Tiwari, J.<\/p>\n<p>1. The grievance of the petitioner is that without giving the details of deviations, the Notified Area Committee, Jamshedpur (respondent Nos. 3-5) have directed the petitioner to remove the deviations within 48 hours with the warning that if the deviations are not removed, the same shall be demolished by the said respondents and the cost of demolition shall be realized from the petitioner. Learned Counsel for the petitioner submitted that the said building was constructed in accordance with the sanctioned plan and there is no deviation. If the respondents find any such deviation, they should have specifically pointed out the same to the petitioner in writing. The petitioner does not understand as to which portion of the building is deviation and is unable to comply with the order due to its vagueness and unless the deviation is clearly pointed out. It has been submitted that in case of certain deviation even there is provision for rectification of the plan by realisation of the prescribed amount and the petitioner is ready for that too if the alleged deviation is specified by the respondents.\n<\/p>\n<p>2. Learned Counsel appearing on behalf of the respondents, on the other hand, submitted that the concerned respondents had made enquiry and found deviation in the petitioner&#8217;s building and such deviations were clearly pointed out and the petitioner is aware about the same. By the impugned notice the petitioner has been simply asked to remove the said deviations and there is no vagueness, illegality or arbitrariness in the impugned notice. Learned Counsel further submitted that if the petitioner so requires, details of deviations can be furnished to him. Learned Counsel submits that for that purpose a fresh notice with the details of deviations shall be furnished to the petitioner within two weeks and till then, no coercive action shall be taken against the petitioner and an opportunity shall be given to the petitioner to explain the deviations or to take appropriate steps in accordance with law.\n<\/p>\n<p>3. Considering the said fair stand taken by learned Counsel appearing on behalf of the respondents, this Court wish to dispose of the writ petition at this stage. If the respondents furnish the details of deviations and issue fresh notice to the petitioner within two weeks and provide an opportunity to the petitioner to explain the deviations, the petitioner shall take appropriate steps according to law.
