A\tsuit  for  specific performance\t was  filed  by\t the<br \/>\nrespondent,  M\/s  lyengar Consultancy Services\tPvt.   Ltd.,<br \/>\nagainst\t the appellant United Commercial Bank in  the  Delhi<br \/>\nHigh  Court.   The suit was listed on 29-7-1988\t for  filing<br \/>\ndocuments and their admission or denial, when the defendant-<br \/>\nBank remained absent.  It was<br \/>\n+  Arising out of SLP (Civil) No. 13246 of 1992<br \/>\n<span class=\"hidden_text\">400<\/span><br \/>\nthen  listed  before the learned Single Judge  of  the\tHigh<br \/>\nCourt  on  12-8-1988, when the defendant was  again  absent.<br \/>\nThe  learned  Single Judge proceeded ex\t parte\tagainst\t the<br \/>\ndefendant on that date and the suit was then listed on\t9-9-<br \/>\n1988 as a short-cause for final disposal.  On that day also,<br \/>\nnone  appeared for the defendant in the suit.\tAccordingly,<br \/>\nthe  learned Single Judge decreed the suit ex parte on\tthat<br \/>\ndate.\tThereafter on 9-10-1988, an application for  setting<br \/>\naside the ex parte decree was made under Order IX Rule\tXIII<br \/>\nCPC  by\t the  defendant-Bank&#8217;s\tcounsel\t Shri  A.N.  Tewari,<br \/>\nsupported  by  his  own\t affidavit.   That  application\t was<br \/>\ndismissed   by\tthe  learned  Single  Judge   on   6-7-1989.<br \/>\nThereafter,  a\treview application was filed  by  Shri\tA.N.<br \/>\nTewari,\t which too was dismissed on 31-7-1991.\tIt was\tonly<br \/>\nthereafter  that the defendant-Bank learnt of the  ex  parte<br \/>\ndecree\tpassed against it.  Accordingly, it filed an  appeal<br \/>\nbefore the Division Bench of the High Court through  another<br \/>\ncounsel\t on  30-4-1992\tagainst the  orders  dismissing\t the<br \/>\napplication for setting aside the ex parte decree as well as<br \/>\nthe review application.\t This appeal was dismissed on  23-9-<br \/>\n1992  by  the Division Bench as time barred as\twell  as  on<br \/>\nmerits.\t Hence this appeal by special leave.\n<\/p>\n<p>4.The  appellant  has  adduced\tsufficient  material   to<br \/>\nsupport its submission that it was not aware of the  passing<br \/>\nof  the\t ex parte decree and that having engaged  Shri\tA.N.<br \/>\nTewari as its counsel, on the basis of the information given<br \/>\nby  the\t counsel  from\ttime  to  time,\t it  was  under\t the<br \/>\nimpression that the suit was pending and was being  properly<br \/>\ncontested.  It has also been shown from these documents that<br \/>\nit  was much after the passing of the ex parte\tdecree\tthat<br \/>\nthe  appellant came to know the factual position and it\t was<br \/>\nthen  that  the\t appellant took further\t steps\tby  engaging<br \/>\nanother counsel in place of Shri A.N. Tewari.\n<\/p>\n<p>5.In  view of the facts and circumstances  emerging  from<br \/>\nthe material placed before us, we are satisfied that this is<br \/>\na  fit case for setting aside the ex parte decree passed  by<br \/>\nthe  learned Single Judge of the High Court on 9-9-1988\t and<br \/>\nthe subsequent orders dismissing the application for setting<br \/>\naside  the  ex\tparte  decree  and  the\t review\t application<br \/>\ntogether with the order of the Division Bench dismissing the<br \/>\nappeal.\t  The  parties are required to be relegated  to\t the<br \/>\nposition as on 29-7-1988.  This is necessary in view of\t the<br \/>\nfact that 29-7-1988 had been fixed in the Court as the\tlast<br \/>\nchance\tfor  filing of documents and  admission\t and  denial<br \/>\nthereof by the parties.\n<\/p>\n<p>6.For the aforesaid reasons, the appeal is allowed.   The<br \/>\nex  parte decree dated 9-9-1988, the orders  dismissing\t the<br \/>\napplication  for setting aside the ex parte decree  and\t the<br \/>\nreview\tapplication  as well as the order  of  the  Division<br \/>\nBench of the High Court dismissing the appeal are set  aside<br \/>\nand the parties are relegated to the position which  existed<br \/>\nimmediately  prior to 29-7-1988.  Consequently, the  parties<br \/>\nwill  have one last chance only for filing of documents\t and<br \/>\nadmission  and denial thereof.\tNo further  opportunity\t for<br \/>\nthis  purpose  would  be granted by  the  High\tCourt.\t The<br \/>\nparties\t shall\tappear in the High Court on  11-10-1993\t for<br \/>\ntaking\tfurther\t directions in this  behalf,  including\t the<br \/>\nfixing\tof the date for filing the documents  and  admission<br \/>\nand  denial thereof.  The appellant shall pay Rs  10,000  as<br \/>\ncosts to the respondent on or before 11-10-1993.\n<\/p>\n<p>7.In  the facts and circumstances of this case,\t we  also<br \/>\nrequest\t  the  High  Court  to\tdispose\t of  the   suit\t  as<br \/>\nexpeditiously as possible.\n<\/p>\n<p><span class=\"hidden_text\">401<\/span><\/p>\n<p>8.In  view  of the statement made by the  learned  Solicitor<br \/>\nGeneral\t that proceedings have been initiated  against\tShri<br \/>\nA.N.
