Bala Kurup,<\/p>\n<p>who was a Police Constable in the Police Department and<\/p>\n<p>who died while in service on 6.9.1990. She is the third<\/p>\n<p>wife of the deceased and is the legally wedded wife.   As<\/p>\n<p>on the date of death of her husband, she had a minor son.<\/p>\n<p>Civil Suits were filed by the 2nd divorced wife, her minor<\/p>\n<p>daughter and his mother as O.S No.49\/91 and 38\/92<\/p>\n<p>claiming share of family pension to them in which it was<\/p>\n<p>held by the Sub Court, Vadakara that the petitioner, her<\/p>\n<p>minor son and minor daughter of the deceased&#8217;s second<\/p>\n<p>divorced wife are entitled to family pension. Accordingly<\/p>\n<p>she was receiving 1\/3rd share in the family pension.<\/p>\n<p>     2.    Under the relevant provisions, Rule 90 (7) (ii)<\/p>\n<p>(b) &amp; (c) of Part III of K.S.R., &#8220;the contributory family<\/p>\n<p>pension is admissible in case of son until he attains the<\/p>\n<p>age of 25 years or till he starts earning livelihood<\/p>\n<p>whichever is earlier and in the case of unmarried<\/p>\n<p>daughter until she attains the age 25 years or till she<\/p>\n<p>W.P ( C) No.3013 of 2009<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>starts earning livelihood whichever is earlier.&#8221;       The<\/p>\n<p>daughter of her husband&#8217;s second      divorced wife    was<\/p>\n<p>married in the year 1997 and therefore her eligibility for<\/p>\n<p>family pension ceased after the marriage. On 30.5.2006,<\/p>\n<p>her minor son who was receiving family pension         also<\/p>\n<p>ceased to receive pension as he attained the age of 25<\/p>\n<p>years. Since the representation submitted by the petitioner<\/p>\n<p>to sanction full pension to her was not being attended to,<\/p>\n<p>she approached this Court by filing WPC No.16092 of 2007,<\/p>\n<p>wherein, by Exhibit-P1 judgment this Court directed the<\/p>\n<p>Accountant General to pass orders in the matter.<\/p>\n<p>      3.    Exhibit-P2 is the recommendation made by the<\/p>\n<p>3rd respondent to the Accountant General for sanctioning<\/p>\n<p>full  family pension to the petitioner.     Thereafter, by<\/p>\n<p>Exhibit-P3 the Accountant General has passed appropriate<\/p>\n<p>orders sanctioning full pension from 8.5.2007.         The<\/p>\n<p>petitioner is seeking arrears from the date on which the<\/p>\n<p>daughter of her husband&#8217;s second wife ceased to receive<\/p>\n<p>her share in the family pension.\n<\/p>\n<p>W.P ( C) No.3013 of 2009<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>      4.    By Exhibit-P4, the Government has proposed<\/p>\n<p>amendment to the Rule providing for restoration of full<\/p>\n<p>family pension in the case of a claimant like the petitioner<\/p>\n<p>when the other sharers ceases to get the amount. Relevant<\/p>\n<p>portion of the order incorporating the amended provisions<\/p>\n<p>is extracted below.\n<\/p>\n<blockquote><p>                 &#8220;Where the deceased employee is<br \/>\n           survived by a widow but has left behind an<br \/>\n           eligible son\/daughter from another wife,<br \/>\n           the eligible son\/daughter will be paid the<br \/>\n           share of Family Pension which the mother<br \/>\n           would have received. If she had been alive<br \/>\n           at the time of death of the employee while<br \/>\n           sharing Family Pension between children of<br \/>\n           1st marriage and spouse\/children in second<br \/>\n           marriage, restoration of full Family Pension<br \/>\n           can be allowed in case where 50% is no<br \/>\n           longer payable by the Government to the<br \/>\n           children    of first  marriage\/spouse     or<br \/>\n           children by second marriage.\n<\/p><\/blockquote>\n<p>The issue as such is covered by Exhibit-P1 judgment. In<\/p>\n<p>the opening paragraph of the judgment, the submission by<\/p>\n<p>the learned Government Pleader that the petitioner is<\/p>\n<p>entitled to full family pension from the date on which the<\/p>\n<p>other legal heirs attains majority or when the dependents<\/p>\n<p>gets married is recorded. Finally it was directed that the<\/p>\n<p>W.P ( C) No.3013 of 2009<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>petitioner shall be given the arrears due in the manner<\/p>\n<p>aforementioned, within the period fixed.<\/p>\n<p>      5.    Evidently, Exhibit-P4 is    dated   8.5.2007 and<\/p>\n<p>accordingly by Exhibit-P3 the benefit was restricted from<\/p>\n<p>8.5.2007. Learned counsel for the petitioner submitted that<\/p>\n<p>since it is by way of restoration that the petitioner is<\/p>\n<p>getting full amount of family pension she should get the<\/p>\n<p>shares as on the date on which they have ceased to be<\/p>\n<p>made available to other sharers otherwise there will not be<\/p>\n<p>any relevant principle in restricting the claim from the<\/p>\n<p>date of Exhibit-P4.\n<\/p>\n<p>      6.    Third respondent has filed a counter affidavit,<\/p>\n<p>wherein, it is stated that going by the date of Exhibit-P4 the<\/p>\n<p>benefit is available from that date. It is also submitted that<\/p>\n<p>the 3rd respondent has fully complied with the directions<\/p>\n<p>issued by this Court in Exhibit-P1 judgment.     In paragraph<\/p>\n<p>10 of the counter affidavit, the stand taken is that the<\/p>\n<p>petitioner is eligible to get full family pension only with<\/p>\n<p>effect from 8.5.2007 as per Exhibit-P4 Government Order<\/p>\n<p>as it is not having any retrospective effect.<\/p>\n<p>W.P ( C) No.3013 of 2009<br \/>\n<span class=\"hidden_text\">                                 5<\/span><\/p>\n<p>      7.    A reading of Exhibit-P4 shows that what the<\/p>\n<p>Government intends is to restore the full pension when<\/p>\n<p>the other sharers become ineligible. This amendment was<\/p>\n<p>proposed to be made in tune with the provisions applicable<\/p>\n<p>under the Government of India.         When the benefit of<\/p>\n<p>restoration is sought to be made,       the claimant will be<\/p>\n<p>entitled for restoration from the date on which such<\/p>\n<p>claimant becomes eligible to get the full pension. The words<\/p>\n<p>used in the provision        are &#8220;restoration of full family<\/p>\n<p>pension&#8221; and hence it will necessarily have to be from an<\/p>\n<p>anterior date, on which the right        accrues.    The right<\/p>\n<p>accrues     when the other shares cease to get it.        The<\/p>\n<p>intention of the provision is to benefit a class of family<\/p>\n<p>pensioners, who were also getting a portion of the amount<\/p>\n<p>sanctioned. By the new amendment they become entitled<\/p>\n<p>for the shares which ceases to other sharers, which is<\/p>\n<p>automatic on the happening of the said event.<\/p>\n<p>      8.    In that view of the matter, restriction imposed in<\/p>\n<p>Exhibit-P3 for sanctioning full pension only from 8.5.2007<\/p>\n<p>cannot be justified.\n<\/p>\n<p>W.P ( C) No.3013 of 2009<br \/>\n<span class=\"hidden_text\">                                 6<\/span><\/p>\n<p>      9.    It is pointed out that      the daughter of her<\/p>\n<p>husband&#8217;s second wife got married in the year 1997 and<\/p>\n<p>and her son attained the age of 25 years on 30.5.2006.<\/p>\n<p>Hence their share of family pension ceased with effect from<\/p>\n<p>5.12.1997 and 30.5.2006.
