Kodekar,  learned APP waives service of Rule on behalf of<br \/>\n\trespondents.\n<\/p>\n<p>The<br \/>\n\tapplicant has filed this application under Section 439 of the Code<br \/>\n\tof Criminal Procedure, 1973, for enlarging him on regular bail in<br \/>\n\tconnection with the offence being CR No. I-28 of 2010 registered<br \/>\n\twith Satellite Police Station, Ahmedabad, for the offences under<br \/>\n\tSection 302, 324 and 114 of I.P. Code and under Section 135(1) of<br \/>\n\tthe Bombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tCounsel for the applicant has contended that the applicant is<br \/>\n\tinnocent person and has not played any role in the alleged incident<br \/>\n\tand at that time he was a student. He has contended that the alleged<br \/>\n\tincident has occurred in a heat of moment and due to sudden quarrel<br \/>\n\tthe deceased received the injuries. There was no intention on the<br \/>\n\tpart of the accused to kill the deceased. He has contended that the<br \/>\n\tdeceased along with the complainant came to the place of occurrence<br \/>\n\twith deadly weapon and have assaulted them with deadly weapons and<br \/>\n\tonly in the self defence the alleged incident has occurred. He has<br \/>\n\talso contended that cross case was also registered against the<br \/>\n\tcomplainant party. He has contended that the applicant has not<br \/>\n\tplayed any role and there was no intention on the part of the<br \/>\n\tapplicant to commit crime. He has contended that now the<br \/>\n\tcharge-sheet has already been filed and there is no possibility of<br \/>\n\ttampering the documents by the applicant. He, therefore, prays that<br \/>\n\tthe applicant may be enlarged on bail.\n<\/p>\n<p>Learned<br \/>\n\tAPP has read the statement of the witnesses and vehemently contended<br \/>\n\tthat looking to the seriousness of the offence, the applicant may<br \/>\n\tnot be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard the learned Counsel for both the sides and looking to the<br \/>\n\tfacts and circumstances of the case, statement of the witnesses and<br \/>\n\tthe fact that the cross case has also been filed against the<br \/>\n\tcomplainant party and it also appears that the learned Sessions<br \/>\n\tJudge has also passed an order against the accused &#8211;<br \/>\n\tcomplainant party for adding Section 307 of I.P. Code, and also the<br \/>\n\tfact now the charge-sheet is filed and that there is no definite<br \/>\n\tallegation made against the present applicant, I am inclined to<br \/>\n\tgrant bail to the applicant. No doubt, this is successive bail<br \/>\n\tapplication,  but, looking to the fact that the learned Sessions<br \/>\n\tJudge has also passed order adding the Section 307 I.P. Code in a<br \/>\n\tcross case, filed against the complainant party, I am inclined to<br \/>\n\tenlarge the applicant on bail. However, both the parties do not<br \/>\n\tpress for reasoned order.\n<\/p>\n<p>Considering<br \/>\n\tthe above, this Application is allowed. The applicant is ordered to<br \/>\n\tbe enlarged on bail in connection with CR No.I &#8211; 28 of 2010<br \/>\n\tregistered with Satellite Police Station for the offence alleged<br \/>\n\tagainst him in this application on his executing a Bond of<br \/>\n\tRs.10,000\/- (Rupees ten thousand only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the trial Court and subject<br \/>\n\tto the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tshall<br \/>\nmark his presence before the Satellite Police Station on every last<br \/>\nday of the month between 11.00 a.m. and 2.00 p.m. till the trial is<br \/>\nover.\n<\/p>\n<p>e)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>f)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge.\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>5.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>6.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>7.\tRule<br \/>\nis made absolute.
