Petitioner had let out its premises at U-38-A,<br \/>\nShakarpur, Delhi to one company called M\/s. Shrestha<br \/>\nPriya Finance &amp; Investment Limited. The company wound<br \/>\nup and a case of cheating (FIR No. 101\/2000) was<br \/>\nregistered against it under Sections 406\/420\/34 IPC at<br \/>\nP.S. Shakarpur on the complaint of some investors. Its<br \/>\noffice at the premises was said to have been sealed and<br \/>\nthen again re-opened and its office record was<br \/>\ntransferred to Malkhana of Police Station. It also<br \/>\ntranspires that when investigation of FIR No. 101\/2000<br \/>\nwas transferred to Crime Branch, petitioner was found in<br \/>\npossession of the premises.\n<\/p>\n<p> 2. Be that as it may, it was in this background<br \/>\nthat petitioner was booked in two FIRs &#8211; FIR No. 428\/2000<br \/>\nunder Sections 454\/380 IPC and FIR No. 433\/2000 under<br \/>\nSection 188 IPC. He challenged both FIRs in this<br \/>\npetition. The first one was quashed by court order<br \/>\ndated 4.9.2001 but the second one survived and now it is<br \/>\nto be seen whether this would also go. 0<\/p>\n<p> 3. This FIR under Section 188 IPC charges<br \/>\npetitioner of disobeying Police Commissioner&#8217;s orders<br \/>\ncontained in notification dated 22.6.2000 requiring<br \/>\nhouse owners to inform the concerned police stations<br \/>\nabout the particulars of the tenants to whom the<br \/>\npremises was let out or sublet by them.\n<\/p>\n<p> 4. Petitioner&#8217;s case is that Police Commissioner&#8217;s<br \/>\norder was not to his knowledge and, therefore, no<br \/>\noffence could be said to have been made out against him<br \/>\nunder Section 188 IPC. The stand of respondents,<br \/>\nhowever, is that the Commissioner&#8217;s notification dated<br \/>\n22.6.2000 was duly publicised before the relevant date<br \/>\nand its knowledge must be attributed to petitioner to<br \/>\nattract Section 188 IPC.\n<\/p>\n<p> 5. By court order dated 13.2.2002, respondent was<br \/>\nasked to indicate and specify all modes of publication<br \/>\nresorted to in this regard. DCP\/HQ Sh. T.N. Mohan has<br \/>\nfiled an affidavit in compliance along with some news<br \/>\nclippings and photocopies of some handbills, etc. in a<br \/>\nbid to show that Police Commissioner&#8217;s notification in<br \/>\nquestion was widely publicised and brought to the<br \/>\nknowledge of public and impliedly to petitioners also.<br \/>\nIt remains to be seen whether such knowledge could be<br \/>\nattributed to petitioners in the facts and circumstances<br \/>\nof the case.\n<\/p>\n<p> 6. Section 188 IPC, which has a crucial bearing in<br \/>\nthe matter, reads thus:-\n<\/p>\n<p> &#8220;188. Disobedience to order duly<br \/>\npromulgated by public servant &#8211; Whoever,<br \/>\nknowing that, by an order promulgated by a<br \/>\npublic servant lawfully empowered to promulgate<br \/>\nsuch order, he is directed to abstain from a<br \/>\ncertain act, or to take certain order with<br \/>\ncertain property in his possession or under his<br \/>\nmanagement, disobeys such direction.\n<\/p>\n<p>  shall, if such disobedience causes to<br \/>\ntender to cause obstruction, annoyance or<br \/>\ninjury, or risk of obstruction, annoyance or<br \/>\ninjury, to any person lawfully employed, be<br \/>\npunished with simple imprisonment for a term<br \/>\nwhich may extend to one month or with fine<br \/>\nwhich may extend to two hundred rupees, or with<br \/>\nboth;\n<\/p>\n<p> and if such disobedience causes or tends<br \/>\nto cause danger to human life, health or<br \/>\nsafety, or cases or tends to cause a riot or<br \/>\naffray, shall be punished with imprisonment of<br \/>\neither description for a term which may extent<br \/>\nto six months, or with fine which may extend to<br \/>\none thousand rupees, or with both.&#8221;\n<\/p>\n<p> 7. The provision provides for two types of<br \/>\npunishments for knowingly disobeying a validly<br \/>\npromulgated order by a public servant. Its ingredients<br \/>\nare:-\n<\/p>\n<p> (1) there must be an order promulgated by a public<br \/>\nservant.\n<\/p>\n<p> (2) such public servant must be lawfully empowered<br \/>\nto promulgate such order.\n<\/p>\n<p> (3) A person must have a knowledge of such order<br \/>\ndirecting him to abstain from an act or (b) to<br \/>\ntake certain order with certain property in his<br \/>\npossession or under his management.\n<\/p>\n<p> (4) He must disobey the order having its knowledge.\n<\/p>\n<p> (5) Such obedience must cause or tend to cause (a)<br \/>\nobstruction, annoyance or injury or risk of it<br \/>\nto any person lawfully employ or (b) danger to<br \/>\nhuman life, health and safety.\n<\/p>\n<p> 8. We are not at this stage concerned with police<br \/>\ncommissioner&#8217;s competence to pass an order requiring<br \/>\nhouse owners to give particulars of their tenants under<br \/>\nSection 144 under challenge before us. But it would<br \/>\nhave to be examined whether his order was to the<br \/>\nknowledge of the petitioner and he had knowingly<br \/>\ndisobeyed it.\n<\/p>\n<p> 9. As already seen, a person booked under Section<br \/>\n188 IPC must have actual knowledge of public servant&#8217;s<br \/>\norder requiring him to do or abstain from doing some<br \/>\nact. Acquiring or gaining of such knowledge is a<br \/>\npre-requisite. Any proof of general notification<br \/>\npromulgated by a public servant would not satisfy the<br \/>\nrequirement.\n<\/p>\n<p> 10. It is true that the knowledge of accused could<br \/>\nbe presumed in certain circumstances but all the same a<br \/>\ncomplaint\/FIR must indicate, even though not in very<br \/>\nexpress terms, that he had the knowledge of the order<br \/>\nand had knowingly disobeyed it. Where the terms of<br \/>\ncomplaint\/FIR did not provides even as inkling in this<br \/>\nregard, it cannot be said to make out or constitute an<br \/>\noffence under Section 188 and in such a situation, it<br \/>\nwould warrant to be quashed.\n<\/p>\n<p> 11. A perusal of the FIR does not indicate that<br \/>\npetitioner had actual knowledge of police commissioner&#8217;s<br \/>\norder. It is not the case of respondents also that this<br \/>\norder was served on him by whatever means\/modes or was<br \/>\neither affixed on his premises or was gazetted on the<br \/>\nrelevant date. Their stand, on the contrary, is that<br \/>\nthe requisite knowledge must be attributed to him<br \/>\nbecause police commissioner&#8217;s order was punished in<br \/>\nsome newspapers and handbills, etc. This, in our view,<br \/>\nwould not meet the requirement, because a number of<br \/>\nevents may be reported in newspapers. But that would<br \/>\nnot attribute or convey knowledge of such events to all<br \/>\nreaders. Moreover, a person may not be a reader of a<br \/>\nparticular newspaper. He can&#8217;t, therefore, be<br \/>\nattributed knowledge of the contents of the newspaper.<br \/>\nIt may have been understandable if a general public<br \/>\nnotice of police commissioner&#8217;s order was shown to have<br \/>\npublished in media in general to raise a presumption of<br \/>\nknowledge to the house owners living in a particular<br \/>\narea. But even that is not the case here.\n<\/p>\n<p> 12. The affidavit filed by DCP\/HQ leaves  much to be<br \/>\ndesired in this regard. It does not specify the mode<br \/>\nadopted whereby commissioner&#8217;s order was brought home to<br \/>\npetitioner. It only resorts to generalities in the<br \/>\nbelief that petitioner should be presumed to have gained<br \/>\nknowledge of the order whether or not it was brought to<br \/>\nhis knowledge. Even the concerned SHO&#8217;s version has not<br \/>\nbeen pressed in service nor any material placed on<br \/>\nrecord to show the manner and method in which the order<br \/>\nwas circulated or communicated to the residents of the<br \/>\narea in which petitioner lived.\n<\/p>\n<p> 13. We accordingly hold that petitioner could not<br \/>\nbe attributed knowledge of police commissioner&#8217;s order<br \/>\ncontained in notification dated 22.6.2000 and,<br \/>\ntherefore, the impugned FIR could not be said to make<br \/>\nout any offence against him under Section 188 IPC.\n<\/p>\n<p> 14.
