The appellants have challenged the order<br \/>\ndated 15.12.2003 passed by the High Court of Gujarat at<br \/>\nAhmedabad, rejecting their application for bail filed under Section<br \/>\n439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tFirst appellant was one of the Directors of M\/s Charotar<br \/>\nNagarik Sahakari Bank Limited [for short &#8216;the Bank&#8217;]. He became<br \/>\na shareholder of the bank on 18.10.99 and was appointed as a<br \/>\nDirector on the same day. It is alleged that one Chiman Sathi,<br \/>\nManaging Director of the said bank, first appellant and other<br \/>\nDirectors of the bank siphoned off the funds of the bank by bogus<br \/>\nloans and fictitious letters of credit in the name of their friends,<br \/>\nrelatives, associates and name-lender companies either without<br \/>\nany security or with wholly inadequate security.\n<\/p>\n<p>3.\tThe wives of appellant Nos. 1 and 2 along with appellant<br \/>\nNo.3 are the Directors of M\/s Bhavika Creations which is one of<br \/>\nthe beneficiaries of the illegal and collusive loans\/credit facilities<br \/>\ngiven by the Bank. It is alleged that appellant nos. 2 &amp; 3 actively<br \/>\nassisted and supported appellant no. 1 in several fraudulent<br \/>\ntransactions in the name of Bhavika Creations, Jayraj Multimedia,<br \/>\nHindustan Earthmovers Pvt. Ltd.\n<\/p>\n<p>(27.12.2000)<br \/>\n2.486<br \/>\ncrores<br \/>\n<span class=\"hidden_text\">Appellants Nos. 1 to 3<\/span>\n<\/p>\n<p>12.<br \/>\nBogus Letter of Credit in NRI<br \/>\naccount of Shri Subhash Mehta<br \/>\n7 crores<br \/>\n<span class=\"hidden_text\">Appellants Nos. 1 to 3 <\/span><br \/>\nand Chiman Sathi<\/p>\n<p>13.<br \/>\nVehicle loan to Himanshu Desai<\/p>\n<p>1.4 lakhs<br \/>\n<span class=\"hidden_text\">Appellant No. 1<\/span>\n<\/p>\n<p>14.<br \/>\nVehicle loan to Bhavika Creations.<br \/>\n4 lakhs<br \/>\n<span class=\"hidden_text\">Appellants Nos. 1 to 3<\/span><\/p>\n<p>It is also alleged that Chiman Sathi (Managing Director) and other<br \/>\nDirectors were involved in other fraudulent transactions relating to<br \/>\nthe Bank, which are not relevant for the purpose of this Appeal.\n<\/p>\n<p>4.\tIn regard  to the said bank scam,  the bank lodged a<br \/>\ncomplaint with the Police Station, Anand Town vide Criminal No.6<br \/>\nof 2002 for offences punishable under sections 409, 468 and 114<br \/>\nof Indian Penal Code. It is stated that the Appellants voluntarily<br \/>\nsurrendered on 24.10.2002 and are in custody even since then.<br \/>\nOn completion of investigation, a charge-sheet was filed on<br \/>\n22.1.2003 under sections 409, 465,466, 467, 468,470, 471, 406,<br \/>\n420 and 120-B of IPC against the Directors of the Bank.\n<\/p>\n<p>5.\tIt is alleged that Appellants filed Criminal Misc. Appeal Nos.<br \/>\n747\/2000, 6\/2003 and 479\/2003 seeking regular bail which were<br \/>\nrejected by the Sessions Judge, Anand on 5.4.2003, 16.5.2003<br \/>\nand 21.11.2003 respectively. The Appellants filed Criminal Misc.<br \/>\nAppeal Nos. 6523\/2003 and 6520\/2003 before the High Court of<br \/>\nGujarat which were withdrawn. After rejection of Criminal Misc.<br \/>\nAppeal No. 479\/2003 by the Sessions Judge, the appellants<br \/>\nmoved a regular bail application (Criminal Misc. Application No.<br \/>\n10003 of 2003) in the High Court of Gujarat. The High Court after<br \/>\nreferring to the clandestine and fraudulent nature of the<br \/>\ntransactions rejected the application. The said order is challenged<br \/>\nin this appeal, urging the following contentions :-\n<\/p>\n<p>a)\tThe Chairman, Vice-Chairman and other Directors of<br \/>\nthe Bank who were also allegedly involved in the said<br \/>\noffence have been released on regular bail. [Reliance<br \/>\nis placed on order of this Court dated 14.7.2003 in<br \/>\nCriminal Appeal No. 802 of 2003 granting bail to one<br \/>\nRajendra Kumar Dhanraj Banthia, a share broker who<br \/>\naccording to appellants was the real beneficiary and<br \/>\ntook the siphoned money from the bank] <\/p>\n<p>b)\tEven though the charge-sheet has been filed as long<br \/>\nback as on 22.1.2003, charges have not been framed.<br \/>\nThe investigation is completed. The prosecution has<br \/>\ncited as many as 150 witness. The trial is likely to be<br \/>\nprotracted and therefore, appellants should be<br \/>\nreleased on bail. It is contended that failure to do so<br \/>\nwould amount to detention by way of punishment.\n<\/p>\n<p>c)\tEven if a prima facie case is established, where<br \/>\npresence of the accused would readily be available for<br \/>\ntrial and there was no likelihood of the accused<br \/>\ntampering with the evidence in view of completion of<br \/>\nthe investigation, the accused should not be detained,<br \/>\nparticularly when the accused has been long<br \/>\nincarcerated and the trial is likely to consume long<br \/>\ntime  vide Bhagirath Singh vs. State of Gujarat<br \/>\n[1984 (1) SCC 284].\n<\/p>\n<p>6.\tThe cases of appellants cannot be compared with the others<br \/>\nwho have been released on bail. The cases of Appellants are more<br \/>\nserious than the case of other Directors (except the case of<br \/>\nChiman Sathi). Further, the State has pointed out that one or two<br \/>\nDirectors of the Bank were released on the ground of old age and<br \/>\nmedical problems; and other Directors were released on bail after<br \/>\nthey repaid their entire dues. It is also submitted that in regard to<br \/>\nthree sons of Chiman Sathi (the then Managing Director of the<br \/>\nBank), the High Court cancelled the bail for not honouring the<br \/>\nundertaking and repaying the dues. The case of Rajendra Banthia<br \/>\n(share-broker) is different and he apparently was not directly<br \/>\ninvolved in defrauding the Bank.\n<\/p>\n<p>7.\tA Constitution Bench of this Court in <a href=\"\/doc\/1041403\/\">Bihar Legal Support<br \/>\nSociety v. Chief Justice of India &amp; Anr.<\/a> [1986 (4) SCC 767]<br \/>\nhas held that this Court should not ordinarily, save in exceptional<br \/>\ncases, interfere with  orders granting or refusing bail by the High<br \/>\nCourt because the High Court should normally be the final arbiter<br \/>\nin such matters. The crime in which the petitioners are involved is<br \/>\nvery serious involving a conspiracy to cheat and defraud public<br \/>\ninstitutions in a systematic manner and the punishment is likely to<br \/>\nbe severe in the event of conviction. The High Court has recorded<br \/>\na finding that the material shows that the petitioners are prima<br \/>\nfacie involved in the offence. Large portion of the amount<br \/>\nadvanced to Bhavika Creations (about Rs. 7.5 crores) has<br \/>\nallegedly been diverted by appellant No.1 for acquiring shares in<br \/>\nNedungadi Bank Ltd. As a result of the scam, the Bank is under<br \/>\nliquidation from 31.7.2003. On account of the fraudulent activities<br \/>\nof the then Managing Director and Appellant No.1 (the then<br \/>\nDirector) and Appellants Nos. 2 and 3, nearly Rs.23 crores is due<br \/>\nfrom Bhavika Creations alone. Having regard to huge amounts<br \/>\ninvolved in the systematic fraud, there is a danger of the<br \/>\nappellants absconding, if released on bail, or attempting to<br \/>\ntamper with the evidence by pressurizing witnesses. In the<br \/>\ncircumstances, we do not find any reason to interfere with the<br \/>\norder refusing bail as grant of the relief sought may result in<br \/>\nthwarting the course of justice.
