The suit is filed for<br \/>\neviction of petitioner by the respondent.\n<\/p>\n<p>       Learned counsel for petitioner submitted that the petitioner<br \/>\nhas suffered paralytic stroke on 9.4.2010 he was hospitalized and<br \/>\nremained hospitalized till 14.4.2010. After the discharge he was not<br \/>\nin a position to appear before the Court, so the application was filed<br \/>\nseeking adjournment, but it has been rejected by the trial Court on<br \/>\n19.4.2010. It is submitted that one opportunity be allowed to the<br \/>\npetitioner to appear in the witness box.\n<\/p>\n<p>       The prayer made by the petitioner is vehemently opposed by<br \/>\nShri Amit Verma, learned counsel for respondent.\n<\/p>\n<p>       From the perusal of documents Annexure P-4, Annexure P-5<br \/>\nand Annexure P-6, we find that petitioner suffered stroke on 9.4.2010<br \/>\nand he remained hospitalized upto 14.4.2010. After the discharge<br \/>\npetitioner may not be in a position to appear in the Court on<br \/>\n19.4.2010 and for this purpose petitioner moved an application<br \/>\nbefore the trial Court, but it was rejected. Though it is true that such<br \/>\ncertificate was not produced before the trial Court, but in the<br \/>\napplication filed by the petitioner before the trial Court it was<br \/>\nmentioned that petitioner is suffering from serious ailment.\n<\/p>\n<p>       In view of aforesaid, one opportunity deserves to be extended<br \/>\nto the petitioner to appear in the trial Court as witness and on the<br \/>\naforesaid date he shall be cross-examined by the plaintiff.         The<br \/>\npetitioner has already filed an affidavit, which shall be taken, by the<br \/>\ntrial Court on record.<\/p>\n<pre>\n                          W.P.No.5718\/2010\n\n     Prasram Kanojia                            Nand Kumar Mishra\n\n\n\n\n<\/pre>\n<p>         In view of aforesaid, this petition stands finally disposed of<br \/>\nwith following directions :-\n<\/p>\n<p>1.       The petitioner shall appear in person before the trial Court on<br \/>\nthe next date of hearing i.e. 7th July, 2010.\n<\/p>\n<p>2.       On the aforesaid date the plaintiff shall cross-examine the<br \/>\npetitioner. No adjournment shall be granted by the trial Court to the<br \/>\npetitioner for his appearance for any reason.\n<\/p>\n<p>3.
