Rs.1,10,502\/~ with interest at 12% p.a. from after 30\ndays from the date of accident till deposit.\n\nThis Appeal is coming on for admission this day,\n\nthe Court delivered the following:\n\n3 U D G M E N T\n\nThis appeal is byis that} insnranceglxcdmpanyl\n\nchallenging the quantum of compensaticn awarded\"b\u00a7 the\nLabour Officer & Workmens\ufb02 Compensation pommissioner,\n\n-.\n\nChitradurga (hereinafter_ \"referred \"*\u00a3\u00a7 as The\n\nCommissioner' for shortii ;,\"fjF\u00a2: the sake of\n\nconvenience4'Kparties\u00a7.are. referred to as they are\n\nreferred? tor in_ the _\u00a7;\u00e9im5 petition before the\n\ncommissionerq.,\"\n\n2. Brie\ufb01 facts of the case are:\n\n\"t On 30.\u00a7f20Qg,when the claimant was driving the\n\n' i\u00a2:;y_ bearing\" Reg.MED~7240 belonging to Respondent~2<\/pre>\n
“h\u00e9rei5,Y;;h\u00a7” Lorry met with an accident and he<\/p>\n
sustained injuries. Hence he filed a claim petition<\/p>\n
‘V, before” the Comissioner seeking compensation and it<\/p>\n
‘a\u00a7as* resisted by the insurance company by filing<\/p>\n
u”v~statement of objections.\n<\/p>\n

3. The claimant in support of his claim has examined
\nhimself as PW–l and the doctor who treated him as
\nPW-2. He has produced as many as 8 docu_:hen<tis'–VV which<\/p>\n
are marked as Ex.P-1 to 8. The <\/p>\n
examined its official as RW–_1,_y,V and pro'duced= insurance-..<\/p>\n
policy as Ex.R–2(l).\n<\/p>\n
4. The Commissioner afte”t;:”gonsiideringjt  oralliiand
\ndocumentary evidencekon  impugned judgment
\nhas held that the ciataaht has established that he has
\nsustained  \\’5;\u00a2\u00e9’i.def:;.\u00a3’V”‘occurred in the
\ncourse ofi.   he is entitled to
\nseek   the commissioner taking
\nnote  the  nature of his job,<\/p>\n
wages drawn,\u00bb nature  injuries sustained by him and<\/p>\n
 the”‘~I:ii:siability”\u00abstated by the doctor and assessing the<\/p>\n
 ‘3,os3_ -._off’.._e’arning capacity at 25%, has awarded<\/p>\n
taapen\u00e9ationf of Rs.l,10,502\/– with interest at 12%<\/p>\n
after days from the date of the accident.<\/p>\n

5. Sri.N.C.Seetharama Rao, learned counsel for the
\ninsurance company submits that the insurance company
\nin order to know the nature of injuries sustained by<\/p>\n
the claimant in the alleged accident’ fmadef_ an<\/p>\n
application before the Comissioneryseeking.direction<\/p>\n
to subject the claimant fora exawination dby_ Medical_:<\/p>\n
Board but it was rejected,\\ Therefore he subeits that
\nthe comissioner having ‘regectedb’the’Eanblication is
\nnot justified invLassessi\ufb01ghE%\ufb01\u00a2 itttl of earning
\ncapacity at 25% in “the labseng\u00e9fi\u00e9ff evidence of the<\/p>\n
doctor to thatKeffect.g–5<\/p>\n
6. With regard to awarding of interest at 12% after
\n30 days’ from _tr4\u00e9\u00ab..da.ti\u00e9tA..\u00a7’a:. award, he submits that it is<\/p>\n
contrary to thegjudg\ufb01ent of the Supreme Court in the<\/p>\n
 cas_’e5′.:. QRIEI\u00a7’i’AL ____ INSURANCE co. LTD. Vs. MOI-ID. NAZIR<\/p>\n
he’A$D,ANQTHE3f{A.I.R. 2009 S.C.W.–3717). Hence he prays<\/p>\n
to allow the appeal by setting aside the judgment and<\/p>\n
award \ufb01assed by the Comissioner.\n<\/p>\n

ll abpearing for the claimant submits that the claimant<\/p>\n
apart from examining himself as Pwml has examined the<\/p>\n
\ufb01g.\n<\/p>\n

do not propose to interfere with the said finding of<\/p>\n
the Comissioner.\n<\/p>\n
10. The doctor who treated. the claimant Whas” issued<\/p>\n
the disability certificate stating’ thatf thew claimant<\/p>\n
has stained 25% disability to the limhfx *He_has,pot’<\/p>\n
stated the disability caused! toh’the_*who1e;,hody? and.d<\/p>\n
what is the loss of earning capacity sestained by the
\nclaimant on account of the i\ufb01juri sestained by him in
\nthe accident. Of cohnse in the absence of evidence of
\nthe doctor to that effect it\ufb02nat not he proper for the<\/p>\n
Comissioner to assess the.loss_of earning capacity at<\/p>\n
25%. “Instead. St” teeandi\ufb01gw the matter on technical
\ngroundsf to ‘theicConmissioner for re–consideration,<\/p>\n
considering the materials available on record, it is<\/p>\n
\u00ab just and proper to assess the loss of earning capacity<\/p>\n
heat 15% as against 25% assessed by the comissioner. If<\/p>\n
that i\u00a7”s\u00a7 ‘the compensation works out to Rs.66,3OG\/–<\/p>\n
2. (4056 x shrine = 2400 x 184.17 x 15\/100).<\/p>\n
‘ii,v2With regard to awarding of interest at 12% p.a.<\/p>\n
V7_ “after 30 days from the date of the award, the matter<\/p>\n
is covered by the judgment of the Supreme court cited<\/p>\n
supra.\n<\/p>\n
12. Accordingly the appeal is allowed. Judg\ufb01ent and<\/p>\n
award of the Comissioner is hereby medifiedlq ‘The<\/p>\n
Claimant is entitled for a total compensatib\ufb01 of 35.<\/p>\n
66,300\/~ as against Rs.l,iQ,5Q2f\u00e9h;awarded,rhyd the d<\/p>\n
Commissioner with interest at 7.5% p.atWfrom the date
\nof claim petition till the date of award and 12% p.a.<\/p>\n
from the date of award till the date of nafment.<\/p>\n
13. In view of the de\ufb01osit of the entire amount of<\/p>\n
compensation by the insuranae com\ufb01any while preferring<\/p>\n
the appeal, series is directed to calculate the amount
\npayable to the slaimant as per this order and refund
\nthe balance amount if any to the insurance company.<\/p>\n
