 .  I .aga;[1]H \ufb01pga Poojari, he had developed intimacy<\/p>\n
   the wife of Lakshman, as such, the elder<\/p>\n

  '-swetitioner No.1), Basavanni Settepps Poojary (petitioner<\/p>\n
   Ramappa Mallappa Poojary (petitioner No.3) warned<\/p>\n
    deceased Balappa and three montlls prior to the date of<\/p>\n
V' complaint, there was a quarrel in the said regard in at<\/p>\n

   petitioner Setteppa Lawmappa Pujari and<\/p>\n
mud  was not there and he came to know that<\/p>\n
 he 3 gone to Shankeshwar Sandy; he suspected<\/p>\n
A 57 Eghettappa Lagamappa Pujari might have done harm to his<\/p>\n
V’   son and when he was making search for his son, about 100<\/p>\n
meters away from the house of Setteppa (A-1), he found<\/p>\n
crows howiing around near the said place, he got<\/p>\n

suspicious, he went to the said place   <\/p>\n

Lagemappe’   and his childxen namely,<\/p>\n
\u00ab V.  Ni\ufb01gep\ufb01a {Hot  for trial), Basavanni (A~5), Ramappa<\/p>\n
  (A~6) together had committed the murder<\/p>\n
of A1118 $3311. and as such, action should be taken<\/p>\n
egainstvtilem. The complaint was received by the police<\/p>\n
   p.n1 on 12.10.2007 in the police station located at a<\/p>\n
V%   -distance of 25 Kms. After receipt of complaint, the police<\/p>\n
A V  went to the scene of occurrence and held inquest<\/p>\n
panchanama between 3\u00ab 15 and 4-15 13.111 and at the time<\/p>\n

recorded statements of Sathigunda and<\/p>\n

\nfeet, they Went to  they saw Shetteppa<\/p>\n
Lagamappa Pujaxji [A-i)”,’\u00bb   ?ujari (A-5),<\/p>\n
Ramapfi-1″  present along with
\nBheeeiaopad  (A-2), Basavanni<\/p>\n
Gudadapfia HansuIA1AiV_(‘(A-3), Yallappa Gudadappa Hanami<\/p>\n
 –  ,   the deceased and they were assaulting<\/p>\n
    stones, they had removed their shirts and<\/p>\n
   their pants. The deceased Balappa was<\/p>\n
 (held ” A-I (Shetteppa Lagamappa Pujari) and his son
\n Shetteppa Pujari (A-5), Ramappa Mallappa<\/p>\n
     (A-6) were present along with Bheemappa Ramappa<\/p>\n
Ramanakatta @ Motugol (A-2), Basavanni Gudadeppa<\/p>\n
Hanami (A-3), Yallappa Gudedappa Hanami (A-4). The<\/p>\n
deceased Balappa was held by A-I Setteppa Legeznappa<\/p>\n
Pujari and his son Basavanni Shettappa Poja\ufb01   “me<\/p>\n
ccraccused Yaiiappa Gudedeppat   was   <\/p>\n
named in the orignal eomplaiiat a;1:i’a’;ua;;:.a;5pateete d<\/p>\n
Pujari were assaulting
\nYallappa Gudedappa  the left
\nside jaw, Ramappa  on the left
\nside jaw, Basafiatmi  named in the<\/p>\n

\naiso not eaaaaaaa said to the other accused<\/p>\n

4. According to CWS. 7 8: 8, the accused persons<\/p>\n
saw these two witnesses watching the incident in the
\n\u00bb2\u00a3ma,lu.._.\n<\/p>\n

they were a\ufb01aid, they felt feve\ufb01eh_,  \\v\u00e9e1;1;t’A’tQ e\ufb01ieuse

\nwanted to inform the #0  of the deceased,
\nthe   they found he had
\nalready   police station to lodge
\n    they informed him about<\/p>\n

 5.\u00bb The geeeeg of the complaint lodged by the<\/p>\n
 t%1\u00a7}ier::jef:A.tfie~:\u00a7Ieceased Balappa reveals that he found the<\/p>\n
  ef his son at about 8.45 am, and only after<\/p>\n
 the deadbody, in all probabilities, he must have<\/p>\n
   to the police station along with the scribe of the<\/p>\n
  __eemp1aint Mahaninga Kelnpanna Patil (CW22) and he in<\/p>\n
 his statement has stated that on 12.10.2007, people in the<\/p>\n
village were talking about murder of Balappa at about 9 ‘o’
\n)3 \ufb02l.u\\a,\/Llce.\n<\/p>\n

\nWitnesses   police. Surprisingly,
\nthe  M.K. Patil is recorded on\n<\/p>\n
13. 10.2007  date of lodging of the complaint<\/p>\n
aned\ufb01\ufb01d after   of inquest panchanama. No<\/p>\n
  forthcoming as to why there is a deiay in<\/p>\n
  statement till the next date i,e., on<\/p>\n

dd 6. It is to be noted that cw.7 and 8 claim that they<\/p>\n
‘V wldtxave seen the petitioenrs assauiting deceased Balappa<\/p>\n
during the night of 11.10.2007 at about 9.30 p.19 and they<\/p>\n
have further stated that they witnessed the incident in a<\/p>\n

\ufb02ash light ef battery and after seeing the entire  of<\/p>\n
each one of the accused persons  <\/p>\n
participating in the incident, the aceusetihh  tofgo <\/p>\n
away and alter seeing the i11cidet1t,’as     J<\/p>\n

\nreveals that the news of   spread in
\nthe village by 9 ‘o’   and the people
\nwere talking:  it after 9 ‘o’ clock,

\nwas  J\ufb01village, CW5. 7 85 8 have not<\/p>\n
 to  the complainant or CW.22 or other<\/p>\n

 Further, the version of these two witnesses<\/p>\n
  the incident in the \ufb02ash light of the torch, as<\/p>\n
 V. the accused persons were enacting a drama by allowing<\/p>\n
 witnesses to oompietely see the entire incident and<\/p>\n
V’  then thereafter asking them to go away \ufb01om the said place<\/p>\n
appears to be unnatural. Besides the nomexplanation of<\/p>\n

these witnesses (CW5. 7 & 8) of not  h’ 4′<\/p>\n

\n12.10.2007  between the
\ndeceased  oz}  one hand and the
\n   because the accused
\nPersonsvhaci\u00e9’ deceased was having illicit
\nintimacy  wife of Balappa. If that be<\/p>\n

   in the above two petitions are emitted for grant<\/p>\n
  However, it is made clear that the observations<\/p>\n
made above are restricted for the disposal of the present<\/p>\n
