and he<br \/>\n\treturned back to India. He submitted that as the daughter-in-law is<br \/>\n\tpregnant, the applicant and his wife are desirous to meet her at<br \/>\n\tabroad for a longer period, for which, he has produced the tickets,<br \/>\n\twhich are from 19th October, 2011 to 19th<br \/>\n\tJuly, 2012. He further submitted that though the learned Sessions<br \/>\n\tCourt has granted such permission, it has been for a limited period<br \/>\n\tand, hence, the present application has been filed. He has also<br \/>\n\treferred to the order passed by the learned Sessions Court in<br \/>\n\tCriminal Misc. Application No.1974\/2011 dated 09.09.2011. He has<br \/>\n\talso submitted that amount of Rs.1.00 lac has already been<br \/>\n\tdeposited. He, therefore, submitted that the present application may<br \/>\n\tbe allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tAPP Mr.Raval has submitted that he had requested for a period of two<br \/>\n\tyears and, therefore, it has not been granted, however, it could<br \/>\n\thave been requested. He submitted that subject to depositing the<br \/>\n\tamount and usual conditions for submitting itinerary with contact<br \/>\n\tnumber and all details of his stay, same can be granted.\n<\/p>\n<p>\tIn<br \/>\n\tview of these submissions and the facts and circumstances of the<br \/>\n\tpresent case, the present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application stands allowed. The conditions imposed while<br \/>\n\treleasing the applicant on regular bail as per the order passed in<br \/>\n\tCriminal Misc. Application No.771\/2004 by the Joint District Judge &amp;<br \/>\n\tAdditional Sessions Judge, 3rd<br \/>\n\tFast Track, Surat dated 24.05.2004 shall remained suspended till<br \/>\n\t31st<br \/>\n\tJuly, 2012 in order to enable<br \/>\n\thim to visit abroad for the reasons stated in the application.<br \/>\n\tHowever, the applicant shall submit detailed itinerary with contact<br \/>\n\tnumber and address during his visit at abroad. He shall submit all<br \/>\n\tthese details before leaving India to the Trial Court and shall also<br \/>\n\tplace it on the record of this Court. The applicant shall also state<br \/>\n\tby way of undertaking that he will return back to India and<br \/>\n\tsurrender the passport on or before 31st<br \/>\n\tJuly, 2012.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
