No.44651 of 2010\n                    KAPIL BHUINYAN, SON OF SRI RAMDEO BHUIYAN\n                                           Versus\n                                 THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>02   27.01.2011               Heard learned counsel for the petitioner as well<\/p>\n<p>                   as learned Public Prosecutor for the State.\n<\/p>\n<p>                                 Petitioner seeks his bail in connection with<\/p>\n<p>                   Madanpur P.S. Case No. 40 of 2000 registered under Sections<\/p>\n<p>                   147, 148, 149, 302, 120(B) of the Indian Penal Code, 27 of the<\/p>\n<p>                   Arms Act and 17 of Criminal law Amendment Act.<\/p>\n<p>                                 Although, petitioner is named in the First<\/p>\n<p>                   Information Report but no specific overt act has been<\/p>\n<p>                   attributed against him. It is stated in the First Information<\/p>\n<p>                   Report that it was co-accused Mandip Singh, Satyendra Singh,<\/p>\n<p>                   Sheo Gagan Bhuiyan, and Naga Bhuiyan, who opened<\/p>\n<p>                   indiscriminate firing from their respective weapons upon the<\/p>\n<p>                   informant&#8217;s brother, as a result, of which informant&#8217;s brother<\/p>\n<p>                   sustained fire arm injury and died then and there. Although,<\/p>\n<p>                   petitioner carries criminal antecedent of two cases but<\/p>\n<p>                   considering this aspect of the matter that petitioner is<\/p>\n<p>                   languishing in jail custody since 15.04.2008 I think it proper to<\/p>\n<p>                   release him on bail. Accordingly, above named petitioner is<\/p>\n<p>                   directed to be released on bail on furnishing bail bonds of Rs.<\/p>\n<p>                   10,000\/- (Ten Thousand) with two sureties of the like amount<\/p>\n<p>                   each to the satisfaction of Additional Sessions Judge-IV,<\/p>\n<p>                   Aurangabad in connection with Sessions Trial No. 282 of<\/p>\n<p>                   2000\/58 of 2009 arising out of above stated Madanpur P.S.<br \/>\n           Case No. 40 of 2000 subject to condition that one of the<\/p>\n<p>          sureties must be close relative of the petitioner and the<\/p>\n<p>          aforesaid surety must be holder of landed property.<\/p>\n<pre>Shahzad                        (Hemant Kumar Srivastava, J )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kapil Bhuinyan vs The State Of Bihar on 27 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
