C. Setalvad, Attorney-General for India, (G.  N.  Joshi<br \/>\nand P.G. Gokhale, with him) for the respondents.<br \/>\n1954.  Mai 27.\tThe Judgment of the Court was delivered by<br \/>\nBOSE J.-This is a petition under article 32 of\tConstitution<br \/>\nand  raises  the  same\tquestion on the\t merits\t as  in\t the<br \/>\nconnected  summons  case in which we  have  just  delivered-<br \/>\njudgment.   The facts will be found there.  In\tthe  present<br \/>\nmatter it is enough to say that no question arises about the<br \/>\nbreach of a fundamental right.\tBut as a matter touching the<br \/>\njurisdiction  of  the Bar Council Tribunal and that  of\t the<br \/>\nBombay High Court was argued, we will deal with it shortly.<br \/>\nMr.  G&#8217;s first objection is that the proceedings before\t the<br \/>\nTribunal were ultra vires because there was no proper order.<br \/>\nof  appointment.   At a very early stage he applied  to\t the<br \/>\nRegistrar  and\talso to the Prothonotary for a copy  of\t the<br \/>\norder of the Chief Justice constituting<br \/>\n<span class=\"hidden_text\">502<\/span><br \/>\nthe  Tribunal.\t He was told by the  Prothonotary  that\t the<br \/>\norder was oral.\n<\/p>\n<p>Mr. &#8216; G&#8217;, put in two written statements before the  Tribunal<br \/>\nand did not challenge this statement of fact in either.\t  He<br \/>\ncontented  himself  with  saying that  the  &#8216;order  was\t not<br \/>\n&#8220;judicial&#8221;  and\t so-was\t not valid.  He\t took  up  the\tsame<br \/>\nattitude in the High Court.  The learned Judges said-<br \/>\n&#8220;The  record clearly shows that when it came to, the  notice<br \/>\nof  this Court it was decided to refer this case to the\t Bar<br \/>\nCouncil\t under section 10(2) and accordingly a Tribunal\t was<br \/>\nappointed  under section 11(1) by the learned Chief  justice<br \/>\nof this Court.&#8221;\n<\/p>\n<p>In  his\t petition to this Court he did\tnot  challenge\tthis<br \/>\nstatement  of  fact  but again confined his  attack  to\t the<br \/>\nquestion  of the validity of the order.\t It is evident\tfrom<br \/>\nall  this that the fact that an oral order was made was\t not<br \/>\nchallenged.  We cannot allow Mr. &#8216;G&#8217; to go behind that.<br \/>\n    The\t next question is whether an oral order\t is  enough:<br \/>\nBar  Councils Act does not lay down any procedure.   All  it<br \/>\nsays is-\n<\/p>\n<p>Section 10(2):\n<\/p>\n<p>&#8220;&#8230;&#8230;&#8230;&#8230;..\t the  High Court may of its  own  motion  so<br \/>\nrefer  any case in which it has otherwise reason to  believe<br \/>\nthat any such advocate has been so guilty.&#8221;<br \/>\nand section 11 (2) says&#8211;\n<\/p>\n<p>&#8220;The Tribunal shall consist of not less than  three&#8230;&#8230;&#8230;<br \/>\nmembers of the Bar Council appointed for the purpose of\t the<br \/>\ninquiry by the Chief Justice.&#8221;\n<\/p>\n<p>   We agree it is necessary that there should be some record<br \/>\nof  the\t order on the files but, in our opinion,  the  order<br \/>\nitself\tneed not be a written one; it can be an\t oral  order<br \/>\ngiven  to  a proper officer of the Court.   In\tthe  present<br \/>\ncase,  the letter No. G-1003 dated 29th April, 1953, of\t the<br \/>\nProthonotary to the Registrar and the letter No. E. 41-09\/53<br \/>\ndated the 1st May, 1953, of the Registrar to the Bar Council<br \/>\n(office\t copies of which were retained on the files)  are  a<br \/>\nsufficient  record of the making of the order.\tMr. &#8216;G&#8217;\t was<br \/>\nsupplied with copies<br \/>\n<span class=\"hidden_text\">503<\/span><br \/>\nof  those letters and so was aware of the fact\tthat  orders<br \/>\nhad  been  issued.  As a matter of fact, we  have  seen\t the<br \/>\noriginals of the High Court&#8217;s office files and find that the<br \/>\nnames of the three members of the Tribunal are in the  Chief<br \/>\nJustice&#8217;s handwriting with his initials underneath.  That is<br \/>\nan  additional record of the making of the order.   We\thold<br \/>\nthat  an  order\t recorded in the, manner set  out  above  is<br \/>\nsufficient  for the purposes of sections 10(2) and 11(2)  of<br \/>\nthe Bar Councils Act and hold that the Tribunal was  validly<br \/>\nappointed.\n<\/p>\n<p>   Mr.\tG&#8217;s next point is that there was no  &#8220;complaint&#8221;  to<br \/>\nthe  High Court and so it had no jurisdiction to  refer\t the<br \/>\nmatter to the Tribunal.\t This ignores the fact that the High<br \/>\nCourt  can refer a matter of this kind &#8220;of its\town  motion&#8221;<br \/>\nunder section 10(2) of the Bar Councils Act.<br \/>\nWe have dealt with the merits in the connected case.<br \/>\nThis petition is dismissed but, here again, we make no order<br \/>\nabout costs.\n<\/p>\n<p>\t\t\t\t       Petition dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mr vs The Honble Chief Justice And &#8230; on 27 May, 1954 Equivalent citations: 1954 AIR 560, 1955 SCR 501 Author: S R Das Bench: Mukherjea, B.K., Das, Sudhi Ranjan, Bose, Vivian, Hasan, Ghulam, Jagannadhadas, B.
