DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-223 of 2010 with Nadiad Rural Police Station, District:<br \/>\nKheda,  for the offences punishable under Sections 379 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel appearing for the applicant submits that charge-sheet is<br \/>\nfiled and considering the nature of evidence, role attributed to the<br \/>\napplicant and punishment prescribed and that the applicant is falsely<br \/>\nimplicated in the crime on the basis of the past instances, this<br \/>\napplication for bail may kindly be considered by imposing suitable<br \/>\nconditions.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP for the respondent &#8211; State who opposed grant of<br \/>\nbail looking to the nature and gravity of offence.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences and now the investigation is over, I am<br \/>\ninclined to enlarge the applicant on bail.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-223 of 2010 with<br \/>\nNadiad Rural Police Station, District: Kheda, on executing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) with one surety of the like<br \/>\namount to the satisfaction of the trial Court and subject to the<br \/>\nconditions that he shall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tthe<br \/>\napplicant will not enter into District of Kheda and Nadiad for a<br \/>\nperiod of six months except for attending the trial or marking<br \/>\npresence as the case may be.\n<\/p>\n<p>(f)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>(g)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
