No.2899 of 2008\n            -------------------------------------------------\n           Dated this the 6th day of August, 2008\n\n                               ORDER\n<\/pre>\n<p>      The petitioners face indictment in a prosecution for<\/p>\n<p>offences   punishable,      inter    alia,   under     Sec.498A IPC.<\/p>\n<p>Cognizance has been taken on the basis of a final report<\/p>\n<p>submitted by the police after due investigation.              The 1st<\/p>\n<p>respondent herein is the wife of the 1st petitioner and<\/p>\n<p>daughter-in-law of petitioners 2 and 3.             Proceedings were<\/p>\n<p>initiated against the petitioners on the basis of the complaint of<\/p>\n<p>the 1st respondent herein.      Cognizance has been taken by the<\/p>\n<p>learned Magistrate.        Proceedings are pending before the<\/p>\n<p>learned Magistrate.       It is at this stage that the petitioners,<\/p>\n<p>along with the 1st respondent, have come before this Court to<\/p>\n<p>apprise this Court of the fact that the matrimonial disputes<\/p>\n<p>have been settled and the spouses have decided to dissolve the<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No.2899 of 2008 -: 2 :-<\/span><\/p>\n<p>marriage and reside separately. The 1st respondent has settled<\/p>\n<p>all the disputes with the petitioners and has compounded the<\/p>\n<p>offences allegedly committed by the petitioners. An application<\/p>\n<p>has been filed before the Family Court for dissolution of<\/p>\n<p>marriage.\n<\/p>\n<p>     2.   The petitioners as well as the 1st respondent report to<\/p>\n<p>this Court that the disputes between them having been settled,<\/p>\n<p>the   continuance    of   the  prosecution   is  irrelevant  and<\/p>\n<p>unnecessary.     It is, in these circumstances, prayed that the<\/p>\n<p>surviving prosecution against the petitioners may be quashed.<\/p>\n<p>An affidavit has been filed by the 1st respondent as Annexure-III<\/p>\n<p>in which it is confirmed that the matter is settled between the<\/p>\n<p>parties.\n<\/p>\n<p>     3. I am satisfied from the submissions made at the Bar by<\/p>\n<p>the learned counsel for the contestants as also from the<\/p>\n<p>documents produced that the disputes have been settled<\/p>\n<p>between the parties willingly and voluntarily and the 1st<\/p>\n<p>respondent has genuinely compounded the offences allegedly<\/p>\n<p>committed by the petitioners. If legally permissible and possible,<\/p>\n<p>the composition can be accepted and the premature termination<\/p>\n<p>of the proceedings can be brought about, I am satisfied.<\/p>\n<p>     4. The offence under Sec.498A of the IPC is not<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No.2899 of 2008 -: 3 :-<\/span><\/p>\n<p>compoundable. But the learned counsel for the parties, in these<\/p>\n<p>circumstances, rightly rely on the decision of the Supreme Court<\/p>\n<p>in B.S. Joshy v. State of Haryana (AIR 2003 SC 1386). I am<\/p>\n<p>satisfied   that, relying on the said decision, powers under<\/p>\n<p>Sec.482 of the Cr.P.C. can be invoked in the facts and<\/p>\n<p>circumstances of the instant case where such invocation is found<\/p>\n<p>to be eminently justified.\n<\/p>\n<p>      5. In the result:\n<\/p>\n<p>      (a) This Crl.M.C. is allowed.\n<\/p>\n<p>      (b) C.C.No.392\/06 before the learned Judicial First Class<\/p>\n<p>Magistrate, Irinjalakuda, against the petitioners is hereby<\/p>\n<p>quashed.\n<\/p>\n<\/p>\n<p>                                                  Sd\/-\n<\/p>\n<p>                                       (R.
