R.R. Bhanot, the appellant herein, attained the age  of<br \/>\nsuperannuation\ton December 31, 1970.  Till-date  his  post-<br \/>\nretiral\t benefits including pension have not  been  settled.<br \/>\nHe  has\t been  running\tfrom pillar to\tpost  and  has\tbeen<br \/>\nshuttling  between  the two States of Himachal\tPradesh\t and<br \/>\nPunjab\tfor over two decades.  Total apathy on the  part  of<br \/>\nthe  officers  concerned,  has\tbrought\t untold\t misery\t and<br \/>\nhardship  to the appellant.  He filed a writ petition  under<br \/>\nArticle 226 of the Constitution of India, before the  Punjab<br \/>\nand  Haryana High Court, seeking appropriate  directions  to<br \/>\nthe  authorities  concerned  for  the  release\tof  pension,<br \/>\ngratuity etc. due to him under the rules.  It is unfortunate<br \/>\nthat  the High Court dismissed the writ petition in  limine.<br \/>\nThis appeal by way of special leave is against the order  of<br \/>\nthe High Court.\n<\/p>\n<p>3.   The appellant was born on January 1, 1913.\t He  entered<br \/>\nthe  service of the erstwhile State of Punjab  as  Sectional<br \/>\nOfficer\t (Overseer) on September 30, 1937.  He was  promoted<br \/>\nto the post of Sub-Divisional Engineer on December 10, 1959.\n<\/p>\n<p>4.   On the reorganisation of the erstwhile State of Punjab,<br \/>\nthe  appellant was provisionally allocated to the  State  of<br \/>\nHimachal  Pradesh  with effect from November 1,\t 1966.\t The<br \/>\nappellant  joined the State of Himachal Pradesh but  at\t the<br \/>\nsame time represented before the Union of India against\t his<br \/>\nallocation to the said State.\n<\/p>\n<p>5.   The Himachal Pradesh Government prematurely retired the<br \/>\nappellant from service by notification dated March 20,\t1969<br \/>\nwith  effect  from  the\t afternoon of  May  14,\t 1968.\t The<br \/>\nappellant,  at\tthat  time,  was  on  deputation  with\t the<br \/>\nDevelopment  Commissioner, Himachal Pradesh, Shimla and\t was<br \/>\nposted\t as  Assistant\tEngineer,  Development,\t Una.\t The<br \/>\nappellant challenged the said order by way of writ  petition<br \/>\nbefore\tthe High Court of Delhi, Himachal Bench, Shimla.   A<br \/>\nlearned\t Single\t Judge of the High Court  allowed  the\twrit<br \/>\npetition  and  quashed\tthe  order  dated  March  20,\t1969<br \/>\nprematurely  retiring  the  appellant  from  service.\t The<br \/>\noperative  part of the High Court judgment  dated  September<br \/>\n29, 1969 is as under:\n<\/p>\n<blockquote><p>\t      &#8220;After the matter was argued at great  length,<br \/>\n\t      Shri  Malhotra,  the learned counsel  for\t the<br \/>\n\t      petitioner, was able to bring to my notice  an<br \/>\n\t      order  passed, pending this writ petition,  by<br \/>\n\t      the  Government  of India,  Ministry  of\tHome<br \/>\n\t      Affairs,\tNew  Delhi on May 19,  1969  stating<br \/>\n\t      that  with  effect from November 1,  1966\t the<br \/>\n\t      petitioner,  among others, was deemed to\thave<br \/>\n\t      been  allotted to the State of  Punjab.\tThis<br \/>\n\t      order  was  passed in exercise of\t the  powers<br \/>\n\t      conferred by sub-section (2) of Section 82  of<br \/>\n\t      the  Punjab  Reorganisation  Act,\t 1966.\t  By<br \/>\n\t      reason  of  the  said  provision\tit  was\t the<br \/>\n\t      Central\tGovernment   which   could   finally<br \/>\n\t      determine\t the  State to\twhich  the  officers<br \/>\n\t      concerned\t were  allotted.  In  view  of\tthis<br \/>\n\t      order,  which has been passed by\tthe  Central<br \/>\n\t      Government, Shri Chhabil Dass, learned counsel<br \/>\n\t      for  the\tState of  Himachal  Pradesh,  fairly<br \/>\n\t      concedes\t that\tthe   order   retiring\t the<br \/>\n\t      petitioner  from service on completion  of  55<br \/>\n\t      years did not<br \/>\n<span class=\"hidden_text\">\t      409<\/span><br \/>\n\t      survive.\t  It  is  hence\t quashed.   In\t the<br \/>\n\t      circumstances the parties will bear their\t own<br \/>\n\t      costs.&#8221;\n<\/p><\/blockquote>\n<p>6.   It\t is  thus  obvious that the  representation  of\t the<br \/>\nappellant against his provisional allocation to the State of<br \/>\nHimachal  Pradesh was accepted and as a consequence  by\t the<br \/>\norder  dated May 19, 1969 issued by the Government of  India<br \/>\nin  exercise of the powers under sub-section (2) of  Section<br \/>\n82 of the Punjab Reorganisation Act, 1966, the appellant was<br \/>\nfinally\t allocated to the State of Punjab with\teffect\tfrom<br \/>\nNovember 1, 1966.\n<\/p>\n<p>7.   After the High Court set aside the premature retirement<br \/>\nof  the\t appellant, he represented before  the\tEngineer-in-<br \/>\nChief  PWD, Himachal Pradesh and also the  State  Government<br \/>\nfor  payment  of  the arrears of his  salary  and  also\t for<br \/>\nfurther posting as a consequence of the High Court judgment.<br \/>\nIt  seems  that\t the authorities in the\t State\tof  Himachal<br \/>\nPradesh\t did  not  take any action on the  ground  that\t the<br \/>\nappellant  having  been finally allocated to  the  State  of<br \/>\nPunjab,\t it was for the later to look into the grievance  of<br \/>\nthe appellant.\tThere is nothing on the record to show as to<br \/>\nwhether\t the  State  of Himachal Pradesh  issued  any  order<br \/>\ndirecting the appellant to approach the State of Punjab\t for<br \/>\nfurther\t posting  in  the said State.\tIt  seems  that\t the<br \/>\nappellant   did\t not,  on  his\town,  approach\tthe   Punjab<br \/>\nGovernment  for\t joining the duties in the said State  as  a<br \/>\nconsequence of the order of the Government of India  finally<br \/>\nallocating  him\t to  the State\tof  Punjab.   Meanwhile\t the<br \/>\nappellant attained the age of 58 years on December 30, 1970.<br \/>\nThereafter the appellant sent various representations to the<br \/>\nauthorities  in the State of Punjab as well as the State  of<br \/>\nHimachal Pradesh for grant of pension and other post-retiral<br \/>\nbenefits.    The   appellant   was   finally   informed\t  by<br \/>\nEngineer-in-Chief  H.P.\t PWD,  Shimla by  his  letter  dated<br \/>\nJanuary 31, 1981 that he should approach the Chief Engineer,<br \/>\nPunjab\tPWD  (B\t &amp; R) Branch, Patiala  for  payment  of\t his<br \/>\npension\t and gratuity.\tThe appellant was  further  informed<br \/>\nthat   he   should  approach  the   Agriculture\t  Production<br \/>\nCommissioner, Shimla, Himachal Pradesh for final payment  of<br \/>\nhis general provident fund.  Thereafter the appellant sent a<br \/>\nlegal notice dated June 21, 1983 through an advocate to\t all<br \/>\nthe  authorities concerned in the two States of\t Punjab\t and<br \/>\nHimachal Pradesh.  The Accountant-General Punjab, Chandigarh<br \/>\ninformed the appellant by his letter dated September 9, 1983<br \/>\nthat  nothing  could be done in respect of his\tpension\t and<br \/>\nother post-retiral benefits till the time the pension papers<br \/>\nare  received  by  the Accountant-General  Punjab  from\t the<br \/>\ndepartment  concerned of the Punjab Government.\t  No  action<br \/>\nhaving\tbeen  taken  by any of the authorities\tin  the\t two<br \/>\nStates of Himachal Pradesh and Punjab, the appellant finally<br \/>\napproached the Punjab and Haryana High Court for relief.  As<br \/>\nmentioned  above the High Court dismissed the writ  petition<br \/>\nof the appellant in limine.\n<\/p>\n<p>8.   Counter-affidavit has been filed on behalf of the State<br \/>\nof Punjab and the Chief Engineer, PWD (B &amp; R Branch) Punjab,<br \/>\nPatiala.  In para 9 of the counter-affidavit the stand taken<br \/>\nby the State of Punjab is as under:\n<\/p>\n<p><span class=\"hidden_text\">410<\/span><\/p>\n<blockquote><p>\t      &#8220;That  in reply to this Para, it is  submitted<br \/>\n\t      that the petitioner was allocated to the State<br \/>\n\t      of Himachal Pradesh, w.e.f. November 1,  1966.<br \/>\n\t      He   was\tretired\t by  the  Himachal   Pradesh<br \/>\n\t      Government,  vide order dated March 20,  1969,<br \/>\n\t      w.e.f.  May  14, 1968, when the  Hon&#8217;ble\tHigh<br \/>\n\t      Court  at Shimla, vide order  dated  September<br \/>\n\t      29,  1969\t set aside the above  order  on\t the<br \/>\n\t      ground that Union of India, vide their  letter<br \/>\n\t      dated May 19, 1969 had allocated him to Punjab<br \/>\n\t      State,  he  should have come  to\tPunjab.<br \/>\n\t      As admitted by the petitioner in para 7 of the<br \/>\n\t      petition, he did not join in the Punjab State.<br \/>\n\t      The  Government  of  Punjab,  therefore,\t had<br \/>\n\t      nothing to do with his pension case which\t was<br \/>\n\t      returned.&#8221;\n<\/p><\/blockquote>\n<p>9.   We\t are of the view that the stand taken by the  Punjab<br \/>\nGovernment is wholly unjustified.  As stated above the order<br \/>\ndated March 20, 1969 prematurely retiring the appellant from<br \/>\nservice was quashed by the Himachal Bench of the Delhi\tHigh<br \/>\nCourt  by  its\tjudgment dated September  29,  1969.   As  a<br \/>\nconsequence the appellant continued in service till December<br \/>\n31, 1970 when he attained the age of superannuation.  It  is<br \/>\nnot disputed that the appellant was finally allocated to the<br \/>\nState of Punjab with effect from November 1, 1966.  The\t net<br \/>\nresult\twould  be that the appellant shall be deemed  to  be<br \/>\ncontinuously  serving the State of Punjab with\teffect\tfrom<br \/>\nNovember  1, 1966.  He had joined service in  the  erstwhile<br \/>\nState  of Punjab on September 30, 1937.\t On March  20,\t1969<br \/>\nwhen he was prematurely retired by the State of Himachal  he<br \/>\nhad  already served the Government for about 32\t years.\t  He<br \/>\nwas  undoubtedly entitled to the grant of pension and  other<br \/>\npostretiral  benefits.\tSimply because the appellant  failed<br \/>\nto  submit joining report to the State of Punjab  after\t the<br \/>\njudgment of the Himachal Bench of Delhi High Court, he could<br \/>\nnot  be\t denied his right to pension and other\tbenefits  to<br \/>\nwhich  he was entitled on his attaining superannuation.\t  It<br \/>\nwas for the State of Himachal Pradesh to have reinstated the<br \/>\nappellant  in  service\tafter the High\tCourt  judgment\t and<br \/>\nthereafter relieved him to join the State of Punjab.  In any<br \/>\ncase  the  appellant, having been finally allocated  to\t the<br \/>\nState of Punjab, it is the State of Punjab which has to give<br \/>\npension and other retiral benefits to the appellant.\n<\/p>\n<p>10.  We, therefore, order and direct as under:\n<\/p>\n<blockquote><p>\t      (1)   The Himachal Pradesh Bench of Delhi High<br \/>\n\t      Court quashed the premature retirement of\t the<br \/>\n\t      appellant by its judgment dated September\t 29,<br \/>\n\t      1969.   The  appellant shall be deemed  to  be<br \/>\n\t      working  with  the State of  Himachal  Pradesh<br \/>\n\t      till September 30, 1969.\tWe direct the  State<br \/>\n\t      of   Himachal   Pradesh  through\t its   Chief<br \/>\n\t      Secretary\t and the Secretary, PWD to  pay\t the<br \/>\n\t      arrears  of salary due to the  appellant\ttill<br \/>\n\t      September 30, 1969 within two months from\t the<br \/>\n\t      receipt of this judgment.\n<\/p><\/blockquote>\n<blockquote><p>\t      (2)   Since the appellant did not join service<br \/>\n\t      with the State of Punjab from October 1,\t1969<br \/>\n\t      to December 31, 1970, he shall not be entitled<br \/>\n\t      to any salary for the said period.  The  State<br \/>\n\t      of  Punjab shall treat the said period  to  be<br \/>\n\t      leave  of the kind due to the appellant.\t The<br \/>\n\t      appellant shall be<br \/>\n<span class=\"hidden_text\">\t      411<\/span><br \/>\n\t      deemed  to have been retired from\t service  on<br \/>\n\t      December 31, 1970 when he attained the age  of<br \/>\n\t      superannuation.\n<\/p><\/blockquote>\n<blockquote><p>\t      (3)   The\t State of Himachal  Pradesh  through<br \/>\n\t      the   Secretary\tPWD  and   the\t Agriculture<br \/>\n\t      Production  Commissioner,\t Himachal   Pradesh,<br \/>\n\t      Shimla are directed to send the personal\tfile<br \/>\n\t      and  other record pertaining to the  appellant<br \/>\n\t      to  the  Chief Engineer, PWD (B &amp;\t R  Branch),<br \/>\n\t      Punjab,  Patiala.\t All the records  and  files<br \/>\n\t      which  are  necessary to\tfinalise  the  post-<br \/>\n\t      retiral  benefits\t of the appellant  shall  be<br \/>\n\t      sent by the Himachal authorities to the Punjab<br \/>\n\t      authorities.\n<\/p><\/blockquote>\n<blockquote><p>\t      (4)   The\t Chief Engineer PWD (B &amp; R  Branch),<br \/>\n\t      Patiala, the Secretary to Government PWD (B  &amp;<br \/>\n\t      R\t  Branch),   Punjab,  Chandigarh   and\t the<br \/>\n\t      Accountant-General   Punjab,  Chandigarh\t are<br \/>\n\t      directed\tto finalise the pension case of\t the<br \/>\n\t      appellant within two months of the receipt  of<br \/>\n\t      this  order.  All the arrears of\tthe  pension<br \/>\n\t      and other post-retiral benefits shall be\tpaid<br \/>\n\t      to the appellant within one month thereafter.<br \/>\n\t      (5)   The arrears of pension shall be paid  to<br \/>\n\t      the appellant with interest at the rate of 12%<br \/>\n\t      per annum; and<br \/>\n\t      (6)   we\tfurther direct the State  of  Punjab<br \/>\n\t      through the Secretary to Government PWD (B &amp; R<br \/>\n\t      Branch), Chandigarh and Chief Engineer (B &amp;  R<br \/>\n\t      Branch), Patiala to pay a sum of Rs 50,000  to<br \/>\n\t      the appellant within two weeks of the  receipt<br \/>\n\t      of   this\t judgment.   The  amount  shall\t  be<br \/>\n\t      adjusted\tat  the\t time of  making  the  final<br \/>\n\t      payment\tof   arrears  of  pension   to\t the<br \/>\n\t      appellant.\n<\/p><\/blockquote>\n<p>11.  The  appeal is allowed in the above terms\twith  costs.<br \/>\nWe  quantify  the costs as Rs 10,000.  The cost to  be\tpaid<br \/>\nhalf and half by the States of Punjab and Himachal Pradesh.\n<\/p>\n<p><span class=\"hidden_text\">412<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India R.R.
