     The accused in a prosecution for an offence u\/s.138 of<\/p>\n
the Negotiable Instruments Act is the revision petitioner, as<\/p>\n
he is aggrieved by the order of conviction and sentence<\/p>\n
imposed by the courts below.\n<\/p>\n
     2.  The case of the complainant is that towards the<\/p>\n
discharge of a debt due to the complainant, the accused<\/p>\n
issued a cheque dated 15.10.2007 for an amount of<\/p>\n
Rs.45,000\/-,   which   when     presented       for encashment<\/p>\n
dishonoured for want of sufficient fund in the account<\/p>\n
maintained by the accused and the cheque amount was not<\/p>\n
repaid inspite of a formal demand notice and thus the<\/p>\n
revision petitioner has committed the offence punishable<\/p>\n
u\/s.138 of the Negotiable Instruments Act. With the said<\/p>\n
Crl.R.P.No.1816 of 2010<\/p>\n

allegation, the complainant approached the Special Judicial<\/p>\n
First Class Magistrate (Marad Cases), Kozhikode by filing a<\/p>\n
formal complaint, upon which cognizance was taken u\/s.138<\/p>\n
of  the    Negotiable      Instruments  Act  and  instituted<\/p>\n
S.T.No.51\/2008.        During the course of the trial the<\/p>\n
complainant himself examined as PW1 and Exts.P1 to P6<\/p>\n
were marked. Though there was no witness examined from<\/p>\n
the side of the defence, Ext.D1 was marked. On the basis of<\/p>\n
the available materials and evidence on record, the trial<\/p>\n
court has found that the cheque in question was issued by<\/p>\n
the   revision     petitioner\/accused  for the purpose    of<\/p>\n
discharging his debt due to the complainant. Thus<\/p>\n
accordingly the court held that, the complainant has<\/p>\n
established the case against the accused\/revision petitioner<\/p>\n
and consequently found that the accused is guilty and thus<\/p>\n
convicted him u\/s.138 of the Negotiable Instruments Act.<\/p>\n
On such conviction, the trial court imposed sentence of<\/p>\n
simple imprisonment till the rising of the court and also<\/p>\n
Crl.R.P.No.1816 of 2010<\/p>\n

ordered to pay compensation of Rs.45,000\/- to the<\/p>\n
complainant under Sec.357(3) of Cr.P.C. and the default<\/p>\n
sentence is fixed as simple imprisonment for 3 months.<\/p>\n
     3.    Though an appeal was filed, the same was<\/p>\n
dismissed       by     judgment      dated    5.4.2010   in<\/p>\n
Crl.A.No.1028\/2008 of the court of Addl.District and<\/p>\n
Sessions Judge, Fast Track (Adhoc-II) Kozhikode confirming<\/p>\n
the conviction and sentence. It is the above conviction and<\/p>\n
sentence are challenged in this revision petition.<\/p>\n
     4.    I have heard the learned counsel appearing for<\/p>\n
the revision petitioner and also perused the judgments of<\/p>\n
the courts below.\n<\/p>\n
     5.    Reiterating    the     stand   taken    by   the<\/p>\n
accused\/revision petitioner during the trial and appeal,<\/p>\n
submitted that the complainant has not established the<\/p>\n
transaction and also the execution and issuance of the<\/p>\n
cheque.    But no case is made out to interfere with the<\/p>\n
concurrent findings of the trial court as well as the lower<\/p>\n

appellate court. Therefore, I find no merit in the revision<\/p>\n
petition and accordingly the conviction endorsed by the<\/p>\n
courts below against the revision petitioner u\/s.138 of the<\/p>\n
Negotiable Instruments Act is approved.<\/p>\n
      6.    The learned counsel for the revision petitioner<\/p>\n
submitted that a breathing time may be granted to the<\/p>\n
revision petitioner to deposit the compensation amount.<\/p>\n
      7.    Having regard to the facts and circumstances<\/p>\n
involved in the case, I am of the view that the said<\/p>\n
submission can be considered favourably but subject to<\/p>\n
slight enhancement of the compensation amount since the<\/p>\n
cheque is dated 15.10.2007.\n<\/p>\n
            In the result, this revision petition is disposed of<\/p>\n
confirming the conviction of the revision petitioner under<\/p>\n
Sec.138 of the N.I.Act and also confirming the sentence of<\/p>\n
imprisonment ordered by the trial court. The compensation<\/p>\n
amount is enhanced and the revision petitioner is directed<\/p>\n
to pay a sum of Rs.50,000\/- to the complainant as<\/p>\n
 Crl.R.P.No.1816 of 2010<\/p>\n
                             : 5 :<\/span><\/p>\n
compensation under Sec.357(3) of Cr.P.C. within 3 months<\/p>\n
from today. In case any failure in paying the compensation<\/p>\n
within the above stipulated time, the accused\/revision<\/p>\n
petitioner is directed to undergo simple imprisonment for a<\/p>\n
period of 3 months.       Accordingly the accused\/revision<\/p>\n
petitioner is directed to appear before the trial court on 7th<\/p>\n
October, 2010 to receive the sentence and to pay the<\/p>\n
compensation amount. In case any failure on the part of the<\/p>\n
revision petitioner in appearing before the court below as<\/p>\n
directed above and in making the deposit of compensation<\/p>\n
amount, the trial court is free to take coercive steps to<\/p>\n
secure the presence of the revision petitioner and to<\/p>\n
execute the sentence awarded against the revision<\/p>\n
petitioner.\n<\/p>\n<\/p>\n
