Writ Petition No. 42325 of 2009.\n<\/p>\n<p>Learned Standing Counsel represents respondent nos. 1 to\n<\/p>\n<p>4.<\/p>\n<p>Issue notice to respondent nos. 5 and 6 fixing 21st<br \/>\nSeptember, 2010 as the date.\n<\/p>\n<p>Petitioner to take steps within a week.\n<\/p>\n<p>All the respondents may file counter affidavit by the next<br \/>\ndate fixed.\n<\/p>\n<p>List on the date fixed.\n<\/p>\n<p>On behalf of the petitioner it is stated that under the<br \/>\nGovernment Order dated 31st May, 1995, the State<br \/>\nGovernment came out with a proposal for establishing<br \/>\nwomen colleges in Asevit Development Blocks and Sevit<br \/>\nDevelopment Blocks with the help of the State Government.<br \/>\nPetitioner&#8217;s institution made an application for the purpose,<br \/>\nwhich was processed and ultimately, petitioners&#8217; institution<br \/>\nwas found eligible for establishing a girls college. Orders<br \/>\nwere issued for the money being released for the purpose by<br \/>\nthe State Government. However, before actual payment<br \/>\ncould be received, on the asking of respondent no.5, who is<br \/>\nCabinet Minister in the State of Uttar Pradesh, certain<br \/>\nobjections were raised qua the place where the institution<br \/>\nwas to be established with specific reference to the<br \/>\nparticular caste of persons residing in that area and on that<br \/>\nbasis the money which was earlier sanctioned in favour of<br \/>\nthe petitioners&#8217; institution was withheld. Petitioners therefore,<br \/>\napproached this Court by means of Civil Misc. Writ Petition<br \/>\nNo. 42325 of 2009, wherein interim order was granted on<br \/>\n19th August, 2009 directing that the authorities may consider<br \/>\n any other place for establishment of the institution but they<br \/>\nshall not take any final decision till the next date of listing of<br \/>\nthe writ petition. According to the petitioners, interim order<br \/>\nhas been extended from time to time. Despite the aforesaid,<br \/>\nrespondent no.2 under the impugned order dated 11th May,<br \/>\n2010 has selected the institution run by the wife of the<br \/>\nCabinet Minister i.e. respondent no.5, as manager for<br \/>\nallotment of Rs. 10,00,000\/- for establishing a girls<br \/>\ninstitution.
