Wadhwa, J.\n<\/p>\n<p>     In this  petition under  Article 32 of the Constitution<br \/>\nthe five petitioners have prayed for the following reliefs:\n<\/p>\n<blockquote><p>     &#8220;(a)  issue  declaration  that  the<br \/>\n     formation of  Accounts Cadre in the<br \/>\n     Food Corporation  of India\t made in<br \/>\n     the year 1997 is illegal, void;\n<\/p><\/blockquote>\n<blockquote><p>     (b)  issue\t  a  writ  of  certiorar<br \/>\n     quashing the  Circular No.3 of 1984<br \/>\n     dated 17.1.1987  Order  No.  57  of<br \/>\n     1987  dated   26.3.1987,  No.80  of<br \/>\n     1987, dated  22.4.1987 and No.87 of<br \/>\n     1987 dated 29.12.1987 issued by the<br \/>\n     Food\t  Corporation\t      of<br \/>\n     India\/Respondent No.1;\n<\/p><\/blockquote>\n<blockquote><p>     (c) direct\t the Food Corporation of<br \/>\n     India  by\tissuing\t an  appropriate<br \/>\n     writ in  that nature  mandamus that<br \/>\n     all  the\toptees\tin  pursuant  of<br \/>\n     Notification  dated   5.2.1977  and<br \/>\n     17.11.1977\/ and  Notification  No.3<br \/>\n     of 1984  dated 17.1.1984  be placed<br \/>\n     in their  respective cadres and may<br \/>\n     declare   that   all   the\t  optees<br \/>\n     aforesaid shall  remain  placed  in<br \/>\n     their   respective\t  cadres   where<br \/>\n     before 1977;<\/p><\/blockquote>\n<blockquote><p>     (d) issue\ta writ\tin the nature of<br \/>\n     prohibition     prohibiting     the<br \/>\n     respondents  from\t making\t further<br \/>\n     promotion in the Accounts Cadre;\n<\/p><\/blockquote>\n<blockquote><p>     (e)  to  declare  the  Notification<br \/>\n     dated   5.2.1977\tand   17.11.1977<br \/>\n     issued by Food Corporation of India<br \/>\n     as illegal and  void;\n<\/p><\/blockquote>\n<blockquote><p>     (f) any  other writ or writs, order<br \/>\n     or orders, direction or directions:\n<\/p><\/blockquote>\n<blockquote><p>     (g) allow the costs.&#8221;<\/p><\/blockquote>\n<p>     The petitioners  are working in the Food Corporation of<br \/>\nIndia, a Corporation, established under the Food Corporation<br \/>\nAct, 1964.\n<\/p>\n<p>     The  Corporation  with  the  approval  of\tthe  Central<br \/>\nGovernment took a decision to from a separate Accounts Cadre<br \/>\nfrom the level of Assistant Grade-III onwards. A circular to<br \/>\nthis effect was issued on February 2, 1977. It was stated in<br \/>\nthe circular  that Accounts Cadre at the level of AG III, AG<br \/>\nII and\tAG I  would initially  be formed  by transfer of the<br \/>\nqualified personnel  from the  General Administration Cadre.<br \/>\nOptions were, therefore, called for from the AG i in General<br \/>\nAdministration\tCadre\tpossessing  a  degree  in  Commerce,<br \/>\nMathematics or Statistics for transfer to the Accounts Cadre<br \/>\nas AG  i (A\/Cs),  It was  also mentioned that the options of<br \/>\nsuch AG\t I  (General  Administration  for  transfer  to\t the<br \/>\nAccounts  Cadre\t  would\t be   subject  to  their  passing  a<br \/>\ndepartmental test,  details of\twhich would  be intimated in<br \/>\ndue course.  Similar options  were called  from AG II and AG<br \/>\nIII (General;  Administration) for  their  transfer  to\t the<br \/>\ngrade of  AG II\t (A\/Cs) and  AG III  (A\/Cs) respectively.  A<br \/>\nnotification incorporation the policy decision was issued on<br \/>\nFebruary 5, 1977 and accordingly the Corporation amended the<br \/>\nFood Corporation  of India  (Staff) Regulation,\t 1971. If we<br \/>\nrefer to  the notification  initial recruitment to Assistant<br \/>\nGrade-III in  the  newly  formed  Accounts  Cadre  was\tfrom<br \/>\nAssistant  Grade   III\tof   General  Cadre  possessing\t the<br \/>\nprescribing qualifications  who would  be transferred to the<br \/>\nAccounts Cadre on the basis of option.\n<\/p>\n<p>     Subsequently by notification dated November 17, 1977 an<br \/>\namendment was issued which modified the earlier notification<br \/>\ndated February 5, 1977 which provided that initially all the<br \/>\nAssistant Managers,  Accounts Grade  I, II and III belonging<br \/>\nto all\tcadres and  possessing the  prescribed qualification<br \/>\nfor  respective\t  posts\t and   who  were  considered  to  be<br \/>\ncompetent  and\t capable  and  possessed  the  aptitude\t for<br \/>\naccounts work  would be transferred to the Accounts Cadre on<br \/>\nthe basis of such option. It had also been provided that the<br \/>\noptees were  to be  subject to\ta  very\t intensive  training<br \/>\ncourse and  that those\tselected in  the new  accounts cadre<br \/>\nwere to\t be given  necessary training  at the  Corporation&#8217;s<br \/>\nZonal  and   Central  Training\t Institutes.  Four   of\t the<br \/>\npetitioners are\t Assistant Grade  I and the 5th is Assistant<br \/>\nGrade III in the General Cadre (Administration).\n<\/p>\n<p>     It is  difficult to  understand how  can there  be\t any<br \/>\nchallenge if  the Corporation  decides to  form\t a  separate<br \/>\nAccounts Cadre\tconsidering the\t administrative necessity in<br \/>\nits working.  We also  fail to see as to how the petitioners<br \/>\nwho are similarly placed like other employees in the general<br \/>\ncadre, prejudiced  by formation\t selection of  the  separate<br \/>\nAccounts Cadre\tand consequent\tamending of  the Regulations<br \/>\nprescribing the\t qualification for the initial absorption in<br \/>\nthe newly  created cadre  and subsequent  filling up  of the<br \/>\nposts in  that cadre.  The petitioners\tcannot challenge the<br \/>\nqualification fixed  by the  Corporation for  absorption  or<br \/>\nsubsequent recruitment\tin the Accounts Cadre. It is not the<br \/>\ncase of\t the petitioners  that they  possessed the requisite<br \/>\nqualifications for  absorption in the Accounts Cadre or even<br \/>\nif they\t were qualified\t they gave any option for absorption<br \/>\nin the\tAccounts cadre\tor their  absorption was not acceded<br \/>\nto. Grievance  of the  petitioners appears  to be  that\t the<br \/>\noptees\twho  went  to  the  Accounts  Cadre  go\t accelerated<br \/>\npromotion which\t the petitioners  were unable  to get  while<br \/>\nstill working in the General Administration Cadre. That is a<br \/>\nchance an  employee takes  in any  service. The\t petitioners<br \/>\nrefer to  as many as 12 such officials who had been promoted<br \/>\nto the\tposts of  Assistant  Manager  (Accounts)  when\tthey<br \/>\npossessed qualifications  upto Matric,\tHigher Secondary  or<br \/>\nIntermediate  and  they\t were  lower  in  seniority  to\t the<br \/>\npetitioners in\tthe General Administration Cadre. Apart from<br \/>\nmentioning their  names, qualifications\t and their placement<br \/>\nin the\tseniority no  particular have  been given  if  those<br \/>\nofficials were first initially taken in Grade III (Accounts)<br \/>\nand subsequently  got promotions.  In  the  absence  of\t any<br \/>\nparticulars it\tis not possible for us to accept the plea of<br \/>\nthe petitioners.\n<\/p>\n<p>     Corporation issued\t a  circular  on  January  17,\t1984<br \/>\ninviting  reference   to  its\tearlier\t circulars  of\t1981<br \/>\nproviding for  withdrawal of  options  from  Accounts  Cadre<br \/>\nwithin a  particular period. Again options were given to the<br \/>\nemployees to  opt out  of the  Accounts Cadre and go back to<br \/>\nthe original  cadre. Options  were also given to category II<br \/>\nand III\t employees who\twere interested to join the Accounts<br \/>\nCadre  and  who\t possessed  necessary  qualification  and\/or<br \/>\nrequisite working experience prescribed for each post in the<br \/>\nAccounts Cadre in category II and III posts. In the circular<br \/>\nof January  17, 1984  it was  clearly stipulated  that those<br \/>\nemployees who  would opt  out of the Accounts Cadre would go<br \/>\nto their  original Cadre  and their transfer to the original<br \/>\ncadres would  be in  the same  grade  fro  which  they\twere<br \/>\ntransferred to\tthe Accounts  Cadre and that their seniority<br \/>\nwould, therefore,  be maintained in the original cadre as it<br \/>\nwas before  their transfer  to the  Accounts Cadre,  It\t was<br \/>\nclarified that\tif some of the juniors in the original cadre<br \/>\nstood promoted\tto higher  grades the optees who would stand<br \/>\nreverted  on   account\tof   their  option  should  also  be<br \/>\nconsidered for\tpromotion as  per the rules\/instructions. It<br \/>\nis again  difficult  to\t understand  the  grievance  of\t the<br \/>\npetitioners on\tthis Account  as well.\tThey cannot say that<br \/>\nthe employees  who had given their options once to go to the<br \/>\nAccounts Cadre should be stopped from all times to come back<br \/>\nto the\toriginal cadre\teven  if  they\tretained  their\t old<br \/>\nposition in  the seniority  in the  General Cadre. We do not<br \/>\nfind any  valid ground\tfor the petitioners to challenge the<br \/>\ndecision of  the Corporation  to give  the  options  to\t the<br \/>\nemployees in  the Accounts  Cadre  to  revert  back  to\t the<br \/>\noriginal cadre.\t All the  circulars to\twhich challenge have<br \/>\nbeen made  follow the general principles laid in the earlier<br \/>\ncirculars. We  find that  in  pursuance\t of  Circular  dated<br \/>\nJanuary 17,  1984 as  many as  170 employees gave options to<br \/>\nrevert back  from accounts  cadre to  their original  cadre.<br \/>\nThey perhaps did not find the Accounts Cadre to be lucrative<br \/>\nenough to  remain there.  It was newly constituted cadre and<br \/>\nthe employees  who gave\t their options\tto go  to that cadre<br \/>\nsubsequently did  not find  the usefulness of that cadre for<br \/>\ntheir service  for  some  reasons  or  the  others  and\t the<br \/>\nauthorities had\t given them  options  to  got  back  to\t the<br \/>\noriginal cadre.\t Petitioners cannot  make any  grievance  on<br \/>\nthat account<br \/>\n     We do  not find any merit in  this petition and dismiss<br \/>\nthe same.
