PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 14\/02\/2011\n \n\nORAL\nORDER<\/pre>\n<p>Rule, Mr.H.L.\n<\/p>\n<p>\tJani, learned Additional Public Prosecutor, waives service of Rule<br \/>\n\ton behalf of the respondent-State.\n<\/p>\n<p>By way of present application, the<br \/>\n\tapplicant has prayed to modify the order dated 04th<br \/>\n\tAugust 2010 passed by this Hon&#8217;ble Court in Criminal Miscellaneous<br \/>\n\tApplication No.8548 of 2010. Condition No.(F) reads as under:\n<\/p>\n<p>&#8220;(F)-\n<\/p>\n<p>shall not enter within the territory of Viramgam Taluka except for<br \/>\nthe purpose of attending the Court on the date of hearing till the<br \/>\ntrial against him is completed.&#8221;\n<\/p>\n<p>Heard Mr.Girish D. Chavda, learned<br \/>\n\tcounsel for the applicant and Mr.H.L. Jani, learned Additional<br \/>\n\tPublic Prosecutor for the respondent-State.\n<\/p>\n<p>Mr.Girish Chavda has contended<br \/>\n\tthat applicant&#8217;s marriage is scheduled on 27th February<br \/>\n\t2011 and therefore, he has prayed for modification in condition<br \/>\n\tNo.(F) for temporary period.\n<\/p>\n<p>I have perused papers produced<br \/>\n\tbefore me as well as submission advanced by the learned counsel for<br \/>\n\tthe parties. Looking to the papers, it appears that applicant&#8217;s<br \/>\n\tmarriage is scheduled on 27th February 2011 and applicant<br \/>\n\thas placed on record Invitation Card on record. Looking to the<br \/>\n\tpapers produced and submission advanced by the learned counsel for<br \/>\n\tthe applicant, present application is allowed and Condition No.(F)<br \/>\n\timposed in order dated 04th August 2010 passed in<br \/>\n\tCriminal Miscellaneous Application No.8548 of 2010 is hereby<br \/>\n\ttemporarily modified to the extent that the applicant is allowed to<br \/>\n\tenter within the  territory of<br \/>\n\tViramgam Taluka from 22nd<br \/>\n\tFebruary 2011 to 04th<br \/>\n\tMarch 2011 on the condition that the applicant shall deposit<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) before the trial Court.
