(Oral)\n<\/pre>\n<p>      Notice of motion.\n<\/p>\n<p>      On the asking of this Court, Mr.B.S.Chahal, DAG, Punjab accepts<\/p>\n<p>notice on behalf of the respondents-State. With the consent of the counsel,<\/p>\n<p>this petition is disposed of at motion stage.\n<\/p>\n<p>      The petitioner was engaged as Driver          on daily wage basis on<\/p>\n<p>1.6.1993. He is continuing on the post since then. The petitioner claims<\/p>\n<p>regularization of his services. His case        was also recommended vide<\/p>\n<p>Annexure P-5. He also served legal notice dated 10.11.2008 (Annexure P-<\/p>\n<p>6). The grievance of the petitioner is that he is working against a sanctioned<\/p>\n<p>post, but   his services have not been regularized till date. The State<\/p>\n<p>Government even notified policy dated 15.12.2006 (Annexure P-3) for<br \/>\n<span class=\"hidden_text\"> CWP NO.1824 OF 2009                                2<\/span><\/p>\n<p>regularization   of services of similarly situated persons. Even then, no<\/p>\n<p>consideration has been accorded to the case of the petitioner.<\/p>\n<p>      The issue of regularization is finally set at rest by Hon&#8217;ble Supreme<\/p>\n<p>Court in the case of Secretary State of Karnataka and others Vs. Uma Devi<\/p>\n<p>Secretary State of Karnataka and others Vs. Uma Devi (2006) 4 SCC 1<\/p>\n<p>wherein following observations have been made:-<\/p>\n<blockquote><p>                         &#8220;53. One aspect needs to be clarified. There may<\/p>\n<p>                         be cases where irregular appointments (not illegal<\/p>\n<p>                         appointments) as explained in S.V. Narayanappa,<\/p>\n<p>                         R.N. Nanjundappa and B.N. Nagarajan              and<\/p>\n<p>                         referred to in para 15 above, of duly qualified<\/p>\n<p>                         persons in duly sanctioned vacant posts might have<\/p>\n<p>                         been made and the employees have continued to<\/p>\n<p>                         work for ten years or more but without the<\/p>\n<p>                         intervention of orders of the courts or of tribunals.<\/p>\n<p>                         The question of regularisation of the services of<\/p>\n<p>                         such employees may have to be considered on<\/p>\n<p>                         merits in the light of the principles settled by this<\/p>\n<p>                         Court in the cases above referred to and in the light<\/p>\n<p>                         of this judgment. In that context, the Union of<\/p>\n<p>                         India,   the   State   Governments       and    their<\/p>\n<p>                         instrumentalities should take steps to regularise as<\/p>\n<p>                         a one time measure, the services of such irregularly<\/p>\n<p>                         appointed, who have worked for ten years or more<\/p>\n<p>                         in duly sanctioned posts but not under cover of<\/p>\n<p>                         orders of the courts or of tribunals and should<br \/>\n<span class=\"hidden_text\"> CWP NO.1824 OF 2009                                  3<\/span><\/p>\n<p>                          further ensure that regular recruitments are<\/p>\n<p>                          undertaken to fill those vacant sanctioned posts<\/p>\n<p>                          that require to be filed up, in cases where<\/p>\n<p>                          temporary employees or daily wagers are being<\/p>\n<p>                          now employed. The process must be set in motion<\/p>\n<p>                          within six months from this date. We also clarify<\/p>\n<p>                          that regularisation, if any, already made, but not<\/p>\n<p>                          sub judice, need not be reopened based on this<\/p>\n<p>                          judgment, but     there should     be no further by-<\/p>\n<p>                          passing of the constitutional requirement and<\/p>\n<p>                          regularising or making permanent, those not duly<\/p>\n<p>                          appointed as per the constitutional scheme.&#8221;<\/p><\/blockquote>\n<p>      Under the given circumstances, this petition is disposed of with a<\/p>\n<p>direction to the respondents to consider the case of the petitioner in the light<\/p>\n<p>of the government policy which also appears to have been based on the<\/p>\n<p>aforesaid judgment of Hon&#8217;ble Supreme Court and consequential order be<\/p>\n<p>passed within a period of four months of the receipt of a certified copy of<\/p>\n<p>this order.
