BASANT, J.\n\n\n             ````````````````````````````````````````````````````\n\n                   W.P.(C) No. 24257 OF 2007 K\n\n             ````````````````````````````````````````````````````\n\n            Dated this the 12th day of February, 2008\n\n\n                            J U D G M E N T\n<\/pre>\n<p>              The   short   prayer   of   the   petitioners   in   this   writ<\/p>\n<p>petition   is   that   crime   No.341\/07   of   Vizhinjam   police   station<\/p>\n<p>may be entrusted to the 7th respondent CBI for investigation.<\/p>\n<p>      2.      Serious allegations about misappropriation of large<\/p>\n<p>quantity   of   rice   which   were   in   the   possession   of   the   Food<\/p>\n<p>Corporation of India is alleged in the said crime.  It is alleged<\/p>\n<p>that   officials   of   the   F.C.I.   in   collusion   with   some   others   had<\/p>\n<p>siphoned   out   rice   from   the   possession   of   the   F.C.I.   with<\/p>\n<p>dishonest   intention.     The   petitioners   submit   that   such   a<\/p>\n<p>serious   crime   committed   by   the   officials   of   the   F.C.I.   in<\/p>\n<p>collusion with others deserves to be investigated by a Central<\/p>\n<p>Agency.  The nature of the challenge before the investigator is<\/p>\n<p>such that a local investigator may not be able to do justice to<\/p>\n<p>the job and, therefore, the case may be entrusted to the CBI.<\/p>\n<p>WPC.24257\/07<\/p>\n<p><span class=\"hidden_text\">                                      : 2 :<\/span><\/p>\n<p>This   is   the   short   prayer.     The   learned   counsel   for   the<\/p>\n<p>petitioners   further   submits   that   the   State   Government   had<\/p>\n<p>undertaken   on   the   floor   of   the   Legislative   Assembly   that<\/p>\n<p>investigation shall be entrusted to the CBI but no steps have<\/p>\n<p>been taken by the State Government so far.  Notice was given<\/p>\n<p>to  all   concerned.     The   F.C.I.,   the   5th  respondent,   has   filed   a<\/p>\n<p>formal   objection.     They   have   denied   the   allegations   in   the<\/p>\n<p>petition   but   no   worthwhile   contention   has   been   raised   which<\/p>\n<p>can be an effective answer to the  prayer for investigation  by<\/p>\n<p>the   CBI.     No   specific   objection   has   been   raised   by   anyone.<\/p>\n<p>The   learned   Public   Prosecutor,   on   behalf   of   the   State,   has<\/p>\n<p>reported that the State has no objection and wants the matter<\/p>\n<p>to be investigated by the CBI.\n<\/p>\n<\/p>\n<p>      3.     The learned Standing Counsel for the CBI submits<\/p>\n<p>that   the   CBI   is   heavily   overloaded   with   work   and   want   of<\/p>\n<p>infrastructure   and   facilities   fetter   the   ability   of   the   CBI   to<\/p>\n<p>conduct   an   effective   investigation.     The   learned   Standing<\/p>\n<p>Counsel submits that if this Court directs the CBI to conduct<\/p>\n<p>WPC.24257\/07<\/p>\n<p><span class=\"hidden_text\">                                      : 3 :<\/span><\/p>\n<p>investigation,   there   may   also   be   an   appropriate   direction   to<\/p>\n<p>ensure   that   the   requisite   materials   and   resources   are   also<\/p>\n<p>provided   by   the   State   Government   for   the   conduct   of   the<\/p>\n<p>investigation.\n<\/p>\n<\/p>\n<p>       4.    Having   considered   all   the   relevant   inputs,   I   am<\/p>\n<p>satisfied that this petition can be allowed and direction can be<\/p>\n<p>issued   to   the   7th  respondent   CBI   to   take   over   and   complete<\/p>\n<p>the   investigation   in   crime   No.341\/07   of   Vizhinjam   police<\/p>\n<p>station.\n<\/p>\n<\/p>\n<p>       5.    This   writ   petition   is   accordingly   allowed.     The   7th<\/p>\n<p>respondent CBI shall take over and complete the investigation<\/p>\n<p>in   crime   No.341\/07   of   Vizhinjam   police   station.
