Notice issued by this<br \/>\n\tcourt is served on respondent no.1 Regional Passport Officer. As per<br \/>\n\tstatement made by learned advocate Mr. Devnani for petitioner, for<br \/>\n\trest of respondents no service has been effected because there is<br \/>\n\tsome difficulty, according to petitioner.\n<\/p>\n<p>Date<br \/>\n\tof birth of petitioner was 31.10.1978 at Anand, Taluka and District<br \/>\n\tAnand. Date of birth has been recorded in birth register at serial<br \/>\n\tno. 2932 on 4.11.1978. According to petitioner, while admitting<br \/>\n\tpetitioner in school, date of birth of the petitioner was mentioned<br \/>\n\tas 31.10.1979 instead of 31.10.1978. According to petitioner, there<br \/>\n\twas discrepancy with regard to date of birth in school leaving<br \/>\n\tcertificate comparing birth register of petitioner, therefore,<br \/>\n\tpetitioner approached respondent no.1 and requested to correct date<br \/>\n\tof birth mentioned in passport on the basis of birth register but<br \/>\n\trespondents denied to correct the same and petitioner has been asked<br \/>\n\tto obtain orders from Court of law.In light of these facts, let<br \/>\n\tpetitioner may make detailed representation to respondent no.1<br \/>\n\tRegional Passport Officer with a request to correct date of birth in<br \/>\n\tpassport on the basis of birth register which has been obtained by<br \/>\n\tpetitioner within fifteen days from the date of receipt of copy of<br \/>\n\tthis order. After receiving such request\/representation from<br \/>\n\tpetitioner, it is directed to respondent NO.1 Regional Passport<br \/>\n\tOfficer to consider representation made by petitioner on the basis<br \/>\n\tof the observations made by the Division Bench of this Court in case<br \/>\n\tof Regional Passport Officer versus Kokilaben, 2009(2) GLR 1246.<br \/>\n\tRelevant Para 9,10,11 and 12 of said decision are quoted as under:\n<\/p>\n<p> 9.\tWe<br \/>\n\tmay indicate that Registration of Births and Deaths Act, 1969 was<br \/>\n\tenacted to provide for births and deaths and matters connected<br \/>\n\ttherewith, which came into force with effect from 1.4.1970.  Chapter<br \/>\n\t3 of the Act provides for registration of births and deaths and<br \/>\n\tSection 13 is pertaining to delayed registration of births and<br \/>\n\tdeaths.  Sub-section (3) of Section 13 empowers a Magistrate of the<br \/>\n\tFirst Class to pass an order in case if birth or death is not<br \/>\n\tregistered within one year by its occurrence.  Initial registration<br \/>\n\tof births and deaths within a period of one year remain with the<br \/>\n\tauthority as provided under sub-section (1) and sub-section (2) of<br \/>\n\tSection 13 of the Act.  Section 15 of the Act deals with correction<br \/>\n\tor cancellation of entries in the register of Births and Deaths.<br \/>\n\tSection 15 of the Act, read with Rule 11 of the Gujarat Registration<br \/>\n\tof Births and Deaths Rules, 2004 provides for detailed procedure to<br \/>\n\tbe followed.  It says where it is proved to the satisfaction of the<br \/>\n\tregistrar that any entry of a birth or death in any register kept by<br \/>\n\thim under this Act is erroneous in form or substance, or has been<br \/>\n\tfraudulently or improperly made, he may, subject to such rules as<br \/>\n\tmay be made by the State Government with respect to the conditions<br \/>\n\ton which and the circumstances in which such entries may be or<br \/>\n\tcancel the entry by suitable entry in original entry, and shall sign<br \/>\n\tthe marginal entry and add thereto the date of the correction or<br \/>\n\tcancellation.  Thus, it is clear that if it is proved to the<br \/>\n\tsatisfaction of the Registrar that entry being erroneous in the<br \/>\n\tregister of births and deaths, and it has been fraudulently or<br \/>\n\timproperly made, he can make a report giving necessary details to<br \/>\n\tthe officer authorised by the Chief Registrar by general or special<br \/>\n\torder in this behalf under Section 25 of the Act and on hearing from<br \/>\n\thim, take necessary action in the matter.  Learned Single Judge of<br \/>\n\tthis Court in Nitaben Nareshbhai Patel Vs. State of Gujarat   2008<br \/>\n\t(1) G.L.R 884 elaborately considered the scope of above mentioned<br \/>\n\tprovisions, and the learned Single Judge also examined at length the<br \/>\n\tprovisions of Gujarat Secondary Education Act, 1972 and Gujarat<br \/>\n\tSecondary Education Regulation, 1974.  With regard to the change of<br \/>\n\tdate of birth entered in the school record, referring to Regulation<br \/>\n\t12(A), it was stated that if the student has actually left the<br \/>\n\tschool, no change can be effected in the record of the school.  For<br \/>\n\tmaking a change in the name, as provided under Regulation 12(5)(1),<br \/>\n\tan application in prescribed proforma with certain documents as<br \/>\n\tnarrated in Regulation 5(1)(A) to (D) are required to be submitted.<br \/>\n\t Regulation 12(6) deals with correction of date of birth, which is<br \/>\n\tpermissible only when student is studying in the school, and<br \/>\n\tthereafter it can be corrected by the concerned Magistrate of First<br \/>\n\tClass, upon proof of correct birth date.\n<\/p>\n<p>10.\tReference<br \/>\n\tmay also be made to the order passed by the Division Bench of this<br \/>\n\tCourt in Letters Patent Appeal No. 699 of 2003 in Special Civil<br \/>\n\tApplication No. 8122 of 2003, decided on 11.8.2003 (unreported). In<br \/>\n\tMinor Jagdishbhai Prabhatbhai Gohil Vs. State of Gujarat and others,<br \/>\n\t referring to Gujarat Secondary Education Regulation, this Court<br \/>\n\ttook the view that the only remedy available to the party with<br \/>\n\tregard to correction of date of birth\/place of birth is to approach<br \/>\n\tthe authority for redressal of his grievance as provided under<br \/>\n\tSection 13 of the Act.\n<\/p>\n<p>11.\tThe<br \/>\n\tabove discussion would amply show that for carrying out correction<br \/>\n\tof date of birth or place of birth or name, powers have been<br \/>\n\tconferred under the Act on the Registrar as well as the Judicial<br \/>\n\tMagistrate, as the case may be, and also Magistrate First Class when<br \/>\n\tthe correction is sought to be made in school record, which is<br \/>\n\tgoverned by Gujarat Secondary Education Act, 1972 and Regulation<br \/>\n\tframed thereunder.\n<\/p>\n<p>12.\tWe<br \/>\n\tare therefore, clearly of the view that Passport Authorities are not<br \/>\n\texpected to make their own independent enquiry when there is a<br \/>\n\tdispute or difference with regard to the date of birth, place of<br \/>\n\tbirth or name entered in the Passport, especially when entries were<br \/>\n\tonce made on the basis of records produced by  the Passport holder.<br \/>\n\tIf there is any mistake on the records already produced, based on<br \/>\n\twhich entries were already made, then it is for the party who seeks<br \/>\n\tcorrection to produce documents after carrying out necessary<br \/>\n\tcorrection by the concerned statutory authorities, Judicial<br \/>\n\tMagistrate or the Civil Court, as the case may be.  Passport<br \/>\n\tAuthorities are always competent to direct the parties to produce<br \/>\n\trelevant documents either from the authorities functioning under the<br \/>\n\tBirths and Deaths Register or from the Judicial Magistrate or from<br \/>\n\tthe Civil Court, as the case may be. On production of corrected<br \/>\n\tdocuments, Passport Authorities will immediately carry out necessary<br \/>\n\tcorrection in the Passport.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid observations made by Division Bench of this<br \/>\n\tCourt, it is directed to Regional  Passport Officer to consider<br \/>\n\tapplication\/representation made by petitioner and examine it and<br \/>\n\tpass appropriate reasoned orders in accordance with law within<br \/>\n\tperiod of one month from the date of receipt of such representation<br \/>\n\tfrom petitioner and communicate decision to petitioner immediately<br \/>\n\tthereafter.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this petition is disposed of<br \/>\n\twithout expressing any opinion on merits.
