3. Sri.Nataraj Ballal. the learned Counsel for the<\/p>\n
appellant M complainant strongly contended that the Trial<\/p>\n
Court committed an error in holding that there was nov.vseurvi’ce<\/p>\n
of statutory notice, issued by the complainaorit,””‘o_n—.:__tt2e”_<\/p>\n
accused and therefore. the complainant. catise of ”<\/p>\n
action to file this complaint against t}:1e..jr’ac’cused lfoi>.._Ath.e<\/p>\n
offence “under Section 138 of N.I.:5l_ct–..i.n respect. of <\/p>\n
cheques in question. He V__furtheVr___Vc0,ntended “that_the Trial
\nCourt committed further   there was no
\nlegally enforceable _d’e.bt eiristingggf  date of the<\/p>\n
cheques.\n<\/p>\n
4. _.Per co’i1tra,…Sri’\u00a7KlSl1ashikan.th Prasad, the learned
\n thee 1″‘espond”ent.l — accused strongly contended that<\/p>\n

l”.raVC,cused residing at the address to which the<\/p>\n
 notice EXP’? was sent by the complainant and<\/p>\n
l”._V”there1?ore–,-there was no service of said notice on the accused.<\/p>\n

\nHe further contended that the accused has successfully<\/p>\n
proved his defence through DWS. I and 2 that the two<\/p>\n
cheques i11 question were issued by him in blank ‘t.o”\u00bbathe<\/p>\n
complainant as security in respect. of the agreerne”nt\u00ab..entered~.<\/p>\n
into between the complainant and one Ashok   ~.. <\/p>\n
were not issued by him to the complainantstoWards”*disc’ha1?g.\u00a7eA<\/p>\n
of any existing debt.\n<\/p>\n

  that as on the relevant date, he was<\/p>\n

” it is ‘clear that the accused has successfully established<\/p>\n
that  the date of the said legal notice, he was not<\/p>\n

\ntowards discharge of any legally enforceable debt payable by

said to have entered into the ags’ee–rner1t’dated  <\/p>\n

\ncheques were given by the ‘ac{:L1sAepd%.i_to.  complainant as on<\/p>\n
the date of the said llvlbeing so, the<\/p>\n
cornplainarit  as on the date of the
\ncheques in any legally enforceable
\ndebt payable  the complainant or by the said
\n  and the accused issued the<\/p>\n
said  discharge of the said debt. Therefore. I<\/p>\n
 of the opiiliofnlthat the Trial; Court. did not commit any<\/p>\n
 in acqnittiiig the respondent M accused, of the said<\/p>\n
